*** ** *** Dear Dispute Resolution Team: On April 14, 2017, Selene Finance LP (“Selene”) received the Revdex.com’s (“Revdex.com”) correspondence forwarded from Andrew Tabak of the Law Offices of Matthew Metz on behalf of Ryszard Gut, regarding loss mitigations for the above referenced loan Please be advised that we are committed to working with customers who seek assistance from us. We work hard to keep our customers in their homes and view foreclosure as a last resort. In that regard, on August 16, 2016, pursuant to the receipt of MrGut’s loss mitigation application, we initiated another review of the loan for a potential loss mitigation workout. However, upon review of the documentation provided, we determined certain items were missing. As a result, the enclosed letter dated August 17, was sent to *** *** requesting the missing documentation. Further, the missing documents were to be returned by September 15, Unfortunately, we did not receive all of the required documents within the allotted time frame, and as a result, the loss mitigation file was closed on September 23, 2016. Notification of the loss mitigation determination was provided to *** *** by way of our enclosed letter dated September 23, Please be advised, in accordance with the applicable regulations, if a loan servicer receives an incomplete loss mitigation application thirty-seven (37) days or less before a scheduled foreclosure sale, the loan servicer is not required to initiate a loss mitigation review. In addition, we may only suspend active foreclosure proceedings providing we receive a complete financial package more than thirty-seven (37) days before a scheduled foreclosure sale date. However, even if we receive a complete financial package less than thirty-seven (37) calendar days before a scheduled foreclosure sale, there is no guarantee we can evaluate the file for a home retention option in time to stop the foreclosure sale Our records indicate on March 10, we received an incomplete loss mitigation package as such no loss mitigation review was initiated Thereafter, on April 6, 2017, the property was foreclosed in accordance with New York foreclosure law Please be advised, Selene maintains that we complied with the applicable state laws and regulations to proceed with the foreclosure saleLast, we understand Mr*** attempted to contact the specialist assigned to MrGut’s file, and we apologize for the communication difficulty that he experienced. On May 1, 2017, Selene Finance LP (“Selene”) received the Revdex.com’s (“Revdex.com”) correspondence forwarded from [redacted]f the Law Offices of Matthew Metz on behalf of [redacted] regarding loss mitigation efforts for the above referenced loan.   Please be advised that we are committed to working with customers who seek assistance from us.  In that regard, on March 15, 2017 upon receipt of certain short sale documentation from the Grau’s we initiated a review of the loan for a possible short sale.  On March 20, 2017 [redacted]f the Law Offices of Matthew Metz contacted our office regarding the short sale request, the assigned Single Point of Contact Trenton Mills advised that we would need an offer of $190, 000.00 with net proceeds of 90 percent.  Further, we required proof of HOA lien, commission adjusted to 5 percent and reduced closing fee.  Please note Mr. Tabak advised he would confirm taxes on the HUD -1 Settlement statement and provide updated offer.   In the interim, pursuant to procedure, March 20, 2017, we ordered an appraisal of the property, and we received the appraisal on March 23, 2017, which indicated a value of $195,000.00.   On March 22, 2017 Mr. Mills contacted Mr. Tabak regarding the counter offer of $175,000.00 we received via phone, and advised him to provide a Brokers Price Opinion (BPO) or comps supporting the offer.  Thereafter, on March 23, 2017 we received the BPO which indicated a value of $177,000.00, as a result the BPO, and the purchase offer were forwarded to our Valuations Department for review.      Thereafter, on April 12, 2017 Mr. Mills contacted Mr. Tabak and advised that the BPO had been reduced after review by our Valuations Department and we needed authorization to submit the offer of $175, 000.00.  In addition, we required updated proof of funds reflecting offer amount, an updated payoff for Jr. Lien, payoff for HOA lien, commissions adjusted to 5 percent, settlement charges reduced to $750.00, and an updated HUD-1 Settlement Statement and Listing Agreement since the previous documents expired February 28, 2017.   Our records indicate on April 19, 2017 we received certain short sale documentation, however based on our review additional documentation was required.  As a result on April 26, 2017 Mr. Mills contacted Mr. Tabak and advised that we required an updated contact or addendum for the offer of $175,000.00, settlement charges to be reduced to $750, the HOA fees to be negotiated and the name of the account holder for proof of funds.   Based on the foregoing, upon receipt of the requested items we will complete the short sale review for the above referenced property.   Last, we understand Mr. Tabak attempted to contact the specialist assigned to the Grau’s file, and we apologize for the communication difficulty that he experienced.  Please note that our telephone system will automatically direct the customer to the Single Point of Contact; however, in the event that the Single Point of Contact is unavailable, the call will be transferred to the next available representative who can assist.     Should you have any additional questions, please contact our office.    Sincerely,   [redacted] Customer Service Specialist Selene Finance LP

            [redacted]       [redacted]               Dear Revdex.com:   Selene Finance LP (“Selene”) received your correspondence on September 19, 2016 and September 28, 2016, on behalf of [redacted] regarding her above referenced mortgage loan and her requests loss mitigation assistance under the Home Affordable Foreclosure Alternative ([redacted]) Program.   Based on a review of our records on August 25, 2016, [redacted] Single Point of Contact, [redacted] Jones, contacted her and informed her of the August 30, 2016 foreclosure sale date.  Additionally, we advised [redacted] that we required a complete loss mitigation package to complete a review of the loan for a potential non-retention option.   On August 26, 2016, [redacted] contacted our office and indicated that her loss mitigation application had been submitted to us for review.  However, we did not receive [redacted] application until August 30, 2016.     Unfortunately, the foreclosure sale of the property occurred on the same day, August 30, 2016, and as a result, we were unable to initiate a loss mitigation review of the loan for a potential non-retention workout option.    On September 1, 2016, Ms. Jones attempted to contact [redacted] and advise of the determination, however, her attempt was unsuccessful.  Subsequently, [redacted] contacted our office and was advised that we were unable to proceed with the review for a potential Deed In Lieu of Foreclosure.   Last, we apologize for the incorrect information relayed to the [redacted] by way of letters dated September 14, 2016.  Specifically, our letters indicated that upon receipt of [redacted] loss mitigation application, we initiated a review of the loan and determined she did not qualify for a non-retention option.  Rather, as indicated above, a review was not initiated because the foreclosure sale occurred on the same day we received the loss mitigation application.     We regret we are unable to overturn any previous decision.  Should [redacted] have additional concerns or need further assistance, she may call our Loan Resolution Department toll free at (877) 768-3759.   Sincerely, Samuel W[redacted] Customer Service Specialist Selene Finance LP
