Ms [redacted] : I read your proposal to resolve As a counter-proposal, if you would agree to pay $directly to Elite Dance Academy, I will write (and notarize) a letter stating that this should not be reflected on your credit report My proposal is due to the fact that I believe you attempted to resolve the matter in 2012, after it went to collections, although I never received your letter As you stated, the certified letter was returned Had I received it, we could have made resolution to the matter and therefore, the collection agency may not have reported it to the credit bureaus In light of the fact it did go to collections, I cannot state it was in 'error' because as you've seen, you did sign the policies and agreed to the terms However, it being sent to collections had no effect on your credit UNTIL it was reported to the bureaus, which I'm sure is where your concern lies I hope to resolve this as soon as possible, as this is costing both of us unnecessary time and energy Thank you, [redacted] Elite Dance Academy

We had a our teacher have a family emergency and didn't show up for work the day I ask him to come in, the next classes/teacher was there for classes at 5:30pmIt it just so happened that he missed the next classThe amount in question was sitting on the desk waiting for pickupThe refund was pick up on May 2, in the amount of $dollarsWe apologize for any inconvenience this may have caused you

With the regard to the complaint received today via
email by the Revdex.com, I would like to respond to each point Per our policies, signed by each customer upon registration at Elite Dance Academy, a 30-day written notice is required to withdraw a student from classes, after receipt of which, the tuition ceases to accrue We have our policies posted in our studio, on our website, http://www.elitedanceacademyinc.com/usercontent/file/2013%20policies.pdf, and a copy of the policies is provided to each and every customer upon registration While we do have an optional contract available to customers for a seasonal discount, all our customers must adhere to the 30-day written notice policy because we are holding a spot for that student, which cannot be taken by another student until a proper withdrawal is received As to the specific complaint of "kicking out" the student for missing classes in August and September, this is false We do not terminate a child's participation in classes based on absences We understand children get sick, parents get sick, and a number of other reasons that may keep a student out of class for several weeks With our recital held in June, we do not concern ourselves with a few absences that early in the season In fact, our policy states, "Attendance: Attendance is very important for your child to learn and advance in dance techniquesDance is a commitment and, like anything
else, must be practiced regularly to progressPlease notify the office (prior to class) if your child will be outTuition is not pro-rated for
missed classesStudents missing more than classes between January and May may forfeit their participation in recital, without refundStu-
dents missing class causes the rest of the class to suffer by learning the same steps again the following weekINITIALS: ______."
As you can see in the policy, we only limit participation in the recital based on absences between January and May You stated the absences occurred in August and September Even then, we only recommend that the student attend private lessons to 'catch up' on anything missed, and only as needed It is not our intention to prevent any student from participating fully in any of our events, as we want each student to have the opportunity to perform and show their family and friends what they have learned I'm certain there was a misunderstanding by Ms*** It is possible that our staff suggested that if she felt she could not attend on a regular basis, that she had the option to withdraw However, we would never expel a student for absences If we ever expelled a student for any reason, it would be done in writing, and only for extreme behavior issues, or the like
While it is unfortunate, we do utilize collection agencies for outstanding debts This is also notated in our policies, which were signed It states: "Outstanding balances will be pursued through collection agencies and/or court
system for which additional fees and/or court costs will be my responsibility." Further, I did not receive a letter inquiring about the debt, which you state was returned I cannot speak to why it was returned If I had received an email or phone call requesting a copy of any of this information, I would have been happy to provide My email is accessed via our website, for convenience While this debt is from 2009, I have all account information and can provide information requested As to collections, the collection agency received a statement of the account when it was turned over to them They do provide proof of debt, as well
It is certainly never our intention at Elite Dance Academy to leave a customer unhappy Please understand it is with great effort that myself and my office staff work to communicate our policies effectively to prevent any misunderstanding I am more than happy to assist in finding a resolution to this matter Please let me know what information, other than what has been provided, you are requesting If you are willing to make a payment toward the debt, I will consider reducing the obligation, and work with the collections agency accordingly

