Although they fixed plus driveways due to the sloping into the entrances of the driveways. I took my own initiative to fix my driveway in a timely manner to decrease car damage and I usethe SAME concrete contractor they also employed, again my issue is, they should of made the same offer to ALL homeowners who were presented with the same problem, whether it was fix by myself or them.

This is in response to the complaint brought by [redacted] of [redacted], PA [redacted] (Complaint ID [redacted]) against EG Stoltzfus Homes, LLC.  I am writing to inform you that the driveway
approach in question was installed per the township’s wishes and was also
inspected by the township after it was completed.   
[redacted] did not provide EG Stoltzfus Homes, LLC the opportunity to address her
concerns because she never brought any to our attention until she contacted us
requesting compensation.  She contacted
and employed a contractor to alter her driveway approach and then contacted EG
Stoltzfus asking to be reimbursed.  I
have attached a copy of the Limited Warranty that **. [redacted] signed at the time
of purchase of her home that states very clearly in section 2. “The work to be
performed under this warranty will be performed by the Contractor or the
particular subcontractor who originally performed that portion of the
construction.  Contractor is not
responsible to pay any other person or Company and will not reimburse
Buyer/Owners if they employ any other person or Company to perform the work.” 
We do not
feel that EG Stoltzfus Homes, LLC owes [redacted] any compensation for any
work that she contracted on her own, however; we have agreed to provide a check
for the amount of $1,000.00 to help offset her costs in the spirit of
goodwill.

Review: I am a home owner at [redacted]. I was the first person to purchase a home in the [redacted] Developement and have lived there from February of 2006 to present. During this time, approx, 30 homes have been built by EG stoltzfus, and they continue to build homes, some under constructions at this time. During this time many changes have been made with township codes, one of them being the driveway aprons at the entrances of our drivways, In Dec. of 2012 the township sent a letter stating they were not under code and this was inhibitiing the township from taking over our streets, stating "The slope percentage of aprons on various driveways are incorrect. Agreement shall be made with the homeowners to correct this isssue". The meeting was held at the [redacted] township bldg reguarding this matter and decision was made that E G stoltzfus was assuming responsibility for the replacement for these entrances. My issue is the builders has replaced 20 plus entrances, one for free, one person they completely refunded, and several of the residents have been replaced at a discounted rate the other were done correctly. I never received a notification by the builder that THEY were replacing these entrances, after they requested a list of driveways that need replaced by [redacted], my house was not included on the list. Because I went ahead and replaced my entrance on my own, I could not wait any longer. My daughter exhaust pipe was taken off, the front end of my cars trim was scraped and cracked. I always had to enter/ exit at a sharp angle not to continue to damage my vehichle any further. I was directed by [redacted] on 5/26, EG Stoltzfus customer service rep, to send a letter and a receipt for the driveway repairs for request of payment. On June 2,sent a letter why I was requesting the payment. I never received a letter of acknowledgement nor a refund, so I called and spoke with [redacted] on June 11th, and he told me "that he has not gotten around to it, but he has not forgotten", Well now it is 6/25 and still no response/ refund. I was told by [redacted] that he was going to replace all the driveway aprons for eg stoltzfus, again, confirming that they assume the reponsibility for the incorrect poured driveways. I even hired the same concrete contractor as EG Stoltzfus was using. When I spoke with [redacted], I reaffirmed that I was not requesting anything more than the other residents had received. I am being excluded from the the contractors repair list because I took the necessary need to have my driveway repaired ahead time due the cost and damage of my cars, which I did not include in the refund request. I had my repairs completed on 4/13/ of 2013. EG Stoltzfus delayed the repairs until April of 2014, which waiting an additional year would have cost the risk of additional damage of my family and friends cars.Desired Settlement: I am requesting the full $1400 dollars in cost to bring my driveway up to code, EG Stolzfus has completed 20 plus driveways, because I took the necessary measures to due this they are delaying my payment. I gave them full and ample opportunity to correct the problem.
