I hired Easy living to paint my house and so far they have not done so... It's been over 2 weeks. [redacted] with Easy Living came out and did a bid on painting my house. He was very professional and knowledgeable. I hired his company on the 5th of May. I mailed Easy Living 1/2 of the amount of the bid as they required.They have emailed me several times with dates that they would be out and start painting. As of the 24th, which they were support to be here....no painters.Desired SettlementI just want to have my house painted.Business Response This is the first that ELC has seen of this complaint. Mrs[redacted];s Home was completed the week of June 15th. The job delay was due to the very unfavorable weather conditions. We did receive the deposit on May 5th as stated by Mrs.[redacted], but she was informed that ELC was 10 days from starting. [redacted] received over 10" of rain from the time we attempted to schedule until we started and completed her project. ELC does sympathize with her frustrations due to the long delay, but once the weather lifted, our painters completed her project.

The Original Warranty Items for the Interior were performed on 1/3/2013 and anything else listed above, *LC did not receive an opportunity to review any of the other issues listed above. *LC does not take responsibility for those items as Mr. [redacted] has been lead to believe by[redacted]'s [redacted]). [redacted] is an un-licensed contractor in the state of TN. No contractor license (General Contractor or Home Improvement) or Liability Insurance was on file with the State of TN Insurance and Commerce Department for the owner[redacted] or[redacted]'s [redacted] while [redacted] performed work at[redacted] Rd. *LC does not deny that water damages did occur to the property as described but nothing has been shown by [redacted] that it was the fault of *LC with emphasis to the roof leak.The roof installed by *LC underwent many rain storms without any leaks thus indicating possible storm damage or a leak from a different location (non related to *LC work) that was seen evident in the Breakfast Room.*LC has already paid Mr. [redacted] $600.00 and is prepared to pay an additional $1,645.00 to cover the items listed below in blue once we have received the signed Release of Liability.1. Driveway:Remove (2) damaged sectionsRe-form & re-pour with washed finish2. Miscellaneous:Adjust front & back door to seal and add (2) small weather strip pieces at bottom of both doorsRemove and reset gutter on rear porch for drainage.3. Replace Weather stripping on the Garage door and paint.*LC is willing to participate in Arbitration under the direction of the Revdex.com if needed to resolve this matter.Thanks,[redacted]C*O*asy Living Construction Co., LLC.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)Mr[redacted] received the invoice for the warranty repair work on June,13,2013 and raised no objection to its appropriateness, The scope of the work that was billed in that invoice was discussed with him on an ongoing basis by[redacted] Constructiion during the repair period so that he was fully advised of the nature and costs being incurred. [redacted] was recommended by Mr.[redacted] to do the warranty work as he had been one of the lead supervisors of the original work on the house when they worked for *asy Living [redacted]. Mr.[redacted] at no time during the time that the original work was being preformed nor while the repair work was being done suggested that it was not being performed professionally and with integrity. It is irrefutable that the molded and damaged dry wall in the kitchen were the result of the flashing that was incorrectly installed in the addition to the main house constructed by *asy Living [redacted]. *ach of the roofers consulted as possible job contractors for the roof repair were unanimous in that opinion. The roof leak appeared shortly following the completion of the addition and gradually worsened as time went on. I do not believe that the offer of arbitration is appropriate in that there is really nothing to arbitrate. There is copious documentation from *asy Living [redacted] acknowledging responsibility for the invoice as originally sent to him and these will be used if it is necessary to produce them. I personally think that discrediting[redacted] after recommending them for the warranty job speaks much much more about the character of Mr[redacted] than it does of Mr.[redacted]. In this regard Mr[redacted] reminds me of a gentleman that I once was acquainted with who had thousands of dollars of cabinets installed in his home and then deliberately defaced one of them in an inconspicuous place as an excuse not to pay for them. Respectfully, [redacted]Final Business Response *LC did NOT recommend[redacted] Company ([redacted]) to Mr. [redacted], but it was Mr [redacted] who hired[redacted] on his on accord to have said work performed as he had done on his other investment properties. ELC was instructed by Mr [redacted] to pay for what he felt was warranty; regardless. ELC has only agreed to the warranty work that was listed in the previous response. In regards to the discrediting of[redacted]s Consruction Company, ELC only states that the warranty work was performed by an unlicensed contractor and this in no way a personal attack against[redacted] Company but just an awareness for Mr [redacted]'s benefit since [redacted] does work on his investment properties along with currently maintaining his[redacted] Rd property. As far as discrediting [redacted], ELC has recently paid over $38,000.00 in repairs that [redacted] has refused to warranty and damages caused on jobs due to negligence as an independent operating company. It was just recently that ELC was made aware of [redacted]'s lack of Contractor License in TN.Mr [redacted] has not justified the following:Why was the breezeway doors