*** *** did discuss his concern about our holiday scheduled just recentlyIn our conversation with *** *** we explained that these holiday's are outlined in the parent handbook that is given at registration and can be found on our website as wellWe explained that the holidays we observe are
offered a make up class
Our holiday schedule is based on both the Federal holiday calendar and the local school holiday calendar
We advised *** *** there were other types of classes that his child could do a make up in on Monday's but he didn't like that option
His child was enrolled in classes but dropped one class, but even after dropping one of the Monday classes *** *** still decided to keep her enrolled in the second Monday class
As a business we can structure our holiday closure as we see best meets are business structure and needsI can see *** *** being upset if the information was with held but it wasn't
I would also like to mention that the most studios in our area are in fact closed these same holidays so it is pretty standard in the industry
Currently *** *** has an outstanding tuition balance for the month of January for the class is child is currently enrolled in
I am not sure what more we can do for *** ***Maybe he should drop his child from our studio and look for studio that meets his needs
Lastly, we feel that this complaint is very much unwarranted and should not be a negative reflection on our business

Please note that tuition is averaged out for the month program we runWhich means when there are five weeks in a month, picture day and recital rehearsals no additional tuition is charged
This is also outlined in our parent handbookPlease refer back to first page of parent handbook it states "ALL HOLIDAY'S HAVE BEEN AVERGED INTO THE MONTH DANCE CALENDARCERTAIN HOLIDAYS THAT FALL ON MONDAY'S ARE ALLOWED A MAKE UP CLASS OR CLASSES;DANCERED ARE ENCOURAGED TO CHOOSE A SIMILAR CLASS TO ATTEND AS A MAKE UP CLASS."
When *** *** came into studio in December we offered him another copy of the handbook and he refused to take it
There has never been an issue with any other family about the Monday holiday calendarWe feel that we offer a reasonable solution
The drop notice *** *** gave for the Ballet class in December; will now also include the Jazz class his daughter was still currently enrolled inThis will waive the January tuition and late fee currently billed to the account
We think it is best that *** *** find another dance school for his daughter that is a better fitWe feel that we are just not the right fit for their family

I read your proposal to resolve.  As a counter-proposal, if you would agree to pay $200 directly to Elite Dance Academy, I will write (and notarize) a letter stating that this should not be reflected on your credit report.  My proposal is due to the fact that I believe you attempted to resolve the matter in 2012, after it went to collections, although I never received your letter.  As you stated, the certified letter was returned.  Had I received it, we could have made resolution to the matter and therefore, the collection agency may not have reported it to the credit bureaus.  In light of the fact it did go to collections, I cannot state it was in 'error' because as you've seen, you did sign the policies and agreed to the terms.  However, it being sent to collections had no effect on your credit UNTIL it was reported to the bureaus, which I'm sure is where your concern lies.  
 
I hope to resolve this as soon as possible, as this is costing both of us unnecessary time and energy.

I am rejecting this response because:They mention in a 10 month period time they take in consideration of there being several months with 5 Mondays in certain months. There are only 4 months in this "10 month calendar" that have 5 Mondays. My basic complaint is that I or others SHOULD NOT be charged for days of dance classes IF that establishment IS NOT open. Why should we as parents feel pressured to pay for something we're not receiving for our child or children? That's like walking into a store and still being charged for a product that they don't have. But they have something similar and still want to charge you for it whether you want it or not. Like I previously stated in my other statement , their so called "MAKE UP" classes DID NOT OR DO NOT fit with my schedule NOR are they a class that my daughter was interested in . And in regards to nobody else complaining. Most people are willing to accept what is given to them, even if it's unfair practice. I believe in standing up for what's right, especially under the laws of the constitution . I was sacrificing by accepting their unfair ways simply cause my daughter WANTED to be in dance. She lost interest in this studio. This is probably why nobody else has complained. Cause they're sacrificing for their kids too.What I did ask of them in November when I first brought this issue to their attention , was to simply be reimbursed , or credited towards the next month for the classes not given. The lady who I had spoken to seemed to have gotten a little upset and walked back into her office . Very unprofessional like. I didn't say anything else in the studio or speak loudly, simply to not draw attention to the issue.

I would love to have accepted the offer. However,  after speaking with the collection agency and being told they could not reach Mrs. [redacted] either, I just paid them on Friday, March 21, 2014. I decided I needed to just get it over with before life got me side tracked again. My husband also reminded me that Jesus says if someone wants to take your shirt, give him your coat as well. So, I went there to pay the full balance and they settled it for $700. I like the $200 offer better, but they have already removed it from my credit and it is over! I do feel this never should have gotten this far! I believe there is a lot of miscommunication somewhere,  nonetheless, it is over! I am not happy with the way it ended, but I know I did what was right!
