Regarding Complaint ID [redacted] , [redacted] M [redacted] ·who now has requested a disc (tape recording) of the original conversation with our representative Sara· G [redacted] and the confirmation call from our representative John M [redacted] which I have enclosed along with the verification call placed by our representative Jeff [redacted] that I·had already mailed to you ·and hopefully you listened to, all combinedHer original complaint alleged she was to receive magazines for per quarter, now her second letter says magazines per quarterHer letter this time states "After that there was a gentleman who called me at work to verify my order, in that recording he talked so fast confirming details of the order that when I hung up I was unsure of what I had agreed on, I tried calling -the company back but there was ·not a #for me to contact them."Not knowing for sure which call this refers to, I have included the second callfrom John confirming the order before sending the driver to sign Ms [redacted] up, or if she refers to the call from our verifier Jeff [redacted] who I have already sent you the disc of that verification on my original answerIn none of these conversations was there ever a mention of paying quarterly! Also on the copy of the contract that Ms [redacted] signed (copy enclosed again) our phone number is listed along with our fax number, it is also listed on the magazine list left with her at· the time of delivery since·one of the perks of our service is that our customers can change their selection at any time during their service(Copy enclosed)Ms [redacted] also states "Intheir current response they stated that I agreed to pay a week for 6o months, if indeed this was true then I would be paying a total of per yearAnd I have paid that in the last months plus more $." to address this .statement I will point out that $per week for 6o months for weeks amounts to $$per month for thirty (go) months equals $Her contract calls for her to pay $down, which she paid to MrM [redacted] by check number (copy of which is in your possession) on Jan06, and then to pay $per month for·the next payments beginning in May, 2015.In closing Ms [redacted] allegations are truly bizarre in light of the facts in these recordings that clearly refute said ·allegationsFurthermore I felt I was being conciliatory when stating "I can see where the confusion may be interpreted as a quarterly payment of $being more than $per month; however, this amount includes late fees and an additional payment due Noveniberl, which amounts to $122.72, and this is not quarterlyMy apologies for the confusion." Ms [redacted] was originally contacted at 02:PM on July 15, by our representative Diane O [redacted] and offered a package of magazines (6) for a cost of $per week for sixty (6o) months, she agreed and the order was placedOn July 20, Ms [redacted] was contacted again at 09:38AM to have her order serviced, meaning the list of magazines were offered for her personal choices, the costs of the service were discussed, $per week for the sixty months was addressed and it was agreed with our representative John M [redacted] that she would make these payments thusly; with four and one third weeks in a month the $per week would amount to $per month for sixty months (6o) or she could pay it at $26.oo per month for the first thirty (30) months and pay nothing for the remaining months of service since most of our customers don't want to make 6o payments on anything unless it is a major purchase like appliances, car, etcShe agreedMrM [redacted] then explained that one of our representatives would drop off her contract, guarantee, list and a small premium for placing the order with us in person on either Thursday July 23, or Friday July 24, since our representative would be coming all the way from Buffalo, ·-New York and that he would be collecting the initial payment of $26.oo at that time which she could pay with cash, check or credit card to which she agreedPlease be informed that these calls are made from our VOIP phone system that automatically records all incoming and outgoing calls, therefore I can produce these recordings upon request.MrM [redacted] delivered Ms [redacted] contract, list, guarantee and a BBQ cookbook on July 23, which you will note that Ms [redacted] changed her original choice of Cosmo magazine to Boating at that timeShe filled out the contract instructions to list two references, her SS# and signed and dated this contract directly next to the codicil on said contract "YOU THE BUYER, MAY CANCEL THIS TRANSACTION AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE THE DATE OF THIS TRANSACTIONShe paid the initial down payment using her Master Card beginningwith [redacted] along with the expiration date and the CVV # ***On July 30, Ms [redacted] was called by our representative Jeffery J [redacted] who is our verifierHis job is to verify all of our contracts before we send them to our clearing house in Bridgeville, Pato make sure that our customers are aware of the terms and conditions and still want the magazines listed or make changes, note that this contract was called a full week after signing the contract, that the customer is informed that this verification is being tape recorded with her permission and that upon entering her selections with the individual publishers the contract is not subject to cancellation to which Ms [redacted] agreedI have included a copy of that verification for your edificationIn the interest of mollifying Ms [redacted] angst I would entertain working out a compromise settlement, however after reading her description of events and her allegations of "this terrible misleading company" she refers to in her Desired Settlement: I hesitate to feel co-operation on our part would be received by Ms [redacted] as a gesture of goodwill, so in anticipation of the Revdex.com reviewing our response and the enclosed tape recording I feel confident that we are justified in our position that we have in fact supported our side in this "she said/he said complaintSincerelyM.JM***

