June 20, 2014Gentleman, At the time of the signing of the contract dated April 15, 2014 **. & [redacted]. [redacted] were sold three replacement windows to replace windows with new frames to be installed due to existing windows being metal and capping to be installed on the outside frames – which...

was done. It is a standard procedure to put frames in when removing metal windows.No such advantage was taken of the above mentioned customers and we in no way gouge any customers nor do we take advantage of them.Enclosed is a copy of a signed completion certificate of satisfaction for work performed.We maintain that we have an excellent reputation since we have been in business since 1992.Respectfully yours, Armen K

July 10, 2014Gentleman, In response to the latest message please be advised that everything was properly completed and acknowledged as per a completion slip signed by the [redacted] family.Also be advised that the installation procedure is the correct way to install window that are to replace steel metal windows.We do not and I “emphatically state” take advantage of persons/people with disabilities.We have a very good record which I trust speaks for itself.Respectfully yours

I am rejecting this response because: Please all of pictures of damaged rear window seals, and total disregard for a customer's complaints and concerns thus far to date. requesting that independent contractor inspect all that has occurred.

I am rejecting this response because: We find this response emphatically irrehirable and very poor customer service
at Best.  We after further review of the work performed at [redacted], we feel whole heartedly believe that the work was subpar at best. With the initial measurements that were taken on April 15, 2014 by Mr. K[redacted] ensure us that the replacement windows would indeed mirror the accessing windows in width, height and length that were being removed from the Second Floor Rear Bedroom. My current status is that I’m totally disable and I’m a person living with disabilities (ADA) and unable to work. Therefore, I received a fixed household disability income. 
Let the record show that there are Current Standing
Federal Laws – for Americans with Disabilities that "prohibit companies" from
taking advantage of persons/people with Disabilities. (Americans with Disabilities
Act). Hopefully,
the factors of me being a Person Living with Disabilities ADA, and my demographics
location and my ethnicity affiliation did not play a role in the lack of services
that were performed. We now are considering these
services to be "Serves NOT RENDERED".
Let the record show that Check Number [redacted] was
written on April 15, 2014 for $700 dollar as a retainer fee for the initial work
process. The balance of $1286.00 was paid on May 29, 2014 as the remaining
balance to date. This information was noted and recorded on (2) of ELEGANT
GALLERY. Inc. Invoices Totaling $1986.00. By showing us a copy of OUR OWN RECEIPT, only proofs one thing, that I'm truly A MAN of WORD AND PAY MY DEBTS.
Let the record show that one of Mr. K[redacted] Chief Contractors informed me that if we order more replacement windows that there
would be no need to have these windows reframe and it would cost us $125.00
less each window unit.  
Please, See ALL of The Attached Photos #1 To #9. The List in detail the issues and concerns that detail subpar work in different forms.   
I personally have over 34 years of Inspections, Testing, Troubleshooting, Quality Control and Assurance with (2) Two of The Top Companies Country the Being ([redacted] and ([redacted].   
I am very Sadden and Disappointed with Elegant Windows & Doors for taken a negative approach in attacking my wife and I. Me being a Person With Disabilities, we have to save these monies (Disability Income as I Recall and Remember) over a period of time. Those monies that you Out Right Took from us, Was Indeed Very Shameful and With Any Regards To The Less Fortunate.

Review: Whom this concern, after further review of the work performed at [redacted], we feel whole heartedly believe that the work was subpar at best. With the initial measurements that were taken on April 15, 2014 by Mr. K[redacted] who ensure us that the replacement windows would indeed mirror the exiting windows in width and height and length that were being removed from the Second Floor Rear Bedroom.

My current status is that I’m totally disable and I’m a person living with disabilities (ADA) and unable to work. Therefore, I received a fixed household disability income.

Let the record show that there are current standing Federal Laws – for Americans with Disabilities that prohibit companies from taking advantage of persons with Disabilities. (Americans with Disabilities Act).

Hopefully, the factors of me being a person living with Disabilities ADA did not play a role in the lack of services that were performed in our home. We now consider the services performed to be, SERVES NOT RENDERED AND PREDATORS IN THIER WORK ETHICS AND JOB PREFORMANCES.

Let the record show that Check Number [redacted] was written on April 15, 2014 for $700 dollar as a retainer fee for the initial work process. The balance of $1286.00 was paid on May 29, 2014 as the remaining balance to date. This information was noted and recorded on (2) of ELEGANT GALLERY. Inc. Invoices Totaling $1986.00 After inquiring, we became victims of PRICE GOUGING.................

Also, we were informed that under Item #3 of their contract “That states “Gust out and replace frames, we were informed my their master carpenter/head contractor that we didn't need frames installation in our windows”. **. K[redacted] became very irate at this comment and he challenge me on comment and wanted to know who stated this. I therefore inform him that his carpenter/head contractor had made is remark. I found his comment and actions to be very indignant and condescending to me and wife. I waned to point out that my wife is my care giver.

After, all installations were completed same contractor informed me that if we were to order more replacement windows from them, that there would be no need to have these windows reframe and it would cost us $125.00 less each window unit. All of the (3) three windows that were installed had their heights shorted from the factory and the carpenter/head contractors built over sides frames to cover up the lack of incorrect measurements. That thought that the contractors comments, were a little odd and off base. In hindsight, my wife works and was working during the period of installation. In additional to these installations, the outside Capping Frames are not flush to their seals and the sealants are uneven to surface to their outside frames.

Because of disabilities, I am unable to walk up and down the flights of stairs in my house, for only very short periods of time. Because of my glaucoma and cataracts in both eyes that interferes with sight I'm challenge. when I was called up stairs to look at the installed windows, I was unable to detect windows dimensions. My wife has no issues, inspecting and seeing anything so she pick up the over sizes frames and shorter frames.

toDesired Settlement: Redemption on my families behind, and on the behind of THE ADA.
