Elevation Custom Food Trucks, Elevation Tires & Accessories

On 01/22/2020 I contacted Christopher *** from a *** Posting about building a food truck.

On 02/20/2020 I flew to Denver to meet with Christopher *** about building a Food Truck and received a Quote for the build.

On 02/07/2020 Christopher *** said that he had a dealer’s license and that he had purchased 3 trucks from and Auto Auction and was going after them.

On 02/10/2020 Elevation Custom Food Trucks, Elevation Tires & Accessories, LLC, and Christopher ***, ***, *** agreed to custom build, sell and deliver a completed food truck.

I was given a final quote to build the truck and we signed a Promissory Note \ Contract stating that I would pay a deposit of $25,000 down for him to build truck, another $10,000 when the truck was finished\delivered and the remaining balance of the truck in payments of about $2,000 over a period of 10 months. Our agreement was that he would provide me the Title to the truck within 30 days so that I could start the paperwork in South Dakota to get it licensed for food service.

On 02/12/2020 I made payments in the amount of $25,000 which included a wire transfer of $18,000.00, a credit card payment of $7000.00.

On 03/09/2020 Christopher *** promised to finish the truck in 2 weeks by 04/01/2020.

On 03/24/2020 Christopher *** stated that the build had stopped due to the shop being closed due to the virus and stated that he was having issues finding windows for the truck and wouldn’t be able to get them for months.

On 04/02/2020 I informed Christopher *** that I found windows that were manufactured in the USA by ***. He stated that he didn’t buy from that guy because of previous dealings. But after discussing the issue I told him that I was going to purchase so that he could finish the build. He came back and asked me to order 4 units and that he would take the amount off what I owed him when the truck was finish. They only had 3 units in stock, so I ended up ordering 3 units in the amount of $3662.00. They were delivered to his shop on 04/07/2020.

On 04/07/2020 Christopher *** informed me that the truck would now be completed by 05/01/2020.

On 04/11/2020 after giving me excuses about the Title for the truck, Christopher *** said that he had received the title. On 04/16/2020 I finally received the title for the truck. The title was signed by the original owner, wasn’t transferred by a legal Dealer and I believe Christopher *** is just an Unlicensed Dealer and/or Salespeople - "Curbstoners" for vehicles.

On 04/24/2020 Christopher *** informed me that he couldn’t afford to finish the truck build as we agreed and wanted me to give him another $10,000 cash payment up front.

On 04/30/2020 I sent request to Christopher *** that since he couldn't afford to finish build-out then we should scale back to what he had completed to date and provide an invoice as to the current state of the build-out. After talking for a short time he told me to *** off and hung up. Tried to call back and he wouldn't take call.

On 05/01/2020 I informed Christopher *** that if he didn’t call me back, I would be contacting the Authorities. He then contacted me and stated that he would now have the truck would now be finished by 06/01/2020 and that he would no longer honor our agreement and that I would need to pay the balance in full upon delivery.

On 05/02/2020 Christopher *** stated that he had someone to purchase the truck for $70,000.

On 05/05/2020 Christopher *** communicated that he was going to complete the truck and sell it to another party and then reimburse me the money I had already paid, Even though he had said that he didn’t have any money to finish the truck he stated that “The truck looks amazing all the equipment comes in tomorrow and I’m gonna put it all in the truck on Monday when all my workers here and then I’m gonna sell it and that will work out the money I owe you and this way you don’t take any losses.”

On 05/07/2020 Christopher *** stated that he couldn’t scale back the project because he wouldn’t make any money.

On 06/11/2020 I contacted Christopher *** and he stated that he has no money to finish and if I send him the money to finish and order 3 more windows for him he would get truck finished. That he won't sell Truck “as is” because he is loosing so much money. And stated that he has had it in Storage for 3 months even though he is sending me pictures of it being worked on as late as the end of April.

On 07/07/2020 I hired an attorney to aid in resolving this issue. My attorney sent a demand letter giving *** 3 options to resolve this matter, which included the following: 1. Requesting that he either return my money, 2. send an invoice for the balance due to deliver the truck “as is”, or 3. send an invoice to complete the build out of the truck according to the specs we had originally agreed upon.

On 07/08/2020 Christopher *** responded to the demand letter by a phone call to my attorney and agreed to send an invoice with the total cost to complete the build-out of the food truck by the following Monday 07/13/2020.

On 07/14/2020 My attorney contacted Christopher *** by telephone since he had not responded with the invoice as promised the week prior. During the conversation he refused to provide any type of invoice or deliver the truck or refund any of my money, concluding the conversation by stating several times “Tell him to take me to court.”
