Review: My husband and I enrolled into the ECC Fitness sometime last summer. We paid the 1st & last month up front and it was $51 per month. [redacted] said we can cancel at anytime with no problems as we had problems before when his gym was on [redacted] informed me that the issue with the continous payments and the over-payment will not happen again. August was our last month at the gym as the summer was over and we had to get back to work. I verbally ask [redacted] to stop the monthly payments and he said it will stop. Months past, I noticed that the payments are still coming out so I called again. He said he'll take care of it. more months past and I noticed that the payments was still coming out. He said that he do not know why it's still coming out so he ask me to send him an e-mail as a written notice. I CC'd my attorney along with his main head quarters as they will stop the payments.I sent that e-mail in December 2012. Now it's a new year and to this day, the payments are still coming out. I called [redacted] in January and he said he'll call me back in 15 minutes as he was going to call his people to give me a refund and since then, I never heard from him again. I call, he don't answer. I call a different number and they say that he'll call me back and he never do. Now March is right around the corner and I know they will debit our account again and they need to stop this illegal transaction. This is FRAUD!Desired Settlement: I want a full refund for every month we wasn't there starting September 2012 and the months are as followed:* Sept 2012 - $51* Oct 2012 - $51* Nov 2012 - $51* Dec 2012 - $51* Jan 2013 - $51* Feb 2013 - $51* Mar 2013 - $51If I have to involve my Attorney, [redacted] will have to pay my Attorney's fees and court costs.

Review: The manager of the fitness club made unauthorized payments to my credit card numerous times and has yet to refund me. A payment was deducted on the 7th of september that I never authorized of $99. And june, july, and aug, 106.85 was taken out of my account each time which was refunded the end of september after numerous phone calls and me going to the gym trying to touch bases with him when he would be there. I also ordered a pair of sneakers for $80 in may. I never recieved them. I would ask him every week when I was going to get them but he always gave me an excuse."I forgot them, Oh I dont have the key to the storage office to get them, Oh they were sent back for some reason". Despite the rough patches I still needed to workout since I was already paying him to train me(my contract was for a cash agreement month to month and my sons contract was for my debit card but his account was frozen due to him being in school so no payments were suppose to be coming out of my card at all). But I would show up on time and the gym would still be closed and he would never show up. Ignoring my calls and txt, I just got tired of the unprofessional enviroment I was in. Only to hear "Im sorry I had a toothache or I was having car trouble". And this would go on every week so I had to let him know this wasn't right . In regards to my funds, I have tried calling and leaving messages and also going to the fitness center during business hours and the gym would completely closed everytime I would go. Ofa (owner/manager of that location) would take 2 to 3 weeks to get back to me and then give me the run around about my funds being put back into my account. And he has yet to refund me and shows no compassion for messing my account up and other numerous inconveniences he has caused.Desired Settlement: Proper written agreement of never deducting from my account. Cash refund with a date of when im going to receive it. Paperwork for cancellation.
