I had been going to this doctors office but was having issues with their services. I have had trouble getting blood work results from them, they have changed my medications on me, and just trying to get in touch with people in the office in general. Due to these issues with this office, I decided to cancel services back at the end of July. I had been paying this office $60 a month for their services which I was set up through automatic payments out of my bank account. I received a confirmation from the office that I did cancel, yet I have continued to be billed by this office since I cancelled for the last 3 months. I have tried numerous times a day to get a hold of them to get my refund. I have been unsuccessful. I just want my last 3 months of payments refunded since I no longer used their service.

In regards to the above reference complaint, please find the provided response. The situation has been resolved as follows:

*** completed the Membership Cancellation form (copy enclosed) on July 28, 2018. As per our policy, and as stated on the Membership Cancellation form, a 30 day notice is required and the patient is responsible for payment of the remaining full month’s charges. *** had been set up to pay his monthly membership charges in three month increments. At the time of Mr. Purcell’s cancellation, he was still responsible for the payment of the August 2018 monthly membership charge, however his payment was processed for the full three months of services.

An attempt was made to refund the remaining two month’s charges to *** card, however his card had been cancelled. In addition, we attempted phone contact several times and were not able to leave a voicemail due to the mailbox being full and not accepting any new messages.

Enclosed with this response is a copy of the Membership Cancellation Form, copy of the refund check payable to Christopher Purcell in the amount of $118.00, as well as the certified mail receipt. This $118.00 check is equal to the two months of membership that *** will not be responsible for. Contact was made with *** and he is agreeable to this. Desired settlement has been reached.

RE: Refund

Dear Mr. Purcell,
Enclosed you will find a copy of your Membership Cancellation form that was completed and signed on July 28, 20018. As per our policy, and as stated on the Membership Cancellation form, a 30 day notice is required and the patient is responsible for payment of the remaining full month’s charges. Along with a copy of the Membership Cancellation Form, a refund check payable to you is enclosed in the amount of $118.00. This $118.00 check is equal to the two months of membership that you are not responsible for. This will be considered your full refund as per your conversation with the Office Manager in which you voiced understanding.

When my doctor retired, he left his medical records to Dr. *** who was with EBO MD at that time. A few months passed and a rep from EBO MD called and asked if I would like to use EBO MD as my medical provider since I had not yet found a new doctor. I told him that I did not because I had insurance and they did not accept insurance. He told me that I could sign up and they would grandfather me in under the same fee I was paying my doctor who had retired and that when I found a new doctor I could just quit. So I agreed to do that. I paid the monthly fee of 189 for my family until I found out in November of 2016 that the doctor had quit in September. They knew the doctor had quit on September 16. They typed up a letter on Oct 3 and they didn't mail it out until November 8. So I had paid for three months where there was no doctor. I stopped sending them checks. A few months later I asked them to send our medical records to our new doctor. They told me that I owed them another $189 and that they were turning it over to a collection agency. They have not explained why I owe them 189 and the collection agency says they see my point but it is still in collection.

We have a 3 month cancellation notice policy. ***’s doctor walked out one day with no notice and that is with the Board of Healing Arts. We sent out a letter to all of his patients letting them know and that there would be no interruption in care and they could be seen by our nurse practitioner or another doctor. I believe she did see another person in our office. We have a signed agreement from Ms. for the notice policy. We did turn her over for collections for the amount she is speaking of, but if it will resolve the issue, I will write it off. I will let the collection company know.
