Dear *** ***,I represent EC Research Corp and am writing in response to Complaint No*** filed by *** *** ***.*** ***, you will note, filed her Complaint with you on May 10, This was four days after I had a very lengthy conversation with her mother, explaining why the
documents in my possession, including *** ***'s medical records, refuted her claims of injury.*** *** claims in the Complaint filed with you that she needs her past medical bills of $paidThis is an interesting claim as her medical bills at *** *** ER, which were paid by Medicare, were for the diagnosis and treatment of the following complaint: “year old female...presents with the chief complaint of painful, ulcerated rash in her genital area spreading to her thighsIt is associated with hematuria, dysuria, frequency and suprapubic pain.” Nowhere in those records was any mention of any use of a skin cream of any kind by *** ***.*** *** told me that she bought three bottles of *** - In January of 2015, I sent E.CResearch's check in the amount of $to *** *** which she cashed.*** *** has recently produced two receipts - dated June and July respectively, each for a check issued by *** *** to *** *** for a refund for a total of two containers of EC Research's cream.When we were first contacted by *** ***, we had no reason to believe her story was fabricatedWe now have every reason to believe it was fabricatedContrast her claim to you, made after I explained the factual inaccuracies in her story to her mother, with the taped (and the transcript as edited by *** ***) statement *** *** provided earlier to me:Transcript of *** *** of March 31, Taken at Cafe“***: So I bought three bottles of the *** - *** - that's what it was calledThe yellow box bottleI had used *** *** and I had gone home and used um, I don't remember when it wasIt was really close 'cuz I could not wait to try it - the creamI was excited to see what the results would beI know I used like uh, maybe this amount on each thigh - this amount of cream on each thigh and as soon as I applied the cream - at first I felt a tingling right away but I thought it was a feeling, like the tingling sensation - I thought that was noting, it was working, you know? Review: I order the [redacted] which is an product that EC research Corp says helps reduce the appearance of stretch marks in as little as 3 weeks. I purchased the cream and heat activator on April 3,2014. It took 5-7 business days to receive my product which puts delivery at the earliest April 11,2014. I used the product for 30 days twice a day as instructed, however I had no results in the process. I contacted EC research to request a refund on June 6,2014 and the said my 60 day return policy had past. I disputed this with the representative how can the policy start when the product wasn't in my possession. How can I be accountable. I just want my money back the product was a failure and didn't work at all.Desired Settlement: I want my 89.13 refunded to me. I can return the rest of the product but I want my money back.
