Eastworks has failed to provide me with my full security deposit, failed to return my security deposit in a timely fashion, failed to provide interest on said security deposit, failed to provide explanation for full return of said security deposit. Deposit was [redacted] Eastworks returned [redacted] on [redacted] I vacated premises (after an inspection) on [redacted]Desired SettlementI would like a FULL refund of my security deposit.the balance due is $ [redacted]Business Response This complaint is unfortunate and unwarranted. This was a commercial lease and no interest is due or payable on a commercial security deposit.The complainant shared the rental space with two other people. All three people entered into and signed a single lease. For this reason, all three were jointly and severally responsible for lease obligations. At the end of the tenancy, a pro-rata share of charges for unpaid rent and disposal of items left behind were deducted from each tenant/party's security deposit. Such deductions are within our legal right and a full accounting was made to all three tenants. In 17 years of working for this organization, we have never before been reported to the Revdex.com. It should also be noted that the owner of this business sat down with all three tenants prior to signing and discussed the headaches that can arise with several parties on the same lease. Because of this experience, we no longer offer shared leases for non-business related parties.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)The original lease was over 3 years old.It expired after one year.No additional lease had been signed by me in the last 12 months.I was a tenant at [redacted].I continued in good faith to pay all rents due. I was at the studio site on the final day with the office manager to view my space and make it clear that I had emptied the space of my belongings and cleaned it as well. According to the owner of Eastworks, he must have a lease agreement from the other 2 tenants; yet he has chosen to extort his loss of unpaid rent (from the other occupants) from me. I did not agree to this. I did not enter into any lease agreeing to pay other tenants unpaid rent. If Eastworks does not return my full deposit I will have no other choice but to file an additional complaint with the attorney general's office. Final Business Response This unit was leased to three persons as a SINGLE tenancy. All three persons were jointly and individually responsible for the obligations of the tenant. The term of the Lease did end as Ms [redacted] says. HOWEVER the tenant held over. Paragraph XIX of the attached lease establishes that all of the obligations of the lease continue in that event. Ms [redacted] is not responsible for one-third of the obligation; she is responsible for all of it. Her argument is not with Eastworks but with her partners.Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)Eastworks has not offered any resolution. Eastworks is holding me personally responsible for the unpaid rent and/or security deposits of their tenants. This is theft and extortion.
