Complaint: [redacted] PLEASE SEE ME RESPONSES BELOW IN PARENTHESES
I am rejecting this response because: 1.     Allegation regarding  quality  of services provided; [redacted] picked up his car after services were rendered and did not voice a single complaint about the quality of the work done on his car. I always ask my customers who have had body work on the car to inspect the work and tell me if there are any problems that we can help them resolve, I know [redacted] inspected the work, and he did not have a single complaint after inspection. (THIS ISN'T TRUE. I DID NOTICE THE COVER OF MY MIRROR WAS NOT SET RIGHT. [redacted] DID ADDRESS THIS ISSUE SO I ONLY BRING THIS UP TO KEEP THE STORY FACTUALLY CORRECT). I think [redacted] stated it perfectly in his complaint that the work was “up to par”. [redacted]’s suggestion that he did not complain because of the money he saved on the deductible is revisionist and mistaken. The money he saved was due to the efficient and reasonable prices [redacted]’s garage offered and not due to any bargain for substandard work or in exchange for a waiver of the quality of work. Surely [redacted] is not suggesting that he agreed that the work on his car would or could be compromised in exchange for saving money. (I CAN REASSURE [redacted] THAT THE COMPLAINT IS NOT WHOLLY BASED ON THE QUALITY OF WORK AND AT NO TIME DID I FEEL I SAVED MONEY BECAUSE THE WORK WAS SUBSTANDARD). His actions of driving away pleased after inspection of the car and accommodating me for payment of services is a more accurate reflection of the quality of the work. (THE ACCOMMODATION I MADE WAS NOT DUE TO ME BEING PLEASED BY THE WORK, TRUE AS IT MAY BE. I ACCOMMODATED BECAUSE IT IS A REFLECTION OF MY GOOD CHARACTER. HAD IT BEEN SOMEONE ELSE WHO WAS PLEASED WITH [redacted]'S WORK, THERE IS NO GUARANTEE THAT THEY WOULD ACCOMMODATE HIM SO QUICKLY. BEING PLEASED WITH THE WORK PROVIDED DOESN'T ALWAYS GUARANTEE THE CUSTOMER WILL DO WHAT IS NECESSARY TO ACCOMMODATE PAYMENT).2.     Extended length of Repair TimeAdmittedly, the repair for the time for the car was out of the normal repair times; however, [redacted] had his car repaired at a very unique time for body shops in the San Antonio Community. A severe hail storm had struck the San Antonio area causing damage to numerous autos in the community causing both auto body shops and car rental agencies to be stressed beyond normal circumstances. (This can easily be verified as car rentals were in short supply, body shops had extreme backups and car sale dealerships were and still offering sales for hail damaged autos) I communicated this to [redacted] on several occasions and told him my body shop and for that matter all body shops in San Antonio were severely burdened and delayed and that his job, if he went with our shop, would take a long time. He understood the uniqueness of the circumstances in our community and made his own decisions with full disclosure of the circumstances. AT NO TIME did I ever agree to pay for any overages in the matter of his rental car relating to the time of the repair. (THIS IS GROSSLY UNTRUE AND I WILL EXPOUND LATER). I know that car rentals during repairs are between his insurance company and the car rental company. I did explain to [redacted] that it was customary for the insurance company to call the body shop for the status of the work (regarding quality and time of work completion) and then to communicate any specific issues or problems or concerns with the insured and they (the insured and insurance company) should communicate their own understanding of the status of any rental agreements that I am not a party to and to which I cannot get involved with contractually. I was called on behalf of [redacted] prior to services being complete and informed them of the unique circumstances facing my body shop and body shops all over San Antonio, that demand was high and jobs were taking longer than usual, I gave [redacted]’s agents complete disclosure of the status of repairs. I have no control over contractual limitations between the insurance company and Rental Company nor did I make any promises to [redacted] except to honor the estimate for the costs of service which saved him considerable money.