I am in receipt of your letter, dated December 28, 2017, referencing a complaint filed with the Revdex.com regarding EdgeBrook Estates apartments in Cheektowaga NYThis complaint has been assigned a number of #within your organization. I have reviewed the complaint with
the property manager, Allison F* and stand by our responses to Ms*** complaints and issues when they were originally brought to our attention. Some information for you to consider follows below: Sewage backup- Ms*** had episodes of sewage backing up into her bathroom one in July of and one in November Ms*** lives in a lower unit, what we refer to as a "garden level"Garden level units are half above, and half below the grade of the ground outside of the buildingMs*** building is at the lowest elevation of the entire siteOccasionally in periods of high water run-off, grey water that has collected in waste water lines in this area of lower elevation has been known to back up into the bathtubs of these "garden level" apartmentsTo prevent this type of back up, Edgebrook Estates entered a preventative maintenance program several years ago to minimize the chance of these occurrencesCurrently, an outside contractor comes in quarterly (every months) and "jets" out these lines to be proactive in minimizing back up occurrencesUnfortunately, even with the quarterly jetting of these sewer lines, with the large amount of rains we received last year, we had those sewer backupsAt the time of the second back up, Ms*** was offered the opportunity to move to a different area of the apartment communityShe indicated to the property manager that she would need to speak with her boyfriend regarding a moveWe have no record that she ever came back to the office with a decision regarding a transfer on site to a different apartment. Damage to Vehicle- We do not dispute that there was damage to her carInitially, the notice of a fallen tree came to our attention via a resident living elsewhere on the propertyWhen maintenance staff responded, there was no tree on any car in the area where the original caller had advise?? of, Ms*** had moved her vehicleMaintenance did not check every car in the parking lot for damage, as it was dark at the timeThe next morning, Ms*** contacted the office, advising office staff that it was her car that had been damagedManagement asked for to take photos of the damage, however the car was not on the property at the time, as Ms*** was at work and had the car with herWhen Ms*** arrived at the property is was approximately 5:pm and darkPictures were taken but did not come out wellAn incident report was filled out and submitted to our officeOn Site management staff offered to look into seeing what could be done for Ms*** through our companyThroughout our leasing process, our residents are strongly encouraged to purchase Renters InsuranceOur Lease Agreement that Ms*** entered into states that we are not responsible for damage to residents' or their guests' personal property, Ms*** chose to sign a waiver, acknowledging that she had been advised that Edgebrook Estates was not responsible for damage to resident's personal propertyA copy of this waiver signed by Ms*** is attached. In closing, while we always strive to provide our residents with quality housing, we abide by the terms of the lease agreementWe always strongly encourage residents to purchase renter's insurance, to protect themselves and their personal property.