This allegation is in fact incorrect.On December 11, our representative Sara G [redacted] contacted MrS [redacted] at [redacted] '*** [redacted] ***who MrS [redacted] claimed he was the owner of and sold him a package of magazines (6) for a setperiod of months for $per week payable monthly This transaction took place at 03:46P.Mthat dayOn ' I December 16, MrS [redacted] was contacted by our representative John M [redacted] who identified himself as theyoung lady's supervisor who called him on the eleventh and was calling to verify the placing of the order and to set up delivery of said order John explained that the order was for his choice of five or six publications depending onchoice for $3-per week payable monthlyWith and one third -Weeks in a month the cost of the service would be $per month for 6o months however most people chose to pay twice as much for half as long,or $each month for thirty months and nothing the remaining months of service to which MrS [redacted] agreedMrM [redacted] explained toMrS [redacted] that a delivery driver would drop off his paperwork, his guarantee, list, copy ofthe contract; a premium (cookbook) for taking the· order and that he MrS [redacted] would be required to pay the first or initial payment at that time to which he agreedOn December 19, this transaction took p!ace with Mr.S [redacted] issuing check number for his initial payment of $At this time MrS [redacted] also signed the contract, copies of the contract and check are enclosed.As is out practice with all contracts entered into with our customers we allow not only the business day cancellation period but also wait an additional week before our office calls to verify the transaction as we did with Mr.S [redacted] who1was called by our office manager Jeff Jones who verified this order with him on January 08, at 02:P.MThis verification was done on a tape recorded conversation with Mr***'s permission and has been included with this response for your edification.In reference to MrS [redacted] s assertion when you try and contact them they don't even have a working number'' is also, incorrectOn every monthly billing our number is displayedFurthermore please note our local as well as toll free number and fax numbers are displayed directly beneath our name on the contract MrS [redacted] signed and has in his possessionWe are reasonable people here at E.R.Sand had MrS [redacted] contacted us here at our main office [redacted] to discuss his concerns I'm sure we could have reached an amicable agreement, however when you deny you evenparticipated in the transaction, received the merchandise you purchased and then use the Revdex.com as a tool to receive a possible refund I cannot conceive of this scenario even being consideredI am also in possession of the tape recordings of the original sale and delivery set up calls as well since our phone system is VOIP and every call incoming or outgoing as automatically recordedIn anticipation this will aid in your investigation, I remain;Melba M***'

October 19, 2015Regarding Complaint ID of ***, *** ** *** who claims "Some one from this company called me at work about a year ago with a promise I could get 8 magazines for quarterlyThe price then changed toa month, and now I got a bill saying it would
be per quarter which comes out to approximately $a monthI can not find phone# to contact this company to try to resolve this complaint."On February 03, Ms*** was contacted by our company at her place of employment at 10:A.Mand agreed to purchase six (6) publications for $per week for sixty (60) monthsShe was then called on February 04,by John M*** who explained the service and the fact that a delivery driver would be dispatched to drop off her contract, list of magazines and guarantee to her in person and that her payments would be $per monthfor the frrst thirty (30) months, nothing for the remaining months and that when that delivery was made she would have to pay the first payment of $then and her next payment would be due in MayShe was informed that this delivery would occur on either Thursday 02/05/or Friday 02/06/since these were the only two days weekly that we deliverShe agreed and her order was serviced on that Friday, 02/06/when Ms***changed four of the original selections agreed to over the phone, signed the contract (which she dated 1/6/15) and issued check #of $(also dated 1/6/15) which was her down payment leaving payments remainingstarting in May A copy of her contract, her list and guarantee and a premium (cookbook) was left with herI am including a copy of the order card, her contract with a copy of the check used to pay the initial payment areenclosed as well. I have also included in a letter I am sending today with a disc of the verification call placed to Ms*** by our representative Jeffery *** who verifies every contract before actually submitting the order to our clearing house in Pennsylvania, this verification process was initiated by Mr*** on February 12, at 11:A.Mbetween Ms*** *** and MrJeffery *** with Ms*** permission to be tape recorded that I believe substantiates our position regarding Ms*** allegations of "getting 8 magazines for quarterlyThe price then changed to a month, and now I got a bill saying it would be per quarter which comes out to approximately $a month." Addressing this concern, Ms*** has made six (6) installments of$and $in late fees for a total of These payments of $are monthly and paid monthly except for late fees when the installment is lateOn the billing that Ms*** refers to as "per quarter which comes out to