Upon receipt of the full payment, Elcar must put in writing that the post concrete work and the warped picket will be fixed in a timely manner. Elcar can set the date but it must be a reasonable period after payment. We can exchange the written commitment to complete the job and the check at our house, *** ***, any day of the week after 4;pm.

This is a lie - I have repeatedly asked them to come out and they stood me up on one day and now refuse to talk to meIf they would like to schedule a time to come out and look at the gate this is what I've repeatedly requested since before this complaint was entered - read my complaint I give names and dates of times I've requested them to come and look at the gateYou can confirm my statements with the folks that answer the phone (I've included their names for this reason.)

Tell us why her [redacted] and [redacted], Initial complaint to the Revdex.comCustomer’s Statement of the Problem: We signed a contract for Elcar Fence to install a fence in our backyard. During the presentation, the Elcar representative indicated verbally that the total cost included staining the fence. Specifically, he said after 2-3 weeks from the installation, Elcar would return to stain the fence and we would need to let him know what stain we wanted before they returned. When we asked about that after the installation, the representative denied that he said this. He did point out it isn't in the contract and, unfortunately for us, that is correct. We did not read the contract carefully enough. But both my wife and I heard what the representative told us and he clearly stated they would return to stain the fence. We sent Elcar an e-mail regarding the staining and other minor items that we were not happy with, asking for the opportunity to discuss the issues. We contacted Elcar when a week wet by and we had no response. [redacted] talked with my wife and said she would re-send their response. Elcar's response was rude and unprofessional. Instead of agreeing with our request to discuss all of the issues, but most importantly the staining issue, their response totally disregarded the validity of any of our issues and immediately threatened to file a lien against our property. Additionally, [redacted]'s e-mail states "The lien is a formality and time driven once work has been completed. The lien will not go into effect as long as the invoice is paid now. How about you get the primary invoice taken care of this week. To stay within time sensitive dates you may pay by credit card and I will waive the 3% processing fee and no interest will be incurred on your account." She also sent a new invoice that changed the amount based on Elcar removing and hauling the fence. But, I removed a good portion of the fence and Elcar did not give credit for that. So, now we have Elcar insisting that we are late for the final payment, and will therefore file a lien, when they didn't even send us a correct invoice.Elcar’ Prior Response(s)Responded through the Revdex.com so that there was no further verbal misunderstandings, providing copies of the contract to all involved. Contract is clear that staining is not included in the contract.We reduced the invoicing by $405.00 in allowance for the portion of the fence you indicated removing yourself. Indicated that the contracted work is complete and the total of $1,842.04 is legally due.Response to last communicationThe initial complaint was not addressed in your most recent response to the Revdex.com; that of the staining. Subsequent to your complaint you have engaged another company to stain the fence and asked Elcar to reimburse you the cost. This was not authorized by Elcar and will not be reimbursed.Warranties are not effective until contracted and completed work is paid for in full. Once the outstanding balance on the account is resolved the warranty work of the warped picket in the pictures provided will be replaced. The doming (concrete above the surface) of the concrete was at your request. Minor cracks in domed concrete are normal and do not affect the stability of the posts in the ground however, we will skim coat them once for appearance. Both issue will be addressed when weather permits.Elcar has tried to address the ever changing issues in writing to resolve the contractual agreement. Unsupervised verbal communication will not be engaged in due to the previous allegations and to protect all parties concerned from further verbal misunderstandings. However, if the outstanding balance is not paid immediately communication will need to progress though our attorney.   e...

We are sorry that you felt our written response to your letter was threatening and unresponsive to the issues you brought up. Our intent was to inform you of our responsibility to protect our interests under the law until we are paid for product provided and work performed. Also, our intent was to...

clearly respond to each issue in writing so that there would not be any further verbal misunderstandings. We tired to clearly addressed each matter and provide copies of back up documentation, such as, the contract to show our response clearly and professionally.Yesterday, [redacted] requested a reduction to the invoice for hauling away debris.  I immediately researched that issue and emailed an amended invoice to her this morning. I received your call in reference to this complaint and, as I indicated when we spoke, I will discuss this complaint with [redacted] as soon as possible. He is generally in late in the afternoon.  I will bring to his attention the new issues which you raised during our telephone call.
