Attached to this response is a screenshot from out online payment screen. In the screenshot you can see that we list the charges itemized and the person must click acknowledgement before the payment can be made. Therefore in the event that [redacted] says he that he never toured the community nor was he given the price sheet the charges are itemized on the payment screen and there is no way to get around seeing them due to the fact you have to acknowledge before we accept payment.

[redacted] is a previous tenant whose lease agreement expired at noon on July 31, 2017 (see attached lease agreement). All tenants are made aware of the lease termination date and time at move-in and at less 45 days prior to the actual termination date (see attached move out notice that went out...

to the community via email and hard company posted to each apartment on June 6, 2017). This is standard across the board at our community being that all leases expire on the same date and time. The upfront fees to lease at Oxford Village ($40 application fee, $200 reservation fee & $200 security deposit) are told to prospects numerous times before applying to the community. Since our transition to [redacted] from [redacted] Management we’ve moved to online leasing, in which prospects can make the payments for upfront fees, apply and sign their lease agreement all online. **. [redacted] used our online system to make his payment for upfront fees, apply and sign his lease at Oxford Village. He made his payments on June 24, 2017 (see attached resident & deposit ledgers). You will see the app fee and reservation fee charges and payment on the resident ledger and the security deposit charge and payment on the deposit ledger. The payment landing page online shows the payment amount and description for each upfront fee (see attached screenshot from payment landing page).  The first page of the lease agreement has the amount of the security deposit listed. The reservation fee is not listed there due to the lease being a new rollout from the transition between management companies. However the fees are disclosed during the prospect tour, the prospect is also provided with a rate sheet tour once the tour is completed (see attached rate sheet that was used at the time of [redacted] tour) and again as stated earlier in this reply the fees disclosed on the payments landing page. These disclosures are all done prior to signing the lease agreement and as you’ll see [redacted] made the payments on the 24th when his documents are dated for but did not sign the agreement until the 27th. [redacted] also had to acknowledge understanding the upfront fees or the online system would not had processed his payments. In the lease agreement the tenant has the option to request to have a move out inspection completed with them being present. In the move out letter date June 6th tenants were instructed to schedule an appointment with the leasing office. [redacted] choose to not request a scheduled inspection with him being present and turned in his keys not being present for the inspection. Our common practice here at Oxford Village is when tenants turn in keys without requesting to be present for the inspection we advise them to go back to the apartment and take date stamped photos. We advise them to do that for this very situation at hand. I am not certain if [redacted] did or did not take date stamped photos of apartment at his departure. However, when photos were requested to support his claims that he cleaned and left no trash he was unable to provide them.  Attached are photos from the move out inspection of apartment [redacted]. As clearly defined in the move out letter all tenants are responsible for the apartment common areas.  [redacted] security was handle strictly in accordance with the state of Pennsylvania requirements (see attached security deposit Addendum A signed by [redacted]) and the landlord and tenant act for Philadelphia. The Final Account Statement was sent to him on August 6th detailing why a portion of the deposit would not be returned and he received the deposit due to him within the allotted timeframe, which he acknowledges that both were done.
