I would like to respond to this complaint The customer claims he was unaware that the processing fee was non refundable, but it was in plain English in the contract he signed up front agreeing to the terms before we started working together We worked very hard on this deal, and we are sorry it didn't end up like the customer wanted with the terms we were able to get him We are in the toughest lending market in history, and we were dealing with tough credit, and very very tough financials on this one If he would have just contacted us to discuss any problem he had, we are very reasonable and fair people over here We would have been happy to issue him a full refund It appears he did call in time while Chris was out of town for the holidays, and then decided to file a complaint We had made dozens of calls to this customer over weeks of time, and feel he could have called again before jumping online to smear us, if he had an issue he would like to discuss Since he has already gone behind our backs and filed a complaint deciding to smear us, we are going to stick to the contract that he signed, and the processing fee will be non refundable Again, if he would have just called in to talk to us and given us the opportunity to work with him, we would have happily send him a full refund if he was unhappy

I am rejecting this response because: As I stated in my complaint I did call Chris B***, and he never returned my call after I received the refund less the $I shouldn't have to call them againI also left a clear message that If I didn't hear back from anyone promptly that I would file a complaintNo one went behind their backs? These folks really should be put out of business You cannot render a service to someone and charge them $for nothingIf you read just one of the previous complaints from their past complaints this company said the same thing about another complainant who they also said went behind their backs and they also advised that since the complainant did this that they would not work with that client and would stick to their contractThis is very ironic that they would say the same exact thing about my agency and also write the response back in a rude manner All of their responses are rather rude and not written with good a tactful response, it's very defensive I specifically asked the rep Chris B*** that I talked with if I would get my full deposit back before I signed itNo one has gone behind their backs, I already had very very serious reservations before I sent them any money because of past complaints and most money up front loans are scamsI even talked with a Revdex.com rep at the Salt Lake City office before I decided to send them anything In my last conversation with Austin C*** we discussed the reimbursement and he never said anything about it being in a contract and that it was not refundable, he stated' "the underwriting department has put a lot of work into this", which suggested that they may keep some of my funds but he never once said anything about them keeping a processing fee I told him at the time that I better get a full refund or elseAlso again, the verbage in the contract says, "You agree that the processing fee is nonrefundable and will be utilized to by us to cover any and all underwriting expenses in processing your (LEASE)', this is not a lease it's a loanWe are not dealing with property or an asset or land, it's a financial loanThe contract also states on the agreement under paragraph Advance payments are refundable if Elite Business Finance LLC cannot secure final approval of this transactionTheir website even talks about equipment leasingThis is taken straight from their website, Sale Lease Back Programs If you have recently paid cash for equipment you may be able to convert your purchase into a leaseThis is called a Sale Lease BackIf you have paid for the equipment within the last thirty days, your investment can be returned in exchange for monthly payments(Certain credit guidelines must be met and certain documentation such as invoices and proof of payment must be provided.) This info has nothing to do with a working capital loan and this contract agreement is misleading and not clearWhy would they mention a lease regarding the non refundable processing fee for a working capital loan? If you read the agreement and you see the portion that reads in the paragraph Payments 3. advance payments are refundable if Elite Business Finance LLC cannot secure final approval on this transaction. and then you go over to section Taxes and Fees the processing fee is not refundable and will be utilized by us to cover any and all underwriting expenses in processing your LEASE , whether or not the transaction closes It appears that it would be easy to determine that the processing fee if non -refundable regarding a lease, doesn't say anything about a working capital loanThis is ambiguous language I also again state that neither rep that I talked with said the processing fee was non refundableThere is also a number within their info on the Revdex.com website that ask you to call or email Jason C*** at ***@elitebfinance.com or *** ***I also called this number and punched in the extension and it was not a voicemail for Jason C*** but for a different personClearly, their contract is ambiguous What documentation or other evidence have they ever produced to justify charging clients a $processing fee regardless of whether the transaction clears or not? The only issue that will resolve this is if they reimburse the remaining $If they do not I will go behind their backs again and file a complaint with the attorney GeneralThis company has no positive reviews, not one

We have contacted Kevin and have already resolved his issue.  He did leave a voicemail for Chris, who was out of town at the time.  This seemed to be a lack of communication during the holidays, but has now been resolved.  We have already sent Kevin full refund, and he informed us that he tried to contact the Revdex.com to have the complaint removed.  The Revdex.com told him that they could not remove the complaint, but that it would be satisfied.
