Review: 1) A hemlock was planted which has since died. As per contract, item is to be replaced.

2) The patio concrete has cracked and needs to be repaired.

3) All phone calls and emails have been left unanswered.

4) All items were installed in April 2014. The landscaper was told of problems within the year but has failed to fix the problems.Desired Settlement: Repair the concrete and replace the hemlock. In lieu of repair and replacement, a check for $1,000 can be issued so that I may effect the repairs through another party.

Hi [redacted]Here are my responses to [redacted]'s comments:1. Eco-Land did indeed offer a replacement Hemlock. Christine met with [redacted] in April to look at the tree and the client expressed interested in other types of trees instead of a hemlock. Christine emailed [redacted] images and pricing of other trees to substitute the hemlock within a week of meeting with client. The client informed us in mid May that she just wanted another hemlock. We told the client we would replace the tree ASAP. Because of the nature of our business and existing installations and clients that we are completing jobs for, we could not provide an exact date for this replacement.2. Eco-Land went out to the job site and informed [redacted] that we would address the crack on the concrete with a sealer to prevent further damage from freezing rain in winter 2015.3. Eco-Land has emailed and texted with the client regarding these subjects. Eco-Land was also hired by the client to rebuild a retaining wall in her front yard during the spring of 2015. The client was very happy with the work completed.4. The concrete crack and dead tree were brought to Eco-Land's attention spring of 2015 and we responded to address these concerns with the client in a timely manner.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

1. I did not express an interest in othertrees. Ms. [redacted] did not want to replace the hemlock for fear that it toowould not survive. She is the one who wanted me to look at other trees. When itbecame clear that she would not replace the tree as guaranteed and that I wouldhave to pay for a replacement. She would only replace the tree with anotherhemlock. I opted for replacing thehemlock and take the chance that it would not survive.2. Ms. [redacted] came to my house to collect her check. Eventhoughshe was made aware of the problems well in advance, this is the first time shetook a look at the concerns.3. I signed the contract for the retaining wall inOctober. The tree started dying in January. The cracks and mortar deteriorationwere found once the snow melted. I tried to get out of the contract for the wall but she wouldnot let me.4. As indicated before, the problems were broughtto Eco-Land’s attention in January and very early spring. As of June 1st,none of the issues were fixed. This I do not consider “timely”.At this time I have no desire to continue working with Eco-Land. After receiving two disparaging voice mails and getting intoan argument, I have decided to seek a solution elsewhere.