rebuilt? ELC is not responsible for storm damage to the doors.Why did [redacted] Re-paint siding & windows as necessary after Mr [redacted] approved the paint job on the final walk after he made final payment to ELC. Why was the stucco on house above screen porch/breakfast area wall sealed? There is no logical explanation for this being done especially since there is no stucco above the porch. There is only a slurry finish over existing brick thus no sealer is needed.As recalled, the roofing area was repaired early in the construction project and there was no leaking at all through the course of the 6 month job. Please provide the roofing contractor information that repaired the leak along with the documentation supporting claim of *LC workmanship causing leak.Why was the following considered warranty;Theater Room:Replace broken transomCenter AC vent & patch sheetrock back to smooth finishRe-paint ceiling & walls as necessaryLiving Room:Replace base along breakfast room wallRemove molded sheetrockPaint walls & trim as necessaryBreakfast Area:Remove crown on beam & base boards on living room wallRemove all molded sheetrock & insulationRe-insulateRe-sheetrock beam and (2) sections of wallRe-finish damaged area of ceilingRe-paint walls, ceiling & trim as necessaryMiscellaneous:Adjust front & back door to seal and add (2) small weather strip pieces at bottom of both doorsThe entire project was walked with Mr [redacted] after completing his punch list in order to receive final payment.Again, *LC will submit payment for only warranty work responsible to *LC once both parties have agreed on a final number and Mr [redacted] signs the [redacted] Liability Release form

Our floors were replaced in march [redacted] due to mold and severe warping. The same floors are doing it again. Easy Living has denied any responsibility.We contracted to have 1300 sq feet added in [redacted] with ELC. The work was completed in [redacted]. We spent around $150k with them. The added hardwood floors began to warp severely. The conversations regarding the warping and subsequent mold began in [redacted].After two hardwood floor companies ELC contacted said the floor damage was due to no vapor barrier being put down, Easy Living replaced the floors in [redacted] (mold being present the entire time). The floor began warping again. We first contacted ELC again about the floor in [redacted], only five months after the replaced floor. ELC kept saying they would send someone out to look at the floor but never did. We contracted to a structural engineer look at the space ($395 out of our pocket). They gave us a certified letter that there were not enough vents added for circulation for the square feet added and that it wasn't up to code. We gave ELC this letter and they stated they could not do anything else as it passed [redacted] and they didn't see that they did anything wrong. My husband spoke about litigation and [redacted] told my husband to not contact him again. After spending $150k I expected to have a house that was livable. I'm sure mold is already growing with our two small children in the house. We had existing hardwood floors in the front of the house and they have not warped any in this time frame. [redacted] also stated he could do anything because he felt it was a moisture problem. Even if true (though not what structural engineer states), isn't that a contractor's job to make sure everything is ready for building including the land? Desired SettlementMy husband has purchased the vents that are needed to create the circulation. We would like to be reimbursed for the structural engineer ($395)and the vents purchased. We would also like the vents installed. Finally, after the problem is remedied the floor needs to be sanded and restained. I think if this is done now full replacement is not needed. However, the longer this waits the more likely full replacement of the floor for the second time will be neeeded.Business Response The floors were repaired according manufacturers instructions and the ventilation was installed according [redacted] Code Enforcement regulations and inspected by the Building Inspector during the time of construction. ELC removed all mold and replaced the floors by using a different installer for the installation of the Hardwood Floors. ELC installed a moisture barrier under the house that is twice the recommended thickness needed, installed drainage system to divert water away from the home, and sealed up a secondary access point under the home. ELC has made all efforts to remedy the problem but the engineer hired by the homeowner has not provided definitive evidence that their findings is the determining problem and moreover the solution to fix the problem. In short, the engineer that was hired was only speculating with no certainty. At this time ELC cannot warranty a product that is being damaged by an unknown water source and the contract signed by the homeowner states that ELC is not responsible for damages to the property due to natural causes.Thanks[redacted] Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)The Poe Engineering firm did not speculate but definitively stated what was causing the floors to buckle (lack of air circulation in crawlspace) and offered a remedy which we the homeowner have now performed. Poe Engineering stated that more vents were required and stated where they should have been place during the time of the build. Again this has now been done at the expense of the homeowner. I have attached the report for review.In addition, I believe the fact that the company did not make the first two deadlines for response should be reflected in the Revdex.com score. As a consumer, the fact that the case had to be put on "hold" to wait for a response for three months from a company is something I would want to know before doing business with them.Final Business Response