approximately $a monthI can not.fmd phone# to contact this company to try to resolve this complaint." I have enclosed a copy of that billing with the phone number listed and the fact that Ms*** was in fact $past due along with the $for October and the $due 11/1/amounts to $I can see where the confusion may be interpreted as a "quarterly payment" of $being more than $per month, however, this amount includes late fees and an additional payment due November 1, - which amounts to $122.72, and this is not quarterlyMy apologies for the confusion. In any case the disc will confrrm the understanding we have.with Ms***, the signed contract with a reference given by Ms*** beneath her signature, the copy of theiniitial payment check issued by Ms*** and the fact that the contract states the payments of $each month and the fact that she has made six of these payments monthly along with late fees when she was late I believe confirms our positionFurthermore the entire sale, and second confirmation call by MrM*** on February 04, are also tape recorded on our VOIP Vonage phone system should you need a disc of these calls as well. Regarding complaint ID ***, *** *** who alleges that "They said the cost of the magazines would be 30$ a yearInstead they have sent a bill for 30$ a month. In response to this first allegation, I am enclosing a copy of the order card which shows that Mr***
was called on o6/05/at noon by our representative Megan H*** to receive magazines for $per week for 6o monthsThose magazines are listed on the order card copy enclosed On 06/11/Mr*** was called again by our representative John M*** to confirm the order Mr*** had placedAt that time Mr*** was apprised of the magazines ordered, the cost of the magazines, $per week payable monthly with 41/3 weeks in a month works out to $per month for the 6o monthsHe was advised that most people choose to pay twice as much or $per month for the first months and then owe nothing for the remaining months which Mr. *** agreed toHe was then advised that a delivery driver would drop off his contract, guarantee, list, and a small premium (in his case it was a Best BBQ cookbook) on either Thursday o6/12/or Friday o6/13/and would be collecting the first two months $at that timeMrM*** then delivered said goods and collected the $in cash at that time when Mr*** signed the contract for the exact same publications as were ordered over the phone on 06/05/All of these calls were tape recorded since we have VOIP (voice over internet protocol) system that automatically records all incoming and outgoing callsThese recordings are available upon requestFurthermore, on o6/19/our verifier Jeff J*** called Mr*** back to verify his order before placing his individual subscriptions with our clearing house in Bridgeville, P Awho handles the over publications we representThis call was also tape recorded with Mr***'s permission and I am including with this responseThis recording is included because it is the last conversation our office has ever had with Mr*** who claims "I immediately called to say this is not correct but they saw (sic) it is and that it is also a two year contract which I was never told anything about in the first place. The magazines are not even the *** they said they would send me." Now regarding these statements and others claiming he has called etcmy response is that the VOIP phone system I mentioned before does not have any record of any incoming calls from Mr***, however he may have made these calls to our data center (clearing house) and received these rude responses, but again we would have been alerted to his angst since we are the company who sold the magazines to Mr*** and also paid for those subscriptions in advance on his behalf since our service guarantee's our customers that their price will never increase no matter what the postage rates increase to, nor the price of the publication might increase to, in order to do this we of course are required to pay for the subscription price in advance which we do based on the customers signature on the contract and the verification call placed a week later from our verifier, Jeff J***Youmay note that on the contract Mr*** signed (copy enclosed) directly to the left of his signature is the codicil alerting the customer of his right to "cancel this transaction at any time prior to midnight of the third business day after the date of this transaction." Furthermore our company waited until 06/19/to verify on tape the terms and conditions verbally with Mr. *** which he did agree to at that timeDisc enclosed. We also had his order held at the data center for another days before actually entering and paying for his publicationsI believe we acted in good faith and gave Mr. *** all the time necessary to change his mind. In closing Mr*** states "After doing research on the internet I am clearly not alone on this! This is not right." I can empathize with Mr***'s consternation but his allegation of impropriety on our part seems specious at best since the tape recording reveals the process we follow on every signed contract we enterHis Desired Settlement: I want them to stop sending me magazines and stop charging me for themI will send a check for the 90$ they want me to pay for the last three months but Iwill not agree to pay for anymore and need it in writing that they are stopping this." My response to this Desired Settlement: is this I would entertain a settlement figure should Mr*** listen to his tape recorded verification aswell as the entire sale and confirmation process he engaged in with MsH*** on the sale and MrM*** on the confirmation call, admit that he actually agreed to all of the terms on these calls and agree to work out an amicable settlement on a tape recorded compromise situation, I believe we could arrive at a mutual agreement, however, I will not agree with his interpretation of the facts of this complaint.Sincerely,M.JM***

