[redacted], JR.ATTORNEY AT LAWDecember 14, 2017[redacted] 02723My Client:         [redacted] G. [redacted], d/b/a Elite Contracting Premises:       [redacted] 02723Dear Ms. [redacted]:Please be advised that I represent [redacted] G. [redacted] with reference to your email dated December 11, 2017. You entered into a contract with my client on February 8, 2017. Before the contract, you met with my client three times to review the terms, scope of work, materials and price schedules. You reviewed the contract for one week before signing. Before signing, you called my client and said you wanted to meet with him a fourth time to discuss the contract and the disbursements under the contract.He met with you again. You indicated that you did not want to "put too much money in the first floor" and wanted "cosmetic work only." Regarding the second floor, you wanted more substantial work performed therein as this was to be your future living quarters.The contract contained all these particulars, including material and labor costs. You were satisfied with the contract and signed it. My clients pulled all the necessary permits with the City of Fall River. You hired your own plumber and electrician to install a new heat system and a new electrical service for both units, after the contract with my client was signed. Your contractors made holes in all the walls and ceilings throughout the entire premises. The repair of this damage was not included in the contract before the holes were not there when you and my client entered into the contract. My client has all the pictures of this damage made by your contractors, as well as before and after work performed at the premises.Due to the electrical and plumbing upgrades, your plumber told you that the first-floor bathroom should to be gutted, which work was not included in the [redacted] 02720PHONE ([redacted] • FACSIMILE ([redacted] E-MAIL [redacted]contract with my client. The gut job of the first-floor bathroom made it easier for your plumber and your electrician to do their jobs. You entered into a written price adjustment with my client for this additional work. Also, my client performed additional structural work on (the first-floor joists, which were cut up from prior plumbers notching the joists which led to weakening of the first floor and second floor bathrooms. In the course of this work, my client sistered all thefloor joists on the first and second floor bathrooms with 2 by 8's and did not charge you for labor or material costs. My client performed additional framing work in the first-floor bathroom and second floor bathroom, including the walls and ceiling to allow a framing inspection to pass because the wood was structurally not safe as it was in poor condition mainly due to age and building practices of 100 years ago. Your plumber also explained to you that the wood needed to be replaced. All these upgrades were explained to you in detail and you authorized the work because it was in your best interests.The framing inspection passed after this work was performed. In fact, all framing, insulation and final inspections passed. The City of Fall River Inspectors saw the premises before work was performed and after work was performed. They confirmed that my client performed the work diligently and professionally.My client constructed a soffit for the kitchen cabinets on the second floor at no cost to you in materials and labor. He also installed doors in your dining room at no cost to you. My client had DBS come to the premises to design the secondfloor kitchen. Once the kitchen cabinets and design was agreed to, you called DBS to determine if my client paid DBS for the cabinets. My client indeed paid for the cabinets and was insulted that you suggested he would take your money and not pay DBS.Before the final inspection, you wanted several items addressed. You spoke with my client's wife and complained of doors not being painted, touch up needed on some walls and base molding needed to be added in the laundry room, when originally you did not want base molding in the laundry room. My client completed all items on your punch list without cost to you. My client asked you, in the presence of two employees, if you were satisfied with the job and you informed him that you were completely satisfied. You even asked for a price from my client to vinyl side or paint the exterior of the premises. Clearly, you would not request a price from him at the end of the job unless you were totally satisfied with his work on your home. You then made your final payment. The contract says the final payment will not be made unless you are completely satisfied. All final inspections by the City of Fall River were conducted and passed.Now, you sent an email months later expressing your dissatisfaction. Under no circumstances were you taken advantage of. You were not overcharged for work performed nor were you threatened. Your allegations are slanderous,without any basis in fact and represent a money grab. You purchased an old home that needed safety upgrades to protect you and to bring it up to code. The upgrades could not be anticipated until the walls, floors and ceilings were opened up. Without the upgrades, inspections would not have passed, and you would not have received an occupancy permit to reside there. The additional work made the building structurally sound.Please note that my client will not pay you any money. The owner assured me that he would be in charge of the entire project and coordinate all work with all the other contractors. This compnay is very unprofessional with horrible work ethics.. The contractor had unlicensed men working on the job, it was brought to my attention by another contractor, that his worker was drinking on the job. They were left unattended all day long. Many times I went to the property and they did not know what they were suppose to be doing or how to do it. I was notified by my plumbing contractor that his workers were putting the ceramic tile down on a floor that was rotted. I went to the property and found the workers alone with no owner/ contractor present. I asked them what they were doing and they said putting the floor down. I told them to stop and contacted the owner . He stated he would take care of it. He breached the contract and did not finish any of the work by the scheduled date. He stated that I was to pay him $5,000 weekly, because I am suppose to pay his payroll. When I went to him with complaints and stated that I would not be payning him $5,000 weekly, he threatened me with the fact that his wife is an Attorney and he would do this every time I brought any issues to his attention. The workmanship is extremely poor...I have studs coming through the walls...both apts need to be repainted as there are numerous missed spots . Many new interior doors were left unpainted. there is grout and trim missing in areas throughout the house. I contacted his wife and notified her that I was going to file a complaint with comsumer affairs and she pleaded with me not to file the complaint. She stated that she would send the workers back to make all the repairs, they did come back, I was present the entire time they were at the house and the owner of the company was constantly calling them telling them to hurry up and get out of there , because they had other work to do. At this point I was so disgusted as I had paid $47,500 dollars. This experience with this company has been my worse nightmare. I have many photos of the poor workmanship. I would like all repairs to be made, but not by this company. it is going to cost approximately 8,000 to do all repairs. I also had contacted his wife and asked if she could come to the property so I could show her all the issues, she stated she would , but never did. I would like all isssues repaired properly by another contracting company other than Elite Contracting, because their workmanship and ethics are extremely poor. I would accept his wife hiring another company to complete repairs as she was well aware of what was going on at the property.

