I sent the notice that I gave them and the response that I received in return

MrL*** came in to give his notice to vacate on 7/14/2017. His lease ends on 9/9/2017. He was informed at that time that our lease contract requires at least a day written notice. In Paragraph of the lease agreement which is a standard National Apartment Association
lease it states, "This lease contract will automatically renew month to month unless either party gives at least days written notice of termination or intent to move-out". Again, when renewal offers are sent a reminder is given that a day written notice is required. At that time my leasing consultant explained that he would owe a small prorated amount for a notice fee. I have spoken with MrL*** to explain that we are required by law under the Federal Fair Housing Guidelines to set policy and required to implement those policies equally and fairly for all our residents. This is not based on personal opinions of individuals, their payment history or negative reviews. MrL*** states that he made a mistake, as we all do. I do not make our policies but I follow our legal contract with all residents. The cost of the insufficient notice is $95.73. I hope MrL*** will reconsider his negative reviews and his opinion of Howell Commons. We will continue to follow our contract fairly and with integrity so that all our residents know what is required and can be assured that all are treated equally. Thank you so much. Howell Commons is deeply sorry for the lack of understanding in regards to MsH***'s lease responsibilities. To respond to her complaint regarding our rent pricing verses utilities I would ask that she provide any advertising that lists any utilities that are included in our rental
price. This is covered during the leasing process as well as listed on the Welcome Sheet provided at the time of leasing. It also is plainly spelled out on page of our lease agreement. Paragraph of the lease shows all options of utilities that the property will pay. No utilities are checked. Again, our company has a separate Utility Addendum which specifically lists the monthly charges for Cable, Water/sewer, Trash, and Pest Control. Cable is a bulk contract with the cable company so choosing to pay or not pay for cable at our property is not an option.MsH*** had called asking about what she needed to do if she wanted to move out. She was sent a Notice to vacate form which she filled out and sent back on 12/1/17. MsH*** listed the vacate date as 6/28/which is the lease end date for MsH***'s lease. Another member of our office staff received the email and inputted the information as sent with the move out date of 6/28/18. The office received a call from MsH*** asking for additional days so she could have time to remove her washer and dryer. It was at that time that both Howell Commons and MsH*** realized that the wrong move out date was put on the form. I completely understood that mistakes do happen. I agreed to try and get approval to only charge for days for a notice fee instead of the required 60-day notice. MsH*** asked to speak with me because she was not satisfied with that response.As I began explaining to MsH*** that the required 60-day notice is essential in allowing Howell Commons to market the apartment. By her giving us the wrong move out date we had not been given any time to try to re-lease the apartment. I was willing to charge 1/of the 60-day notice. I also asked when she was going to pay the Termination Fee which is due prior to move out when someone breaks the lease contract. She said she had tried to pay it all at once but was told to wait. I asked again and it became evident that MsH*** did not understand the difference between rent, written 60-day notice and a lease termination fee. I tried again to explain what she had paid to date had only been rent. At this time due to the wrong move out date we received NO notice to provide time to market the apartment AND she has not paid the termination fee to break the contract. Written 60-day notice is also part of the 1st page of the lease agreement, Paragraph 3. Early termination is spelled out in the Lease Contract Buy-out Agreement requiring a termination fee equal to Two (2) month's rent.Howell Commons has now completed the final walk of the apartment and the following balance is due:Cleaning and damages: $224.00Early Termination Fee: $1346.0030-day Notice Fee: $673.00Final Water/Sewer 12/1-27: $52.60Prorated Rent 2/- 2/7: $168.25Prorated Utilities 2/1-2/7: $14.50Late Fee: $134.60Total Charges: $2612.87Security Deposit: $125.00Balance Due: $2487.87Balance is due within days to avoid being sent to collections. A day payment plan is available. Please call the office for details.As a representative of Howell Commons I regret the unfortunate mistake of giving the wrong move out date but understand that we can only go by what we receive in writing. If we had been provided the correct move out date of 2/1/and a proper days was allowed for us to market the apartment as available after 2/1/the balance owed would still be $1814.87. I hope this break-down makes more sense as it can be confusing between rent, notice fees and termination fees. Please feel free to contact the office if you have any questions.
