Eclipse Process Service prepared and filed documents based upon best available information provided by plaintiff. Plaintiff did not have a location for defendant or the defendants girlfriend in which she felt he may be currently living. Eclipse ran skip trace reports for not only the plaintiff but...
plaintiffs girlfriend as well. The last known address of the girlfriend was in a secured apartment building with exterior call box. Neither her name or the plaintiffs name shown as residences. During a follow up attempt, management was unable to confirm or deny their whether or not they resided there. Another residential address that came up in search yielded the same result. We then went to the defendant last know address in attempt to acquire a forwarding address of the individual. The existing residents in the four-plex unit had not heard of the defendant and did not know of his whereabouts. We continued to run reports in the process to see in new information was provided and contacted the client to inform her that we would need to get an extension to make further attempts. She them provide information that he was a cook at a restaurant that she named. Spoke with two individuals that worked at the restaurant neither heard of the individual and it was confirmed that he was not currently an employee. Eclipse Process Service agreed to pay the filing fee for new hearing date which we did and provided plaintiff with now notice.
Complaint: [redacted]I am rejecting this response because:Eclispse was paid an additional fee to locate individual at the beginning of our agreement. Addional information provided to Eclipse was to ensure every measure was taken to locate and serve. Client was given an initial court date from Eclipse Services for April 30th 2015. This was sent in the form of court papers via mail. Client's signature was required before serving Defendant. This was completed in early February. Upon receiving information from Eclipse that the defendant's address and location were submitted on the court documents, that information was inaccurate according to the response below. I am rejecting this response as an extension with the company was not made. Eclipse paid $25 for an extended court date but refused to move forward in attempting to serve Def. without additional payment by Client. The only portion of the service fee of $240 that was paid to Eclipse that has been fulfilled is their filing with the court. They did not serve Def, they did not find the Def. It is not appropriate business practice to charge a client and not fulfill or communicate challenges to fulfill a contract in an appropriate amount of time. Eclipse was given 4 months to fulfill their contract and did not communicate challenges until 10dats before the scheduled court date. [redacted]
