I'm responding to complaint # [redacted] from [redacted] ***Last fall we removed a tree from Mrs [redacted] front yard and replaced it with a 12' Colorado Blue SpruceAs is our policy, we installed the tree with soil amendments and also staked the tree to prevent shifting due to wind damageMrs [redacted] wanted the tree to be installed in the exact same location as the tree we removed and there was a slight slope, with a retaining wall below the tree to prevent erosion, so we grinded out all the roots from the stump and added new topsoilAt the time of the installation Mrs [redacted] wanted us to prune up the bottom branches to give it a more uniform look due to the slopeI advised Mrs [redacted] that pruning the tree was not a good idea because it could increase the risk of transplant shock, but she insisted and as a result we went ahead with the pruningOnce this was complete she called me to let me know she was pleased and that I should charge her credit card, which she provided over the phone.Earlier this year Mrs [redacted] contacted me to say that the tree wasn't doing well and that she wanted a replacementWhen I went out to look at the tree I told her that the tree was in good shape and did not need to be replaced but that it did need to be fertilized and she needed to make sure it wasn't getting to much waterI also told her that there was no warranty on the tree but that I would be happy to fertilize the tree instead in an attempt to jump start its growthShe said that would be fine so I came back out a second time to fertilize the treeI drove out a 3rd time several weeks later to check on the tree and once again, the tree was in good shape but it was being over wateredI advised Mrs [redacted] that she needed to keep an eye on the tree due to the excessive rain we were getting and then went on about my business.Mrs [redacted] then filed a complaint with her credit card company (***) against us for the entire amount we charged (this is now months after the installation) and asked for a full refund [redacted] then began a chargeback request with our merchant service providerI responded with the following e-mail:To whom it may concern, This is the second time I've been notified about this chargebackPlease confirm receipt of all attachments and my replyIn reference to case # [redacted] The customer authorized payment via a phone call to her [redacted] card (last four digits ***) on 10/8/for full payment of services rendered (Transaction ID: [redacted] ) for estimate #***There was no warranty provided on the work done at her home ( [redacted] ***)In spite of not having a warranty I personally (the business owner) provided a free consultation, a free fertilization, and visited the property an additional time to check on the tree while the customer ( [redacted] ***) was on vacationThis is all far beyond what we would normally do since there is no warrantyThe tree was obviously not taken care of by [redacted] and this is why we don't provide warranties.Attached is a transaction report, the payment journal entry, phone records showing the date she called with payment, a recent e-mail explaining that we never provided a warranty, a copy of the original estimate, and a copy of the "paid" invoicePlease let me know if you need anything elseAs an FYI, this payment transaction took place in October of This was months ago and the customer expressed, in person, her happiness with the workWe do not leave a customers property until they are 100% satisfied with our workI'm very surprised to find out that [redacted] would go back so far and this makes me question whether or not we should be doing business with themWe may have to change our merchant service account/provider to no longer accept *** [redacted] Eddington Landscaping [redacted] The charge back was denied to Mrs [redacted] as I was able to provide documentation that supported my claims for her authorizing payment, that there was no warranty, and also that I had gone above and beyond to ensure her happinessI have attached these documents to this e-mail for you to verify.In regards to her claims that I offered a replacementWe do not warranty our plant installations in any way, shape, or formThis is because the vast majority of the time a plant dies due to neglect on the part of the homeownerThe last two times I looked at the tree I advised Mrs [redacted] that she needed to keep an eye on how much water the tree was gettingWe were getting excessive rainfall at that time and I told her that she shouldn't be watering the tree unless we stopped getting rainI can provide additional contracts we have with customers, in addition to the estimate attached to this e-mail, that clearly show that we do not offer a warranty to any of our clients.Please let me know if you need any additional documentationIf you could, please confirm that you received this e-mail as well.Thank you!

Our company was hired last spring to perform lawn mowing and lawn fertilization services at Ms***'s property in MilfordWe canceled service due to non-payment of work performed on June 15th after trying numerous times between May 15th and June 14th via e-mail and phone call to recover payment
The last time we were at her home was on June 14th which is a when one of our managers went to her home in an attempt to contact Ms*** for paymentThere was no one homeThere were no problems with her lawn when we were there on the 14th. When Ms*** contacted us, over a month after we were last out, the same manager that went out on June 14th to try to collect payment went out to meet with herAfter inspecting the damage we explained that there is no way we could have damaged her lawn since we simply hadn't been there in over a month and that there was no obvious cause of the damageWe also told her that the lawn did not look that way when we were out on June 14thWe then offered to repair the damage if she would simply pay the overdue invoices in spite of the fact that we didn't damage the lawnWe have contacted her several times since meeting with her to try and collect payment with no answer. At this point in time we feel that we have done everything we can do

