Initial Business Response / [redacted] (1000, 5, 2015/05/11) */ We are a preferred contractor for his insurance company and they sent us a job referral to meet him and look at his fenceI went out there and said there was more lineal feet damaged and it was cedar not green treatedI said we could do the work and submit our estimate into his insurance company if we had a signed agreement to do the workFor the estimate we have to go back and use xactimate which is an estimating software that is recognized by the insurance industryHe then signed the agreement for us to either fix the fence or replace all his fence and gave me his $dollar deductibleAfter that I went back to the office wrote the estimate and talked with his insurance adjuster and got our estimate approved through his insurance company and he received an extra check for $1,I then called him and he said give him a little while to decide if he wants to fix his fence or replace it all he said he might put it on the market and did not know if doing a new fence would be worth itI called him back later and he told me that he was going to try and remove the fence himself to save money over the weekend and he would give me a call on Monday and let me know what he wants to do he said I already paid you $1,dollars so I will have you do something just not sure what yetHe called a week later and talked to the owner and said that he wants his $1,dollar down payment back and he did the work himselfI then called him and explained that we had a signed agreement to do the work and that we are going to charge him $for estimate and administrative feesHe then said that we did not do any work for him which is not true we had to take pictures of his damaged fence and then write and estimate through Xactimate (which that program costs about $dollars a year) and upload it to his insurance company in order for the insurance company to accept our estimate (we had about 7-man hours of administrative work in his job) He said that it was a free estimate and the agreement was not legal until the insurance company approves the estimateI explained that they did approve our estimate that is why he received more money from them and told him I could go after the 25% cancellation fee which would be around $but am only charging him $We talked to his insurance company and they thought we were being more then fair with him charging him $ I believe he just wanted a preferred contractor to write the estimate to get him more money (which we did) and then just cancel the contract so he could pocket more money and do the work himselfWe did not go out on a free estimate it was a job referral through his insurance company it is our policy to have a signed agreement to do the work before submitting estimates to insurance companyIf somebody calls and wants to know how much it costs for a deck, fence, roof or something like that then we will give them a free estimate not submit it to their insurance companyIf it comes as a referral from an insurance company we our not allowed to share our estimate with him until it is approved by the insurance companyI will attach his signed agreement (see number on back page for 25% cancellation) also I will attach the email from his adjuster which proves our estimate was approved and that is why he received more money from themWe did mail him a check for $for his refund

I am rejecting this response because:Mr*** has continually said for
over a month both to me (prior to my filing the complaint) and to the Revdex.com that he will return the paperwork and has not done so. I also filed a complaint with the Attorney General’s office. They have reached out to him multiple times. They asked him both verbally and in writing to sign a document stating the contract was void without penalty. He verbally agreed to sign a letter they sent him, but still has not responded to their written requests. I will consider this matter resolved and closed when he provides the original paperwork or the signed letter that the Attorney General’s office sent him to either me, the Revdex.com or the Attorney General’s office

As soon as this complaint to the Revdex.com is taken down you will get your paperwork> However if this does not get taken down you will not get any paperwork returned to you.

Business asked me to take down complaint and in return would give me the paperwork for shredding. Business failed to return paperwork.

He then signed the agreement for us to either fix the fence or replace all his fence and gave me his $1000.00 dollar deductible. If somebody calls and wants to know how much it costs for a deck, fence, roof or something like that then we will give them a free estimate not submit it to their insurance company. If it comes as a referral from an insurance company we our not allowed to share our estimate with him until it is approved by the insurance company. I will attach his signed agreement (see number 12 on back page for 25% cancellation) also I will attach the email from his adjuster which proves our estimate was approved and that is why he received more money from them. We did mail him a check for $650.00 for his refund.