assertions that are just frankly incorrectMs. *** as contacted originally on January 13, at work at A.Mwith an offer to receive magazines for $p r week for months, payable monthlyHer choice was listed on the order card (copy enclosed) and Teen magazine was changed to Seventeen by Ms ***She then was called back by our office confirmation deptby John M*** who confirmed the order with her at 11:A.Mon January 19, 2015, discussing her choice of magazines, explained the fact that she could pay the $per month payments and explaining the option of pay the installments of $30.30 per month for the first thirty months thereby paying the order in fuin the first thirty months and paying nothing the remaining months of service to which Ms*** agreed toThe was informed by MrM*** that a delivery driver would drop off her copy of the order, her list, and guarantee and that she would have to pay the first $at that time and her next $payment would not be due until April She agreed and was set up for delivery for that Thursday or Friday the 22nd or 23rd at her place of employmentHer order was delivered on Friday, January 23, as agreedShe was given her guarantee, list and contract to sign which she did and supplied us with her Social Security Number and two references, paid her initial deposit of $in cash at that timeHer $cash payment was noted on her copy of the contact she signed and given to Ms*** along wit her list and guaranteeMrM*** who delivered her paperwork also gave Ms*** a cook book as a thank you premium for placing the order with our companyMs***'s order was then brought back to our office in Buffalo MYto be entered with .our clearing house in Bridgeville, Paafter her three day cancellation period had expired and our representative Jeffrey Jones called her back to verify her order before actually purchasing the subscriptions on Ms***'s behalf0ur policy is to wait six to seven days before the final verification call is placed with the customer which Mr Jones did by calling her on January 30, During the tape recorded verification call placed with the permission MrJoneswas asked by Ms*** about the further payment or payments which MrJones corrected her belief that she only was aware of one other payment and explained that there were in fact ''more consecutive payments of $30.30, not one, and asked if she agreed to that" which she agreed toI have included a disc of this conversation; I normally offer the tape, however with all of the allegations and accusations of this complaint feel compelled to at least provide evidence of our actual last conversation with Ms***I will mail that tape recording on the disc in a separate letter from this fax to Revdex.com, Bryant Woods South, Amherst, NY Ms***'s call to ###-###-#### was to the clearing house that her magazines are serviced from in Bridgeville, PaHer subscriptions were ordered, paid for by our company and distributed through this company and referred to her to listen to her complaints that she has taken such umbrage withThis is who coordinated the six JUL-06-14:publication IS she ordered, entered those subscriptions she is still receiving as agreed on her contractIn closing I can produce (upon request) the entire sales call from the initial salesperson, the confirmation call by MrM*** used to base the delivery of her contract, list of magazines, the guarantee, and the cookbook premium dropped off to Ms*** by MrM*** n January 23, 2015, (l certainly would not send a driver over miles round trip on an order that did not understand the agreement) and copies of the contract signed by Ms*** as well as the order car from the initial contact with Ms*** when she ordered the magazinesFurthermore, Editors Readers Service was established on September 16, (copy of Business certificate enclosed) and is still in business under the nameIn anticipation that after reading this response and listening to the tape recording of the verification call sent in separate envelope you may see our side to this complaint.Sincerely,M.JM***

Regarding complaint ID of * , ** who claims she was contacted at work and was told "that if I paid for a subscription for a year that I would receive magazines for years." Evidently after thinking about it she realized "that is something that I didn't want to nor could I
affordSo a week later I called and wished to cancel my subscription they told me that I could not cancel but they would lower my monthly rate from $somethinga month to $and I told them no that I wished to cancelThey refused so I have been paying $every two months for magazines that I don't read and some I signed up for I haven't even receivedI would like tocancel my subscription and not hear from these people againI have tried to contact them again and there is no number given for me to call and talk to customer service." On December 03, Ms*** was called at her place of employment with an offer to receive magazines a month for $per week for monthsShe agreedShe was called again on December 04, by a confirmerwho explained the terms and conditions of the order and gave her another magazine and explained that she would receive a cookbook premium for taking the order when the delivery driver dropped off her list, guarantee and contract on Thursday or Friday of that week and that she would be required to pay a $down payment at that timeShe agreedOn December 05,Mr* arrived at her place of employment to deliver her contract, list, and guarantee along with her cookbookA copy of that contract and the check she paid the down payment of $is enclosedHer contract was then dropped off at our office in Buffalo, New York on Monday December 08. On December 11, our representative Jeff J who verifies every contract before sending them in