EL Primo II

I purchased 4 used tires from this location in July of 2013. The owner told me another customer bought these used them for approx XXX-XXX miles, returned them because he didn't like the ride and got another set. He told me he would give me a great deal if I purchased them that same day, I told him I could get them the next morning when he opened and he agreed. I noticed after about 7-8 months the wear was real uneven and odd, I figured it was my truck so I saved money and replaced all the ball joints and when I was rotating the tires I noticed a large chunk (approx 8-10" long x 6-7" wide) of the tread missing from the middle of the tire. I then looked closer and realized the tires were Recaps not new like I was told! I went back to the shop and the manager said there was nothing he could do because they don't sell Recaps. I finally convinced him to call the owner who promised to be there in 15min but really took an hour (2:12p.m - 3:09p.m.) when the owner arrived he said first thing those are Recaps and immediately got on his phone. He told me his brother sold them to me and he was on his way. He also told me that his brother owned the shop the and now he does so he's not going to help me because he didn't sell them. The brother arrived and started off by saying I new the tires were recaps, when I reminded him of what he said he replied "oh yea" . I asked what he's going to do and his response was " I'll get you one replacement tire for $40-$50, I said what about the rest and he said "you knew they were used" I reminded him he said the were new with 300 miles on them and he said yes but that's "technically" a used tire. I asked again what he's going to do to fix this and he said "nothing, you got almost a year that's pretty good". I was disgusted and I warned them I would file a complaint and he shrugged his shoulders and walked off.Product_Or_Service: TiresDesired SettlementI would like either my money back $550 for the set installed or for them to give me a new set. Business Response This customer has brought 4 "USED" tires which there is NO WARRANTY on any used tires. Even if a tire has any warranty they would only replace the ONE tire not all 4 tires. In which this customer was asking for. We've offered to replace the one tire but he would have had to wait a couple of days, because that size of tire was unavailable at the time. customer has used these USED TIRES for approximately 6 to 7 months came back and demanded his money back or a NEW set of tires, with NO RECEIPT. Customer was aware that the tires were USED and sold as is. It is impossible for me to refund the customer back his money or a New SET of tires. I did offer to replace the ONE tire but he demanded all 4.
