Good Afternoon,I have reviewed the complaint and can say this is the first we are hearing of this complaint. Any vehicles that are towed are sent to the property manager and the board for review. Any complaint regarding the towing of a vehicle is required to be sent to the property manager so that...

the board of directors can review the validity of the complaint and make a determination on whether the tow was in good faith or a wrongful tow. In the event of a wrongful tow, we the service provider would be contacted with a request for refund or explanation. None of the above was followed. The property rules for this community are specific as to resident vehicles may not be parked in the stalls, guests may not be parked in stalls for more than 5 days. Our company does not safelist the vehicles, all safelisting is requested through property management who would then forward to us. We are simply enforcing property rules and regulations that have been set in place by the Homeowners Association.  Thank you[redacted]

Review: In San Clemente, California, USA, we tend to think we are a unified single minded people with do good in our hearts. We take care of ourselves and our community. In the nine years I live at this residence, I have not encountered a more dedicated and professional service for Parking Security than Elite Enforcement. The staff is a standard, like a retired or inactive military service personnel. However, in June of last year, 2014ACE, our block garage fires totalled four garages. Mine was one of those four. Although my neighbor did not intend to cause such damage, it happened. We're going to have a April fools day BBQ to bring the neighborhood back together. Anyway, my cars were placed on SAFE LIST where I can park in the parking lot, and not be towed. I would hang up the phone, then see the security persons showing me a different story. The office sent me a copy of SAFE LIST where I can clearly see my cars are in good status. Then at home, I would find tickets warnings, and then finally my vehicles were towed. I felt intimidation, humiliation, and undue stress. While the in person security personal was determined to DO THE JOB, I was not informed as to the name of the supervisor that I asked for on several occassions. I work until midnight and was stunned to find my truck missing the next morning. As a result of impounding my truck alone, I had to take a cab because I needed to be at work at 06:00 AM the next day.Desired Settlement: 1. Clear all parking tickets warnings and appearance in paperwork that I am not complying with rules and regulations.

2. Disgard any notion that I have any problem with authoritive figures, even as parking security.

3. Reimburse the cost of cab fares $75.

4. Reimburse the cost of impound on the truck $285.

5. Reimburse the cost of time lost at work as I had no way to get there and could not afford another cab $200.

6. Reimburse the cost of excessive run around to find what I needed to handle a new emergency $200.

7. Reimburse the cost of lost sale on the car $500 lost.

8. Reimburse the cost of a parking permit $75.

9. Stop slandering mistreating and causing stress in my life. for example, My car is registered to me, and the Homeowners association was notified that my car is not registered to me therefore I mislead the company by SAFE LISTING my vehicles in the first place.

For example, making documentation appear misleading is a criminal act.

