***, Simply put, you wanted more work done for the money that was spent, after work was completedThat’s all I said in the previous response We are not lying or trying to be condescending We agreed what the scope of the project would be That is what Eckles Paving completed Our sales rep was given quantities by your property manager to get an “apples to apples” comparison If competing bid quantities are the same, the focus is on the price per square foot This takes away any chance of “low-balling” the bid This same process is used with UDOT and every public entity in the state They give out quantities to all prospective bidders to get an “apples to apples” comparison Bidders give a unit price multiplied by the quantity to get a total price for the project Lowest price gets the job There is nothing dishonest or unethical about it While Eckles Paving does its best to interpret the intent of the customer on the project, we are not mind readers Our interpretation of what you wanted was detailed in the contract If you wanted something different, you should have conveyed that to the sales rep and had the contract changed You should not have signed the contract Again to summarize, this situation boils down to a few key points Eckles Paving provided and you signed a contract to perform work on your property This contract was our best interpretation of what you wanted Eckles Paving completed work per the contract You wanted more square feet done that what was contracted to do In the contract it says that you agree to pay the unit price for additional square footage If the job grows, you pay more money If the job shrinks, you pay less money Seems only fair

Eckles Paving was contracted by Mr*** to repair a specified quantity of asphalt at a contracted price per square foot. That is what Eckles Paving did. To minimize confusion, Eckles Paving;1-Provided a clearly worded contract that was signed and agreed to by customer2-Provided a map
detailing where, on the site, the work would be completed3-Walked the site with the customer to make sure we were on the same pageAfter work was completed, Mr*** expressed frustration that “the money didn’t go further” even though the contracted scope and quantity had been completed. Eckles Paving was ready and willing to complete more work at the contracted price per square foot. Mr*** wanted this extra work done for freeCustomer service is very important to Eckles Paving. We are one of the largest asphalt paving and maintenance contractors in the state of Utah who specializes in smaller private projects like this one. We would appreciate the opportunity to reasonably work though this situation with Mr*** and regain his confidence. The contract is what Eckles Paving and Mr*** agreed to. If Mr*** would like more asphalt repaired, we would be more than happy to repair it at the contracted price per square foot

I am rejecting this response because:Eckles response is specious ludicrousTheir sales rep was never given quantities of any kind by our property manager In essence, Eckles is saying, “We didn’t realize that they wanted us to repair their asphalt; we thought they just wanted a certain quantity.” We are not UDOT or a public utility, and we’re not in the paving business. We agreed to the scope that Eckles recommended for our project because they are the paving company. But their recommendation was so inadequate that, by their own admission, it failed to meet their own warranty standards. They knew it beforehand, but did not tell us until after the cut/patch and before the seal coat, then wanted 40% more money to finish the job properly. If this was a misunderstanding, then Eckles would do well for their reputation to work out a reasonable compromise. If, on the other hand, it was intentional, then people should know that Eckles Paving is a business not to be trusted. Sincerely,