Business sent a check to customer in December for the deposit only as that is all the customer paid the businessThere is no balance to refund as customer never paid any more than the 25% or $Business is aware customer has filed chargebacks against the business three times

I cannot say for certain what went wrong with this tree replacement What I can emphatically say is that we did everything we were told to do with regards to watering or not watering the tree We did have a tough winter and a very wet spring We did not overwater the tree in the spring, because we were getting ample water from rainfall Yes, I obviously authorized the full charge to my credit card, even though I was disappointed in how the tree was installed and how it looked initially I was a told that even though it had damage when it was installed from broken branches, that it would fill in and it would grow without any issues I did also authorize, after the owner offered, that they trim the tree because they installed the tree with the lower branches facing the highest point in our front bedThey should have seen that and made the correction before the tree was in place As soon as the tree began to show damage, I alerted Eddington Landscaping to the situation and asked that the owner come and check out the tree He is correct that he told me it would be fertilized, trimmed (to remove the damage) and that the rope would be removed My issue is also that I have no proof that any of that happened When we returned from vacation in March, the tree had not been trimmed, the rope was and is still on the tree So, my inclination is to believe that none of it happened And, I was told on March 23rd when the owner came to my house that if the tree did not improve, he would replace the tree From the get go, I did put full trust in Eddington and their experience I trusted their opinion to go ahead with the replacement in the fall instead of waiting until the spring I believed that the tree would fill in and begin to look better Unfortunately, the tree did not root over the winter, whether it was because of the soil preparation, root excavation or it's initial health The tree began showing signs of distress in February, and that was before all our excessive rainfall, so I tend to think the spring rain had nothing to do with the deterioration of the tree's health.I filed a complaint with *** because the owner went against his initial word when he told me that he would no longer do anything about the dying tree in our yard I was backed into a corner, and had to do something about the almost $*** we spent on the tree replacement I am grateful that companies like *** *** exist to protect consumers and their purchases I have communicated that I am open to a compromise to settle this dispute I am not at fault for the tree being damaged when it was placed in the ground, for any mistakes made in the root removal and soil preparation, or for it being installed with the lower branches towards the highest elevation of the bed We followed watering instructions in the fall and held back on watering in the spring due to our excessive rainfall The only facts in this case that I agree with are that we paid in full for the tree replacement ($***) and that I authorized the payment via a phone conversation I am not satisfied with this situation, and would like to be sure that others are aware of this problem, so they will make a better choice with landscaping needs

[redacted] claims that that could not have damaged my yard because they had not been to my house since June 14th.  When in fact my lawn continued to be mowed up until last week even though I told them not to touch my yard again on August 14th.  I was told by the manager that the crew was fired because of issues like this and that they would repair it.  The following day the manager told me he spoke to the owner and he was told to tell me another landscape company was randomly mowing the lawn and spread the lawn killer around my house. I have 2 records that [redacted] left on my door dated July 7th and Sept 13.  I also email them several time to tell them that I was changing banks with no response at all on their end.  I have never received a phone call, email, text, US mail from [redacted] concerning then stopping mowing do to non payment.

To whom it may concern,On 6/3/17 we received a signed estimate and deposit. Mr. [redacted] was informed that, weather depending, the work specified on the estimate would be completed in 5-6 weeks from the date we accept his signed estimate and deposit. Our schedule is done on a first come, first serve...

basis and no one is placed on our schedule until we have both the signed estimate and deposit. This would put our original start date at sometime during the middle of July. During the months of June and July we received multiple large storms over several weeks that pushed our schedule back.Both Mr. and Mrs. [redacted] called near the end of June to clarify the actual start date. They were both informed on separate occasions that we couldn't give them an actual start date due to our schedule being backed up due to the rain and that we were still completing other jobs that were currently in production but that we were hoping to begin work as soon as possible. We were again contacted in the beginning of July to ask for a date which we were not able to give them for the same reasons as before, the weather had backed up our schedule and we were still wrapping up jobs that were in production. On July 21 a voicemail was left at 5:03 pm, after our business hours, canceling the contract. We were unable to reach them when we tried to call back to confirm the cancellation.Not one person from our office, other than myself, is authorized to give a start date. This is due to multiple reasons but primarily because we don't know when every job will end, we don't start new work until our current work is complete, or if the weather will back us up. Our estimate is very clear that the deposit is non-refundable.