10. Stop notifying my landlord without me.

Review: Third Appeal and Request for Refund of $420.00 Following 8 Email communications dated (10/22/14, 11/20,11/25,12/10,12/29,12/30, 1/15/15, 1/27) [redacted] M. [redacted] (my son)[redacted] CommunityC/O Keystone Pacific Property Mgmt[redacted] I, [redacted], am a resident at [redacted], CA a condominium unit owned by my mother. We have been here since October 2013. Our condominium is part of the Hillcrest Community Association managed by Keystone Pacific. Keystone Pacific as the management company has hired Elite Enforcement Security Solutions to enforce parking rules at my community. I am writing this letter to ask for refund of $420.00 towing fee and make sure you know, it is becoming highly apparent that Elite Enforcement Security Solutions parking enforcement is a predatory activity for the benefit of the Elite and towing company and not security of residents/owners.For the 8th time in writing and more than I can count phone calls, here is my story again. We own two cars within permitted association rules to park on the premises. One of the two cars is parked in the garage majority of time. Elite Enforcement Security Solutions lack of organization, interest, professionalism and response has cost me $420.00 in towing fees from Mission Viejo Towing located in [redacted], a days pay, countless hours of time to and from Mission Viejo Towing, phone calls and emails to all parties involved. It all started on October 12, 2014 when I was issued the first parking ticket from Elite Enforcement Security Solutions. I immediately called the company up and spoke to one of their customer service representatives and explained to their receptionist, that I did indeed have a valid parking pass and that it was in the upper left hand side of the driver side front windshield. At the time she told me that I would not receive any more tickets. She explained there was some confusion as they were recently hired and she had checked their so-called No-Tow List and that both of the cars, make/model/year and license plate number were on said list. Then six days went by and I went to my car and saw another parking ticket, October 18, 2014. I called Elite Enforcement Security back once again and spoke to customer service for a second time and after they could not help me I asked to speak to the manager on duty, [redacted], who asked me to take photos of my parking permit, and email them to him, which I complied with, and sent to him. He assured me this would serve as a written record, of my valid permit. He told me that I would not be getting ticketed any more. Several calls were made and the same pictures of car windshield displaying the permit were emailed to Debbie Stinson of Keystone Pacific Property Management.Nevertheless, on November 21, 2014 my car was towed in the early hours of the morning; every day I wake up at 4:40am to get to my 6am shift, earning minimum wage at a gas station, I woke up to no car, and no way to get to work. I cannot afford to lose my job. Without time for an argument, I called my manager for some understanding and time off, found a ride to the tow lot to pick up my car, and I had to pay an extra open gate, fee because it was the weekend. In total, I paid $420.00 to get my car out of the lot. When the lot attendant, a female, took me back to the lot to get my car, she remarked, Oh! You have a permit, right there. She refused to let me take the car without paying for it, but assured me she would vouch for me having a valid permit, visible; later, she would claim that she never saw, or said anything of the sort. Since I knew that I had to protect myself, I have a recording of her confirming that the permit was visible, (the recorded confirmation can be provided to you at any point). I have tried to resolve this issue the right way by first going to Elite, elevated the complaint to Keystone and to Hillcrest board only to be told by Elite Enforcement, manager that, While your permit was valid and within sight, and you did check with me to make sure it was where it needed to be, and that both of your cars were on the No-Tow List, theres nothing I can do, because my driver is saying he didnt see a permit, and we have a photo that there was no permit. The photo Elite Enforcement is referring to be low-quality, black and white, with high contrast taken in the dark of night. Every single car, regardless of make or model, has the same standard front windows, and all front windows have a tint barrier around the rim; this tint rim is what obscures the visibility of the permit in the dark of night. But by even the blighted human eye, the permit was visible. Furthermore, I was assured I was on their List, which they fully claim is their main reference for cars permitted on the property. I paid all the fees I was asked, I called and emailed to make sure I was complying fully with both the HCA and KPPM and EE policies, and at every turn was fed new rules, on the spot regulations, and no assistance with the issue at hand: I have paid, and complied, even gone above and beyond to discuss the issue with management, and both the association its management company and Elite Enforcement have insisted that, there is still something I am not doing. The reason I am saying the parking enforcement has become predatory is because again, this morning, Tuesday February 10, 2015, at 0245 AM, a benevolent neighbor came banging on my door to say that our car was being towed! Again, both of my cars are within associations parking rules 2 cars per household and have been confirmed to be on this No-Tow list, surprisingly when the driver and his compatriot were confronted with these facts, they reluctantly let the Nissan off the tow truck and told me, If I see your car again, Its mine. At nearly 3am on a Tuesday, in my pajamas, we stood out there and asked them to check their No-TowDesired Settlement: I would like for the $420.00 to be refunded back to me in full please.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Regards,

