The business was claiming that  Ms. [redacted] roof is under warranty.  There was one leak that was only caused by a heavy rain/wind combination which led to water coming in from the ridge vent.  Although not under warranty, my company provided Ms. [redacted] with a qualified roofer to investigate and assist with the repair.  This was at her expense because the problem was not covered by her warranty.   There was minor drywall damage as a result of the above unwarranted roof leak.  My company offered to fix this damage as a courtesy.  Ms. [redacted] refused our assistance.  The business is also saying that the $8500.00 that she is requesting for lawn repair is ridiculous, it should be appx $200.  He stated that after all roof repair was done, her lawn would be repaired.

This email is written in response to Ms. [redacted] above complaint.1. Collapsed 7 INCHES of lawn.  Ms. [redacted] home is within a neighborhood of very narrow home sites.  It is inevitable that when the neighboring properties are built upon, there may be some impact on adjacent home...

contracted with Eldan Homes to construct his home.  You'll see that the builder accepts no responsibility for water that may pond on the property outside of 10' from the house foundation.  I've personally inspected Mr. [redacted] concerns and have noted that the ponding of water is occurring more than 10' from his foundation.  It should also be noted that Mr. [redacted] backyard is encumbered by a steep hill.  The ponding is occurring at the base of the hill, but away from his house.Despite the fact that Mr. [redacted] claim falls outside of his warranty, we have some site work to perform on the property next door.  During that time (as weather permits), we will attempt some minor grading and earth placement operations to attempt to satisfy his concerns.  This effort is being made as a matter of courtesy and in no way will it expand my legal warranty obligations.  Further, if the earth work fails to remedy this situation, I have no intention of making further efforts to correct something that is not warrantied.As far as I know, Mr. [redacted] has never submitted a warranty claim in writing regarding windows that leak at his house.  I would direct him to contact the window manufacturer to determine if they are warrantied by the manufacturer against leaks.I was not aware that Mr. [redacted] was recording any conversations I had with him regarding warranty concerns.  I am turning this matter over to my corporate attorney to investigate any claims I may have against Mr. [redacted] for his actions.I would welcome the Revdex.com to contact me at 315-622-5150 ext. 11 if this email fails to resolve this matter as far as the agency is concerned.Sincerely,Dan B[redacted]

 the business is telling a lie.  His own project manager said the ridge vent was install improperly and they would fix it.  Then they put a hole in my ceiling and put tape on it and have not come back. The consumer is claiming she did not refuse repairs, she was just saying that the ridge vent needed to be repaired before the drywall damage could be done. As far as them waiting on fixing my lawn.  Why should I have to wait until they are done with my neighbors project before then complete my lawn.  They were the ones that messed it up and was on it without permission
