Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this resolution would be satisfactory to me I will wait for the business to perform this action and, if it does, will consider this complaint resolvedPlease remove the complaint due to [redacted] stating that he would make installation of the solar panels a priority Regards, [redacted]

Dear DrGreene, I hope this finds you well.I would like to express my sincerest apologies for any grief we may have caused you; and extreme gratitude for your patience, as there are several reasons why it took quite some time to try and hone in on the reason(s) for the apparent shortfall in your system. We are here to serve you and will not compromise on any of our obligations as your solar provider.I am quite certain we shared this with you, but to recap: we were severely hindered and delayed (to put it lightly) in operations because of some very nefarious activity from several thieving employees and competitors, whom I have been forced to seek legal action againstFor example, in an attempt to get me out of business, one of my former RMO’s forged my name(!) ina LEGAL state document that stated I wished to remove myself from my OWN license (seriously!) which immediately rendered my license suspended, therefore keeping me from operating this past Fall (just in time for yours and a few other customers of ours to have apparent production challenges)I informed the CSLB right away, confused and upset as to how they could possibly accept a forged document like thatTheir response: “Hey, we just log in the info as it comes in – why would we question anyone’s official form if it is signed’There was nothing I could do but sit with my hands tied for a few months while I got my license reinstatedAs I have learned first-hand, there is a reason why the public lacks confidence in contractors: it is a disgusting world we live in - especially in the competitive solar market – when all ethics and morals are thrown out the window, as my competitors and employees tried in vain to ruin me and othersWell it didn’t work, and justice will be servedThe court date is set for this JunePlease recall in several conversations in the past, we stated with confidence that production for our customers has been consistent with projections year after yearThis has been the realityThus it was truly mind-boggling when over the last few months, as several new(er) customers such as yourself came back to us with their Envoy data reports showing “misses” on production and, in some instances people receiving a larger than expected SDG&E bill (also recall we informed you that there would be an apprx $15-$/ month service fee that would result in an end of the year trof aprx $180-$240)We have analyzed your data thoroughly; went to your house for multiple site visits – even getting third party opinions(s) – which helped lead us to figuring out a major factor that was there all along: we had the WORST weather in years thanks to El Nino and now La NinaThis is why, if you will recall from your original proposal, the projections are based upon a year average of your system (please see relevant pages attached). In addition to this major [weather] factor, your Envoy was not on the entire time; there was also some unforeseen challenge with shading from your neighbor’s home on the lower array; and we aren’t totally certain if you actually went over on your own personal usage (vis-à-vis what your prior usage was when we prepared your original proposal)All of these contributing factors help explain why there may be some shortfall this past year or so.However, we do have a production guarantee that clearly needs to be addressed in this emailWe originally sthe production guarantee as a result of a high profile customer of ours back in 2014, that politely “challenged” us when we stated with confidence, that the huge solar system we were providing for him would achieve his goalsHe asked if we would put in a production guarantee, to which we agreed to do, letting him write up the legal verbiage since he was an attorneySince we had never “missed” on production, I had no problem with thisI read over the guarantee and agreed to it; and also thought it was a great item to include in all future contracts, since it would be a great boost of confidence for our company and any other future prospective clientsAgain, to my knowledge, we had never missedIn hindsight, I should have read it over a bit better, even though it is inferred and also clearly written, that it is in direct accordance to the proposal we give and with the manufacturers’ warranties - which all state very clearly that production is based on averages – these production expectations are susceptible to varying weather patterns; etc etcIn other words: no one is God; no one can control the weatherAgain, El Nino & La Nina.I have spoken to several solar company peers in the area, and everyone is going through the same [relatively] bad year of productionThe production guarantee states .- that we will do whatever it takes within a Day timeframe to rectify the situation - what was meant by this, was to ensure that we wouldn’t waste time on analyzing the data and taking the steps to fix any problems if there were - this is something we did go over in your home, prior to contract signing - however, recall from this email, I was unable to operate my business for several months due to the circumstances of my hands being tied. The production guarantee does not state .- that we will pay for any of your bills.- Yet, in good faith, I went above and beyond and authorized the payment of $to cover your last bill of $2700, which included your obligation of $180-$240.As you have acknowledged in the past, please recall that we gave you an absolutely amazing deal, several thousands less than what you were going to pay elsewhereIt was therefore very hurtful to me that you went out of the contractual commitments we both signed - which stated among other things that we would go to arbitration; that you have filed a lawsuit against me; that you have publicly shamed me by going on TV with the respected [redacted] and giving him a very biased, one-sided interpretation, which included several incorrect and misleading statements by youIt has already affected my business and I am very hurt by your actions – both mentally and financiallyI did not deserve this We have concluded that the following measure(s) might help in rectifying the apparent / potential challenge in your production:- moving the lower South facing array to higher areas - moving some of the East facing panels at a potential reverse pitchPlease confirm if you would like us to explore doing this work for youIt would be free of charge, again, in good faith.Warmest, [redacted]