I am not satisfied with this resolution to my complaint because I did contact Elit Enforcement Security Soultions right away when I got a parking sitation from them the for the first and second ticket and spoke to [redacted] G. [redacted] who is the Director of Bussines Managment for Elite Enforcment Security Soultions and sent him pictures of both of the tickets that I was issues by his company and also sent him a picture of my parking pass that was all ready taped to my front winshild on the drivers side up in the tinted part of my car. He told me that everything was all good and that I would not be getting any more tickets from them. He did not tell me to move the parking pass to a more visible location at all when I sent him the pictures he asked for via email. I also contacted them when my car was towed too and I have been in contact with them multiple times before I contacted the Better Bussines Bureau about this issue. My mother and sister also got involved too. My sister went with me to get my car out of the towing impound in Lake Forest called Mission Viejo Towing and also having the lady, whos name is [redacted], who was working at the front desk of the towing on the day that I got my car out of the impound lot on recording saying that she did see my parking ticker on my car under the intented part of my car and also saying that she avised me to move my ticker to a more visible location on my car so I would not get my car towed any more. My sister also was there with me when I called the securty company back the next bussines day to speak to [redacted] G. [redacted], who is the Director of Bussines Managment for Elite Enforcment Security Soultions. Now as for my mother who was also involved, she contacted the property managment company the next bussiness day on the phone and also through email also that I will be sending you as evidencents to show you that the property managment company was noticefied right away once I got my car out of the towing lot and the Security company was not willing to fix this issue on their own. I also will be sending you the voice recording of the [redacted] from Mission Viejo Towing and what she said and I will also be sending you the emails between me and [redacted] G. [redacted] from Elite Enforcment Security Solutions. All this evidence should prove that I am due back the money that they owe me, wich is $420.00 back from them for having my car towed.

Review: On Jan. 31, 2016, Elite Enforcement's Officer Fuller had my gray Honda CRV, license [redacted], towed from a Canyon Villas GUEST PARKING spot, which I had parked in at 6 p.m. the Saturday night before after returning with groceries from Trader Joe's. I am disabled and had my permanent, blue disabled placard hanging from the rear view mirror. I had used GUEST PARKING many times in the past since July 2014 because my garage is very narrow, and, due to my disability, I cannot get in and out of the car easily or without pain, injury, etc., especially with bags, because the garage is so small that I cannot open the car door more than 25%.

On Jan. 27 I had received a yellow notice that I had exceeded the allowable number of days a car can use GUEST PARKING per month. THAT WAS THE ONLY YELLOW NOTICE I EVER RECEIVED IN JANUARY. And, on that notice, the box warning me that my car would be towed HAD NOT BEEN CHECKED NOR HAD I BEEN WARNED TOWING WAS IMMINENT.

When I called Elite Enforcement on Jan. 31and spoke with Shelly, who is very nice, she explained that I "had been cited for parking in GUEST PARKING 7 times in January, including this morning." Yet, only ONE yellow notice had ever been left on my car in January before the towing, which cost me $320. (There was a 2nd yellow notice dated Jan. 31 soaking wet on the windshield when I arrived at Mission Viejo Towing this morning, and it also did not have the box warning about towing checked.)

Elite Enforcement did not leave yellow notices each of the seven times in January that their employee, Shelly, claims their officers cited me and took photographs. Otherwise, if yellow notices had been left each time, Elite Enforcement could provide me with copies of them; but they were not left on my windshield in violation of the company's required practices.

Additionally, when I did get the yellow notice on Jan. 27, my physician faxed Seabreeze Mgmt on Jan. 29 for a parking accomodation for me.Desired Settlement: refund- plus adequate warnings when vehicles are at risk of being towed

Elite Enforcement grossly neglects to abide by the policies and procedures outlined in their contract. They have also towed my vehicle when multiple members of their staff verified incorrect information which resulted in the tow. I spoke with multiple managers and nothing was resolved. They apologized for the misinformation I was given but would not waive the towing fees and I was informed, on a recorded line - from their company. They were at fault here and would not take responsibility for it. I would never recommend this company. When I win my place on the Board, they will be the first change I initiate.
