We hired Elcar to work on our crawl space. However, after we removed the plywood that was installed we realized there were items that were not met contractually.

1. New plastic was not installed in all areas with exposed ground. Additionally the plastic was not stapled/staked into the ground and in some areas was held up by duct tape.

2. The insulation was not properly installed and when we opened up the plywood, the insulation in some areas were completely missing.

3. The ventilation window were not secured and falls out with the slightest touch.

I am responding to the mention complaint above. Elcar's General Contractor worked on various projects at *** house to include the remodeling of three bathrooms, the installation of a kitchen Island, the basement and installation of the whole house floor installation. Once we finished all of the projects that I just mentioned, she decided to have the crawl space work on as well. Per our contract, Elcar's General Contractor, LLC. was to relocate electrical wires, installed insulation in the corner areas, seal the crawl space ceiling with plywood which we did. Afterwards we placed a plastic on top of the top soil, we attached to the corners with metal wire bars approximately 3/16. Once the project was completed, they made the payment and we parted our ways. On December 24th, 2019, I got a call from *** to do a door installation at her house, we did the door installation and they were satisfied with the job. Unfortunately, on December 28th, 2019 *** called me to come and take a look at the door because she said it was not closing properly. When we got to her house on Monday, December 30th, 2019 one of my employee went to her house to check on the door, the door was working fine and she apologize for calling us. On January 9th, 2020 *** sent me a text asking if we had seal the hole in the crawl space with pressure treated wood, she stated in the message that "it seems that a raccoon is living in our crawl space". I responded to her and told her that we had install the pressure treated wood.On January 11th, she wrote again letting me know that she was at the house and wanted to know when I was going to stop by. Unfortunately that day I was not able to go to her house. During a phone call with ***, we had agreed that I was going to be at her house on Sunday to remove one piece of plywood to check if the raccoon was actually there and to check how did the raccoon got access to the inside of the crawl space.
On Sunday I had an emergency and could not make it to her house and ask her by text once again if I could be there on Monday instead around the same time 12:00 and she replied that it was ok. But on Sunday in the afternoon, her husband called me very upset using profanity and telling me that I had done a *** job and that I was not man enough to accept that a *** job was done and sent me pictures of the crawl space, those pictures showed that they had gone to the crawl space and removed the plywood. I texted them and told them that the crawl space area did not look anything how we had left it. He told me by text that he had removed all the plywood in one side of the crawl space and started complaining that the insulation had fallen off and it did not look that it was properly place, if there was a raccoon in that space, the raccoon could have disturbed the insulation out place. The rest of the items that they are complaining about (the plastic and the nails left on the top soil and that the plastic was not properly sealed or attached) when the project was complete they checked and did not see the any issues with the job.
Elcar's General Contractor,LLC. guarantees the job and we had agree to come back and fix whatever need it to be fix. unfortunately they took it upon themselves to disturbed the work area and wanted us to come back and redo the job all over again. Once he disturbed the area the guarantee is gone. --

I am rejecting this response because:

Elcar initially described himself as a contractor who was focused on the details and that he would be present throughout the duration of the work. However this was not the case as he showed through his action of either missing items or not being present at the job site as he said he would. Listed below are all the items besides the crawl space that needed rework from Elcar. This shows that he's not consistent with the level of detail he promised us when we decided to hire him to work on our house or what we consider workman like standard stated in our contract.1. HVAC duct that he didn't connect and left hanging in the boiler room.2. Crawl space vent that wasn't properly installed which you could pop out with a push of a finger.3. Foundation vent well that wasn't properly installed which you could pull out with bare hands.4. Recess lights that weren't installed correctly which caused it to start loosening from the ceiling.5. Stair banisters that wasn't installed correctly which caused several to fall which I had to reinstall correctly.6. Wall painting that was spotty and needed rework.7. Home Moulding that were missing and even now is missing in the downstairs bathroom.8. Bathroom sink flange that were missing in all of the bathrooms that required rework.9. Post construction cleanup loose nails were in the yard and the driveway.When Elcar worked on the crawl space, we requested from him to take videos and pictures as evidence of the work that was done prior to installing the plywood walls which he he failed to do. Also when we first suspected a raccoon in the crawl space we called an exterminator to survey the area and that very same exterminator recommended that we call the contractor back to fix the area as he found items that were not properly secure such as the crawl space vent.That's when I decided to inspect the area myself and found the work he did unsatisfactory. After the my inspection, I called him and did tell him he did a *** job. On that very same call Elcar admitted to the fact that he's made mistakes by saying that he's a man and he'll make mistakes. I'm just holding him to his word. He also stated on the call that he would come survey the work but after he had his feelings hurt, he decided that he wasn't going to show up at the house and gave us the runaround on why he wouldn't be coming. That's when he decided that he was going to play the blame game and decided that he wasn't going to own up to his mistakes.My inspection included taking down some of the plywood walls which revealed the following: 1. The vaporware that Elcar installed did not encompass the entire area of the crawl space and some areas were exposed ground.2. Nails and screws were littering the ground area where there was work done.3. Vaporware was not properly secure and instead were held down by either concrete pieces or duct tape. 4. The insulation was not completely installed as promised on the contract and some areas were left without insulation.5. The insulation wasn't properly secured and was left on the ground.I'm just holding Elcar accountable to the work he said he would do according to the contract. Instead, he's pushing the responsibility on us by saying that I disturb the area but all I did was take off the plywood to expose the subpar work that he did to the house. At the end of the day Elcar is failing to hold himself unaccountable for the work that he's done.
