Review: Attorney [redacted] established a trust for us including a pour over will, living will,etc at a cost of $1600. Attorney [redacted] said we could make any changes on our decisions and there would be no charge for 6 months. Everything was prepared and sent to us for our approval. There were some address mistakes on some of the deeds and misspelling of my wife's name ([redacted])that were corrected at no cost to us. Recently my wife and I had reason to refer to one of the deeds and learned it contained an error in the degrees of measurement. A representative from the office told us Attorney [redacted] indicated one cannot transfer property one does not own. This is exactly what he has done with our deed due to this mistake in measurement. His suggestion to us was to let it go until the time we decide to sell the property. We do not intend to sell, and we paid to have our deed to read correctly and legally. I spoke to a nice lady at ELM who said she could handle our problem and speak to Attorney [redacted]. She informed us he would change the error, but we would have to pay to rerecord it for $150. After my 3rd unsuccessful attempt to speak with Attorney [redacted],I left a message that I would attend his next workshop and inform future clients of this new information I now knew. Namely, I have to pay for his mistake.He then called me and said this was my fault & that we should have caught the mistake.I told him I should not have to proofread deeds that were to just be copied and recorded.The recorders office said it is not their responsibility to proofread deeds. The attorney needs to make the changes, we cant.In my last conversation with Attorney [redacted], I was told he would make the corrections and refile at his cost. A phone call from a lady told us we would receive the deed in 3-4 days, to have it notorized and returned to her. We agreed. Three weeks later, we have not received the deed or return calls from ELM. This is unprofessional at the very least.Desired Settlement: We want the services we paid for. Nothing more, nothing less. We want the corrections made to our deed that was to be copied correctly the first time, and to have it rerecorded in the recorder's office at no additional cost to us. The typographical error was not our fault, and not some change in the trust that we decided upon later. It was not done correctly in the first place.