Revdex.com:
I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted]
I reject the response due to the fact the contract was breached, work was to be completed by April 13th, 2017 and was not completed, which caused me a hardship financially because I had to pay a mortgage and rent also the workmanship was very poor...I had to move into my house with no kitchen sink or counters, because the contractor never co-ordinated any of the work with the other contractors...he was the lead person on the project and it was his duty to co-ordinate all aspects of the project so the work was completed on time. There were unforseen issues  which his was made aware of and even made an addintional work order/contract which I have attached for your viewing. I have many photos of the poor workmanship and the deplorable condition that my house was left in. I was only able to attach a couple of photos and the contract, but have many more that I can send. all the walls in both apts need to be repainted...there are spots everywhere that were missed..he never painted any of the brand new doors in the first floor apt...trimwork was left unfinished..instead of placing a new lock on the interior house door he puttied the old lock onto brand new trim work. I want all necessary repairs completed. Whenever I approached this contractor with any issues he  constantly threatened me that his wife was an attorney. I contacted his wife and explained that I was going to file a complaint against [redacted] and she pleaded with me not to file any compclaint. She stated that she would take care of everything and sent his workers back to the house...they could not complete any of the work properly, because [redacted] was constantly calling them and telling them to hurry up and get out of here because they had other work to do. He would bully me and say everything is good..it's good come on sign this. I felt very threatened by this man and wanted him out of my house and off the project, because whenever I went to him with any issues he would began to yell and remind me that his wife was an attorney. Regards,

Response to complaint[redacted] G [redacted] DBA Elite Contracting VS [redacted]we were called out to give miss [redacted] an estimate on her home. We went out on a few occasions and gave her a bid on the project. she then complained about the price and we then lowered the the bid and she then...

asked for a written contract. She had the contract for one week before signing it. The contract explained in details and there was no miss leading terms or conditions. This contract template is used from consumer affairs. once she signed the contract we pulled required permits on 1st and 2nd floor apartments. she only wanted cosmetic work done on the first floor except for complete bathroom remodel . The second floor had much more work performed . The entire apartment was redone , kitchen , bathroom , dinning room , laundry room, bedrooms. Her plumber and electrician she hired. They had put holes in all the walls and ceilings which we had to patch and repair for additional cost. we also build a soffit to accommodate her kitchen cabinets at no cost to her. we also plowed her driveway at no cost to her to have a dumpster delivered to perform work. we also  did a bunch of demo work and structural work in the bathrooms that we didnt charge her for the floors were giving away. Miss [redacted] had purchased an old home which needed an abundance of work performed and spent more money then anticipated. we have worked with her all along and have been threatened throughout the entire project. At the end of the job we asked if she was satisfied she said yes and made final payments. our contract contains a customer satisfaction clause requirement for last payment . we also went out on 4 additional occasions after the job was completed and did additional work to please her at no cost to her. The building inspector seen all phases of work and passed all inspections. we have documents and pictures and letters from our attorney regarding this matter . Miss [redacted] has made a fraudulent complaint against our business. we have never had any complaints with the Revdex.com . We are pursuing a law suit against miss [redacted] for defaming our business.