***, I have copied the version of this letter I receivedPlease note at the bottom where he states the only way he is willing to correct my system is if I remove my complaints prior to correctingI am willing to remove complaints only after he corrects systemContractor refers to El Nino and La Nina as being reason for shortfalls in Guarenteed production but El Nino fizzled out last year during time when shortfall was notedContractor also states 9734kwh production is a goal and in a low year due to weather I should expect much less which he calls proposed production (low year)however it states clearly in the contract “minimum production” of kwh and that in the event of a short fall he will correct by adding additional panels as neededMy production was off by around % of promised productionI added additional panels to increase production to be able to use A/C in summer which I have not been able to I will withdraw complaint once corrections are made See my version of letter you provided below and note additional line at bottom. ***I will ask you, however, this offerof good faith by me outside of my contractual obligations, will only be considered if you first remove your complaints in the Revdex.com and the CSLB right away, as I have done nothing wrong, and you have not incurred any great expense. El Nino and La Nina have now passed and we should have a long run of good sunshine in the coming years.***

For example, in an attempt to get me out of business, one of my former RMO’s forged my name(!) ina LEGAL state document that stated I wished to remove myself from my OWN license (seriously!) which immediately rendered my license suspended, therefore keeping me from operating this past Fall (just in time for yours and a few other customers of ours to have apparent production challenges). I informed the CSLB right away, confused and upset as to how they could possibly accept a forged document like that. Their response: “Hey, we just log in the info as it comes in – why would we question anyone’s official form if it is signed’. There was nothing I could do but sit with my hands tied for a few months while I got my license reinstated. As I have learned first-hand, there is a reason why the public lacks confidence in contractors: it is a disgusting world we live in  - especially in the competitive solar market – when all ethics and morals are thrown out the window, as my competitors and employees tried in vain to ruin me and others. Well it didn’t work, and justice will be served. The court date is set for this June. Please recall in several conversations in the past, we stated with confidence that production for our customers has been consistent with projections year after year. This is why, if you will recall from your original proposal, the projections are based upon a 25 year average of your system (please see relevant pages attached). In addition to this major [weather] factor, your Envoy was not on the entire time; there was also some unforeseen challenge with shading from your neighbor’s home on the lower array; and we aren’t totally certain if you actually went over on your own personal usage (vis-à-vis what your prior usage was when we prepared your original proposal). on December 12 2014 I signed a contract for them to install solar panels on my home. It took 7 months for them to finally do it. Two months ago I realized it hadnt been working for 8 months. it took them 2 months to get around to finding the problem which was that they installed the electrical work poorly and it was lucky that my house didnt burn down, their new electrician said. For 2 weeks they kept saying that it now work, which was not true. Finally they fixed it. They never paid me for the time it wasnt working ($5900). They did not respond very often to my phone calls or emails, were rude and did not apologize in any way. I would not recommend them

Dear Revdex.com,
We at Ecocentric, have built a business on strong ethics, values, and integrity. We were therefore completely shocked by the following complaint from one of our clients, [redacted],
and his false claims against us. Our goal is to...

resolve this "non-issue" ASAP, yet, at the same time, [redacted] will need to act in a respectful manner towards us AND retract his
false accusations and statements.
Yesterday (11/03/2014) [redacted] sent the following baseless threats to our rep, Paul:

Please see an abridged version of an email sent from [redacted] of Ecocentric to [redacted], yesterday, in response to his threats.