(IF [redacted] WANTS TO ACCUSE ME OF FABRICATING A TISSUE OF LIES THEN THAT IS A CHOICE MADE CONSCIENTIOUSLY AND IT IS APPARENT TO ME THAT HE HAS MADE PEACE WITH HIS DECISION. IN ANY CASE, I SEE NO REASON TO GO TO SUCH LENGTHS TO FIGHT FOR A FALLACY.  AS I MENTIONED, I ASSUMED NO NEED TO GET [redacted]'S PROMISE TO PAY OVERRAGES IN WRITING. IF HE DESIRES TO IGNORE THE TRUTH IN HIS WORDS AND IN THE PHONE CONVERSATION WE HAD REGARDING PAYMENT THEN, AGAIN, THAT IS ON HIS CONSCIENCE. I WOULD LIKE TO RECALL THAT [redacted] WAS THE ONE WHO ADVISED I SEND AN EMAIL TO HIM REGARDING REPAYMENT. AS I I MENTIONED, I NEVER RECEIVED A RESPONSE. IN ADDITION I WOULD LIKE TO RECALL A CONVERSATION WE HAD THAT STATED I WAS APPLYING FOR AN EXTENSION OF COVERAGE SO [redacted] DIDN'T HAVE TO COVER MORE THAN HE HAD TO AGREED TO PAY. MY INSURANCE COMPANY ONLY ALLOWED ABOUT 18 DAYS FOR REASONABLE REPAIR TIME SO I PLEAD FOR THE FULL COVERAGE PROMISED IN MY POLICY. THE AGREEMENTS FROM [redacted] WERE ALL VERBAL SO UNFORTUNATELY, I DON'T HAVE ANYTHING TO SUBSTANTIATE MY CLAIM.3.     Steps taken to pay for services created duty by [redacted]’s regarding car rental[redacted] seems to indicate in his complaint that the steps he took to pay off his bill for services created some sort of obligation by [redacted]’s to challenge the charge from the rental company. Admittedly [redacted] did what was necessary to secure payment for the body work in dealing with a check made payable to the insured and the body shop that required two endorsements. I do not believe this created an obligation on the part of [redacted]’s of any kind. [redacted] called after time elapsed (as he says fast forward in time) to indicate the rental company charged him for the car rental beyond the time agreed to with his insured and I expressed my shared disappointment with his insurance company and Rental Company but I did not make any promise to interfere with a contractual relationship.  Admittedly I advised him he could challenge the charge and that he could begin discussions with the contracted parties the insurance company and rental agency and that if contacted, I ONCE AGAIN would give complete truthful disclosure of the circumstances with [redacted]’s repairs.I understand [redacted] is frustrated with his insurance company and the rental company for not keeping him properly informed, but I do not believe his frustration with them after considerable time had elapsed should lead to [redacted]s being the scapegoat for their inability to effectively communicate the terms of the insurance coverage for the rental car.(MY FRUSTRATIONS ARE DEEPLY MISUNDERSTOOD. I WAS FULLY AWARE THAT OVERAGES WERE GOING TO BE INCURRED, WAY BEFORE THE WORK WAS COMPLETED, GIVEN THE TIME IT TOOK FOR THE REPAIR. I DIDN'T HAVE TO RELY ON MY INSURANCE COMPANY AND/OR THE RENTAL AGENCY FOR ME TO UNDERSTAND THAT. I'M SURE IT IS SAFE TO SAY THAT GIVEN [redacted]'S TENURE IN HIS BUSINESS, HE IS FULLY AWARE OF WHAT COSTS ARE TO BE ASSUMED AS WELL. [redacted] IS UNDER THE ASSUMPTION THAT I AM CREATING AN OBLIGATION BUT THAT IS NOT TRUE. IT IS AN EXPECTATION, NOT AN OBLIGATION. THE EXPECTATION CAME FROM THE HONOR AND ESTEEM THAT I ONCE HELD FOR [redacted] AND HIS BUSINESS. I DESCRIBED [redacted] AS A MAN OF HIS WORD. I WHOLEHEARTEDLY BELIEVED THAT UNTIL RECENTLY)(IT IS BECOMING INCREASINGLY CLEAR THAT [redacted] IS GOING TO CONTINUE TO DENY THAT HE HAD AGREED TO PAY FOR ANY COSTS THAT EXCEEDED THE COVERAGE PROVIDED BY MY INSURANCE COMPANY TO THE RENTAL AGENCY. IN HIS RESPONSES HE CLAIMS THAT WE NEVER SPOKE ABOUT HIS PROMISE TO PAY UNTIL AFTER THE WORK WAS COMPLETED, WHICH IS NOT TRUE. IF [redacted] HAS ESTABLISHED HIS POSITION REGARDING MY CLAIM THEN I SEE NO FURTHER NEED TO PURSUE MY CASE).