Review: Henry F[redacted] went into contract with me to do my roof for $5,500 on 10/30/2015. Roberto C[redacted] was one of the guys who worked on the roof. At the time, he and I and the other men spoke but didn't discuss the roofing or payment issues. The roof was paid in full on 10/31/2015. [redacted] Jr contacted me today on 11/10/15 wanting to know if I had any complaints against him in regards to the roofing work he and his workers did because Henry F[redacted] the owner of Elite Contracting cancelled his check of $870.00 paid for the roofing work. He came over to my house and I told him had no complaints. The trash from the job was taken away late that night which was Halloween. The next morning I notice that the gutters and a pallet was left on the side of the house as well as some asbestos from the roof was still in the yard. I contacted Henry about the trash and he said he would take care of it. No other complaints was given about the roofing work. [redacted] Jr. told me he called [redacted] that night to tell him he was coming back the next day; [redacted] said he told him he would be back in ten minutes which couldn't have been true because it was after 6 pm and the Dump where the trash goes was already closed and he didn't have any more room on his truck. It makes sense he said he would come back the next day but [redacted] didn't communicate that to me when I sent him my concerns about the remaining trash. In talking to [redacted], I found that the $5,500 he charged me was to take the old roofing off and replace it with the new roof but he put the new roof on top of the old roof. I asked him about this and he said it was a good thing to leave the old roof because it meant better insulation.Desired Settlement: According to the laborers working the job, the cost of the overlaying should have been $2220. I paid $5500. Therefore, the desired resolution to this matter would be to receive the difference of $3300. I would also like to the laborers to receive their just compensation in at least the amount of $870 as well as the fees from the back for the grocer who cashed the check and to give him a bad mark so that other consumers are notified before using his services. Just make sure [redacted] gets hi.

Review: Henry F[redacted] of Elite Contracting took on my job which consisted of closing off a door and further soundproofing a wall and a closet. Upon finishing, I paid him the balance owed (my mistake) on December 11. He left in a big hurry and I was already stressed out about other things so I was not thinking clearly. He did say that if I found anything wrong he would fix it. That night I noticed that there was a baseboard missing so I called him immediately and he came out the next morning and added it and painted it. He also painted the base board on the other side that was forgotten. I pointed out a slew of things that I was not happy with. He had only planned on installing the baseboard and painting it that day, which I understand, so he scheduled me for Wednesday (Dec 16th) the next week. I gave him a solid month to respond to my phone calls, messages, and texts. After being extremely responsive, he has not acknowledged my existence since I paid him. This is a list of things that he acknowledged were not done right and agreed to fix (some things are not fixable, but I am noting them here to show the level of "professionalism" that his subs bring):

Paint scraped off baseboards and door jamb;

Dent in wall where crowbar was used to remove base board;

Poor drywall taping job;

Horizontal seam between two drywall sheets in the middle of the wall improperly finished (didn't look as bad that night);

Many imperfections in the drywall (the 18 year old drywall looked newer than when they were done with the new drywall);

Hid an exposed piece of baseboard instead of painting it;

Lots of paint came off the top of the wall at the ceiling when they removed the tape;

Visible nail holes where trim was re-installed;

Wet paint rollers left in non-trash bags (bags ruined);

Trash left in the back of my truck;

Construction debris left in my recycle bin;

Used nice wash cloths from my linen closet to clean up (ruined);

Cigarette butts on driveway;

Drank my soda.Desired Settlement: At first, I wanted him to finish the job; however, I believe, at this point, I would be uncomfortable having him in my house. The original job cost $3,300. My request is for a refund of about $750 so that I can hire someone else to fix the job that Mr. Forrest has abandoned. Any help that the Revdex.com con provide is appreciated. Thanks.

Regards,

I had my roof repaired through my Home Warranty and they sent out a company called Elite Contracting. Elite came out and assed the situation I showed them the leaks and they wrote up and estimate. I proceeded with getting the work done and Elite Contracting came out a couple of weeks later to fix some cracks in the roof and also re-do the whole roof as I have a flat roof. Needless to say, two days later it rained and my roof is still leaking in the same spot. I contacted Elite Contracting immediately and they came out again to assess the situation and said maybe it was the gutters and checked those and it was not. They then said it was my back roof and that they would put down a 36" piece of black sticky stuff, that they use in box gutters, and that that should take care of the problem and would get back to me that evening with an estimate. After several attempts to contact Elite Contracting, two weeks later I get an estimate of $525. I begin to ask why it is so much money since I was told they would only be sticking down a 36" piece of black sticky stuff and did I misunderstand what they were planning to do and I haven't heard from them since which now has been over a week. I also contacted my home warranty to inform them of the situation. I would never recommend this company unless you want to waste your money and still have the same problem that you started with. Buyer beware!