"Dear [redacted],
I don’t even know where to begin. I am shocked. Truly shocked. Especially after the deal we gave you, and ESPECIALLY after waiting patiently for you to even honor your side of the contract.
You were well OVER A MONTH late on getting us payment on your scheduled date. Did we threaten you? Did we complain? Nope...
...We have been doing everything we can to expedite your installation.Let’s look at a few facts, shall we?:
1.       The contract states, “estimated 4-6 pending permits”
- we are still getting / waiting for permits
2.       The contract states, “Work to be performed will begin on approximately 4-6 weeks from contract signing.
Failure of contractor, without lawful excuse, to substantially commence work within 120 days from the
approximate date specified above is a violation of the Contractors' State License Law”
- perhaps you would like to check the dates of the contract
- perhaps I need to remind you who – IF ANYONE – actually held up the work? Yes, that would be you [redacted].
3.       Most importantly, the contract states, “30% Upon Site Walk”
- where was your payment [redacted]? Where? You remained elusive, without stating anything. We had
   to find YOU.
Shall I go on?
Yet, through it all, in good faith, we worked on your project EVEN WITHOUT YOU HONORING YOUR END OF THE CONTRACT.
I will NOT be threatened like this. I refuse.
So here’s the deal:
you will call the Revdex.com and remove YOUR COMPLAINT by 4:00pm TOMORROW (11/04/2014) and provide proof of this to me
or I will seek legal action AGAINST YOU for violation of contract, attempted fraud, attempting to unjustifiably cause damage
to Ecocentric through false complaints, and threat (or actual action) of character assassination / defamation of character.
I HAVE EVERY PIECE OF DOCUMENTATION I NEED TO WIN A JUDGMENT AGAINST YOU.
I have built my business on honesty, integrity, and delivering what we say. EVERY SINGLE ONE OF OUR CUSTOMERS is HAPPY
with us and what we gave them.
[redacted], if you do go online and cause more damage, I will take you to court and seek damages FAR MORE THAN the cost
of your SOLAR SYSTEM.
We would love nothing more than to install your system and see you happy, but the ball is in your court, [redacted].

COMPLAINT INFORMATIONCustomer’s Statement of the Problem:
I've been working with a solar company, EcoCentric Solar, since 2 September 2014 where I met [redacted] (salesman) and signed a contract on 2 September 2014 to have fifteen 300kw. LG solar panels installed on the South facing side of my roof. RESPONSE / CLARIFICATION to the ABOVE by ECOCENTRIC:  - Please provide explanation, [redacted], as to why you put a date of 02/01/2014, when the date was really 09/02/2014?_____________________________________________________________________... Statement of the Problem:
In the contract there were four payments that were required at different milestones based on events. They were broken up into four events based on milestones. RESPONSE / CLARIFICATION to the ABOVE by ECOCENTRIC:
  - Please provide explanation, [redacted], as to why you withheld & delayed payment to ECOCENTRIC FOR OVER A MONTH on the milestone of "30% upon site walk".__________________________________________________________________________... /> Customer’s Statement of the Problem:
Also, there was an agreed install date that was included that was 4-6 weeks from the date of the contract. RESRESPONSE / CLARIFICATION to the ABOVE by ECOCENTRIC: - As per pure the exact contract verbiage, "Est. 4-6 weeks pending permits". To clarify, this means, "Estimated 4 to 6 weeks pending permits".
- Definitions:
   1. "Estimated" means "Estimated"
   2. "Pending permits" means "Pending Permits":
       - Why, [redacted], would you try to delay us the opportunity to install your system by our goal date?
       - We now question your perceived ulterior motives to put Ecocentric in a "no-win" situation by not allowing us to do our job, in accordance to the contract you signed. _______________________________________________________________________... Statement of the Problem:
This is the problem - failure to deliver an agree product and service. RESPONSE / CLARIFICATION to the ABOVE by ECOCENTRIC: - Please provide explanation, [redacted], based upon the facts, as to how we have failed to "deliver an agree product and service"
________________________________________________________________________________... Statement of the Problem:
The initial $1,000.00 check was provided to [redacted] on 2 September 2014. A month after signing the initial contract, 1 October 2014, a check for $6,000.00 was provided.
The next day, 2 October 2014, the owner [redacted] called me and stated he wanted to expedite my installation, but would need me to make out another check to [redacted].
That was my first warning that something wasn't right. Therefore, [redacted] stopped by my residence and returned the check written the previous day (which was destroyed) and I made out another $6,000.00 check to [redacted].
He was very cordial and seemed sincerely interested in meeting the terms of the contract. RESPONSE / CLARIFICATION to the ABOVE by ECOCENTRIC: - [redacted] called our rep [redacted] to ask if there was any way we could try to expedite the installation. [redacted] is the RMO of ECOCENTRIC and does ALL of the installation for ECOCENTRIC. This is something that EVERY
customer of ECOCENTRIC knows and is even STATED in contract. [redacted] realized it may be FASTER if he writes a check DIRECTLY to [redacted] in order to help expedite the process, since ECOCENTRIC must first
deposit a check from the customer, make sure it clears, then gives a check to [redacted]. ________________________________________________________________________________... Statement of the Problem:
To clarify, my total payments made at this time were $7,000.00. Since 2 October to current, I've received only one set of plans via email from [redacted] that was inconsistent with our previous agreed plans. I received them about seven weeks after signing the contract, the plans called for installing nine panels on the South facing and six panels on the North facing side of my roof. The North side rarely receives sunlight, so that was my second warning that a stall tactic was being utilized. He stated this was common and that he would speak with the engineers to have the plans corrected. Since then, I've expressed to [redacted] and [redacted] my concerns via email to provide accurate plans and install the solar panels - as agreed.

