The situation actually goes back further than this project.  We were hired to wire his hot tub back in May of 2015 and we did not receive payment for this work until Dec 21 2015 which came only after we said we would not come back to complete the second project(the project in the complaint)...

unless he paid us in full for the initial project.  Once we received payment for the initial invoice we did schedule to complete his second project which he had requested to be completed by Christmas.  Our schedule was already full but we worked him into our schedule to accommodate this request.  We did this work on Dec 21st and Dec 23rd.  I have attached a scan of the quote and an email we received after we mentioned we needed payment or we would be filing for payment with the court.  This shows that we had provided a rough in budget amount only along with an email showing that he could not afford to pay.  The finish work was completed as requested by [redacted] and he was only billed for the actual time reported by our employee for that time, therefore him installing his own light fixtures only saved him money since we didn’t have to bill him for that.  According to our employee, he had started cleaning up but was told by [redacted] to not worry about it, that he([redacted]) would take care of it.  It is our policy to clean up after ourselves on all jobsites unless requested otherwise by the owner or representative.  We do not get them to sign anything saying that they don’t want us to clean, it is just a verbal exchange between the customer and our employee so we have no evidence one way or another it is just our policy to do so.  We have been doing business in this area for over 12 years and have an outstanding reputation with our customers for reliability, honesty and quality workmanship.  Of course we never want to have an unsatisfied customer and we make every effort to work with our customers both on scheduling and on billing.  Often times we set up payment schedules when they cannot afford to pay all at one time.  We have encouraged [redacted] to come in and try to set up a payment schedule however he has chosen not to do that.  He has made a few payments toward the invoice, however since they have not been regular payments and there has not been a plan setup, we will continue to add finance charges to the invoice.  We feel we are entitled to these finance charges since this invoice is now over 12 months old, we clearly state on our invoices that finance charges will be assessed if not paid by the due date.  The issue with his circuit tripping is not related to the work we performed.  We clearly state in our estimate that we are utilizing the existing kitchen circuits for the new receptacles in his kitchen.  We did not install new circuits and the fact that he has multiple appliances plugged into the same circuit is what is causing the issue.  We have attempted to explain this and we have also tried to set up a time to have an Electrician come by and verify that there isn’t something else going on.  Up until today [redacted] had been unable to make a time work.  We were able to get our electrician onsite this afternoon and he did verify that they have two appliances connected to the same circuit that consume 2900Watts.  A typical kitchen circuit is designed to accommodate approximately 2000Watts.  Our employee explained this to [redacted]’s wife this afternoon and she acknowledged recalling that this was discussed when our estimator met with them initially.
