E.F. Fogarty Construction

Review: I am a trustee of [redacted], [redacted], [redacted], MA [redacted]. In August, 2011, EF Fogarty Roofing Co. installed a new roof on one of our buildings, and made repairs to the roof on another building. We were very satisfied with the product and workmanship. The GAF 30 year lifetime Timberline shingles installed carry a manufacturers 30 year warranty and the workmanship a 10 year warranty. In late September of this year a few shingles fell from the building with the new roof. During the next month, our property management company made four calls to Mr. ** Fogarty to request that repairs be made under the terms of the warranty. No return calls were received from EF Fogarty Roofing Co. I then placed two calls to Mr. Fogarty without success. During the roofing project and the previous year or two when EF Fogarty Roofing Co. made repairs to our roofs, I felt that I had a positive working relationship with Mr. Fogarty. When all the phone calls failed to elicit a response, I sent a letter via certified mail to Mr. ** Fogarty at EF Fogarty Roofing Co., [redacted]., [redacted], MA [redacted] requesting that the repairs be made and mentioning that we would like to hire the company to make some additional repairs on the other building. On November 8, 2014 our management company received a call from EF Fogarty Roofing Co. stating that a repair will be made sometime in the next week or so. To date no repair has been made. In my letter to Mr. Fogarty I mentioned that if no response was received, I would consider filing complaints with the Revdex.com and the Massachusetts Attorney General's Office of Consumer Protection. I will not file with the Attorney General pending the outcome of this complaint. The total cost of the 2011 projects completed by EF Fogarty Roofing Co. for us was $57,000 which was paid promptly in increments according to the terms of the contract. I had thought the Mr. Fogarty contacted our management company on November 8 as a result of receiving my letter. However, my letter was returned to me today by the Post Office "unclaimed".Desired Settlement: That EF Fogarty Roofing Co. make the warranty repairs and give us a report as to why these shingles failed within three years of installation, as well as an explanation of why we have been unable to communicate with them, and whether they want to perform any further work for us.

Worked with company on several jobs. On-time, well priced and stood behind work. Even replaced a small window on shed his staff accidentally broke without being told to do so.