RESPONSE / CLARIFICATION to the ABOVE by ECOCENTRIC: - Our engineer reviewed the plans and noticed MAJOR shading on the south facing roof. However, he did not realize that [redacted] was adamant about having the system on the South facing roof no matter what.
- This is why we AND every general contractor AND every solar contractor provides the customer a set of plans for their approval.
  - Please provide explanation, [redacted], how is this a negative thing and a "stall tactic"?- Since then, the plans have been made to [redacted]'s liking.
________________________________________________________________________________... Background:Product/Service: Solar Panel InstallationPurchase Date: 2/1/2014- why, [redacted], have you put a date of 02/01/2014, when the date was really 09/01/2014?

Paul Yates Purchase Price: $20000.00Disputed Amount: $20000.00 Desired Settlement:
I'm asking for one of two outcomes. Either to be immediately reimbursed $7,000.00 or the agreed solar panels installed by 7 November 2014. Final comments: There are always two side of the story when reading a complaint regarding a business. Therefore, I'm including a little information to support my credibility. I'm 51 year old man that served as an officer in the U.S. Marine Corps for 24 years and another 6 years in the Federal Civil Service. During my military career, I've held a top secret clearance and been entrusted with leading service members in [redacted] and in combat. My word, my integrity means everything to me. RESPONSE / CLARIFICATION to the ABOVE by ECOCENTRIC:- As per our contract, “Work to be performed will begin on approximately 4-6 weeks from contract signing. Failure of contractor, without lawful excuse, to substantially commence work within 120 days from the approximate date specified above is a    violation of the Contractors' State License Law”
  - Please provide explanation, [redacted], based upon the facts, as to how we are in violation of ANYTHING according to the laws of this state, and according to our contract. The ONLY delays that have been made
are from [redacted] FAILURE TO PERFORM HIS DUTIES OF THE CONTRACT. Yet again, in good faith, even without [redacted]'s payments, ECOCENTRIC still went ahead with the project and would like to finish it
as soon as possible. IN CONCLUSION:
ECOCENTRIC agrees to have project installed ASAP, as long as permits are in place AND [redacted] agrees to withdraw his complaint AND restrains from ANY further damage he may wish to cause ECOCENTRIC online, to the Revdex.com, etc. The goal will be to have the installation done by no later than the end of November 2014.
