Review: I had taken some clothes to eclectic consignment about six wks ago to be sold and went there today to pick up my money and they had closed the store with no signs of moving to another location, nothing received by mail of closing, etc. they have money that is due me with sale of the clothes I took there. Have tried to call store but phone has been disconnected.Desired Settlement: Would like money due me paid and a return of unsold clothes.

Review: Consigned 22 articles of womens clothing & 1 pr shoes on 3/27/13. The shop had signs about prosecution of shoplifters & video surveillance throughout store. While signing contract I asked about the clause for no responsibilty, Ms. [redacted] explained that it is in there in event store damage or robbery, she NEVER mentioned theft being a problem added that shop had cameras so consigners would feel safe leaving their items. @ this time I told her I would pick up my items that did not sale prior to the 59th day that I did not want them donated, she said fine, I also had 2 family members with me. On 5/23/13 I went in & was informed that I had made $21.00 & the remaining items would be donated to Goodwill & that she gives all of her customers blank goodwill donation slips and they can put whatever & how much on it even pointing to the stack. I told her to have ready my remaining items that didn't sell & I would pick up 5/24 & my check. NEVER did she mention missing or stolen items. I called her 5/24 to ask if my items were ready for pickup again she said goodwill & the blank donation form, that I could write whatever on. Again I told her my wish to pickup my unsold items @ this point she said I would need to look for my items that she couldn't find them, never mentioning theft. Later my husband & I arrived, I found 4 items of mine, when shown to her, the reply was that 2 items was missing off my sheet & she couldn't tell what happened. I took my 4 items & check for 21.20. Shortly after, in the truck, I compared the list of things I brought to her on 3/27/13 with her list of what she sold of mine 5 items, so 14 items of mine were missing. When we went back her reply was that theft occurs daily in the shop & there was no cameras at all, because of the contract I signed thats all I got.Desired Settlement: 1.Money to replace the 14 stolen items @ the rate of what she would have sold them for. 2.Investigation in the false advertisements of surveillance there & failure to disclose all of the theft that occurs there as they say it does to potential consigners; possible fraudulent use of goodwill blank donation forms; & false statements about faux/knock off handbags & accessories that she sells as authentic/genuine designer items.

Eclectic, LLC is in receipt of a complaint initiated by Ms. [redacted]. Per your request, the response to Ms. [redacted]’s complaint is below. Ms. [redacted] did in fact bring items to consign at Eclectic. She reviewed & signed the consigner agreement & a blank copy of the agreement along with contact information was provided for her records. Our records indicate 17 items were left for consignment; 6 items sold and Ms. [redacted] was paid $21.20, 4 items were picked up by Ms. [redacted] on 5/24/2013, and 1 Loft Dress was donated to Goodwill on 4/16/2013 due to picks. Sometime after 5/24/2013 the Willie Smith top was located on the sales floor & removed due to a hole. The top has been retained should Ms. [redacted] choose to pick it up. Eclectic has no record of the other 5 items that Ms. [redacted] states that she left for consignment. As for the 5 items that were consigned but did not sell or were not picked up, it is possible that like the Willie Smith shirt the items remained on the sales floor after Ms. [redacted] picked up her check and the items that she was readily able to locate. However, as stated in the consigner agreement, after 60 days items that do not sell are donated. Theft occurs at most retail/resale shops. Eclectic is no different and it is clearly stated in the consigner agreement and throughout the store that Eclectic cannot be responsible for such actions as they are beyond our control. It is not unlawful to post signs stating surveillance cameras are in use with or without the presence of such equipment; in fact it is advised to deter theft. Eclectic does not sell knockoff handbags and market them as authentic. In fact, most designer handbags that are sold at Eclectic still have the original tags attached. Eclectic is very blessed to have a loyal consigner and customer base. Our consigners understand and have agreed to the terms of the consigner agreement. We receive thousands of items and take care to ensure that all sellable items are placed on the sales floor for 60 days. All items that are not in sellable condition or do not sell are donated and a tax receipt is retained for the consigners donated items. Sincerely, Eclectic, LLC Deana Collier