to our clearing house in Bridgeville, Pa(Disc of that tape recording enclosed) called and verified the transaction with Ms*** with her permission and alerting her to the fact that the contract was not subject to cancellation to which Ms*** agreed toThere was no mention of affordability, wanting to change her mind, etcWe then sent our contracts to the clearing house which then held her order for the magazines for an additional days before processing the individual subscriptions to be sent to Ms. ***Our service allows the subscriber the right to change the magazines at any time, it also guarantees the subscriber that the cost of their subscriptions will never increase during their term of service no matter what the magazines prices increase to or how much the postal cost of sending them may increase, we do this by paying the publishers in advance for the subscribers choices. Therefore it is in our best interest to make sure that the customer actually wants the service and understands the terms and conditionsI believe the enclosed disc will affirm our position on this inquiry. In Ms***'s explanation she states "So a week later I called and wished to cancel my subscription" yet we have no record of that callWe have a * phone system here that records all incoming and outgoing calls and this call is not on recordAlso she also claims that "I have tried to contact them again and there is no number given for me to call and talk to customer service." Our number here is * which is located on our contract, copy of which was left with Ms*** and on her list that was also left when she signed the contractThe other number from the clearing house is * which is located on each of her monthly invoices. In the interest of compromise I would entertain a possible solution to her Desired Settlement: "I wish to have my subscription cancelled from this scam of a magazine company." There of course would be no refund offered and she would have to admit that nobody attempted to "scam" herIf she would consider this possible solution I would suggest she actually call Jeff J at * to explore a mutual settlement. have serviced since and evidently has since married a *** *** ** *** and is now using the last name ***I really cannot comment on Mr***'s assertions in the context of him having standing in the transaction between *** ***/*** and our company, therefore I will address this complaint as to the transaction entered into with E.R.Sand ***. On October 25, our representative Diane O*** called Ms*** at *** and sold her six magazines of her choice for $per week for 6o monthsMs*** was then called back on October 28, by our representative John M*** who confirmed the order with Ms*** to receive the Cosmopolitan, Food Network, Shape, Better Homes & Gardens, Vogue, and OK Entertainmen.t Weekly magazines for $per month'for 6o monthsMrM*** explained that she could also opt to pay this at $for the first months and it would be paid in full and of course she would pay nothing the remaining months of service which she agreed toMrM*** explained that he would deliver her contract, guarantee, list, and a premium (cookbook) for placing her order with us on either October 30, or since he would only be in the Columbus area on those two days and he would be required to collect her first payment of $at that time of delivery to which she agreed. I have enclosed the copy of the contract with the magazines listed, a copy of the check issued by Ms*** for the $initial payment, her signature, the last 4 numbers of her SS#, and two references all filled in by Ms.*** herselfFurthermore, the buyer's right to cancel normally three business days was honored and actually we held her order in our home office here in Buffalo until November 13, when our verifier Jeff J*** called Ms.*** to verify her contract with her on a tape recorded conversation with her permission before entering her order with the Magazine Fulfillment Center who is the clearing house for our distribution of customers subscriptionsA copy of that tape recording is being mailed in a separate envelope today since I am faxing you this responseOn that recording you will note that Mr. J*** informs Ms*** that once we enter her order with the publishers the order is not subject to cancellation! To which Ms*** agrees. In reference to Mr*** who I now notice is listed as a reference and whose name also is listed on the ,check Ms. *** issued for her initial payment states "We have tried to cancel this service numerous times via phone callsand emailThey tell us we cannot cancel and I refuse to accept that." Magazine fulfillment informs us that Mr. *** has requested by phone on three different occasions to cancel and was told he could notMr*** states "Theykeep charging my account even though we have cancelled our service." This statement seems to contradict his previous sentence that we have "told us we cannot cancel" yet "I refuse to accept that." In Mr***'s Desired Settlement: Refund the money they tookSTOP taking money out of my accountWe're not even getting the magazines they say they are sending." We of course will not be refunding any money since the only money we are receiving is for-the magazines Ms*** purchased and continues to receiveAs far as the "We're not even getting the magazines they say they are sending." This is the first we have been notified of this, however we will alert the individual publishers who will verify through the bar code on the stencil located on the lower left side of the magazines and the U.SPostal Service as to where these publications are being delivered if not to their proper address and should there be a discrepancy any missed issues will be added to Ms***'s order.In anticipation that our response may lead you to a greater understanding of the facts of this complaint, I remainSincerely,Melba M***
