On October, 18th 2017 I called Elite Air Conditioning & Heating because my air conditioner was not working. I talked to ***, she gave me an appointment on October,19th 2017. *** told me there was a $95 dollar service charge, that would be deducted if Elite Air installed a unit I told her ok.

On October,20th 2017 I checked my bank and saw that Elite Air conditioning
charged my debit card $195. I called Elite Air Conditioning and talked to *** she told me that $95 dollar service charge was for local and that a $195 dollar service charge was for not local. I also asked *** to send back the $100. And keep the $95 we agreed on.

She did not respond

My recollection of the event is that the consumer first contacted
me in October asking for various remedies to repair his AC. He had a lot of
concerns and we spoke several minutes as I gave him advice over the phone
including several maintenance tips such as changing the filter, washing the outdoor
condensing unit and checking the breaker. After none of these suggestions
worked and his AC still not working I informed him of a $95 service fee to come
out and diagnose the AC. He agreed and gave me his information. Once I typed in
his address, I realized he was an hour drive away. I quickly apologized for misquoting
and corrected the amount to reflect an out of area service fee of $195. I then
assured him we carry parts on our truck and if repairable would be able to fix
his AC in one trip. He asked, “What if the unit needs to be replaced?” I assured him that we would match any competitor’s
estimates and would apply the $195 service fee towards the new unit. He said
that that sounded fair and continued to make the appointment for the following
day.

A few days later, I was contacted by the consumer stating he
called around and now thought our prices were outrageous and that Home Depot
and/or Sears gave free estimates. He also stated I should have stuck with the
original price and I should refund him $100.

I tried calling him back on 3 occasions but he did not
answer. Then, I received a negative review on our website from the consumer. Again
I tried calling him, but no answer. Finally, I replied to him via email,
reminding him that I quoted $195 over the phone, additionally explaining that
the technician no only diagnosed the problem, but worked on the unit diligently
trying to get it working, replacing electrical components and performing maintenance
with hopes he could get the unit started. All extra fees that were chargeable. I also informed him we would gladly apply the diagnostic
fees towards any future repair or replacement, as well as match any competitor’s
estimates. The consumer did not accept
my offer. I would also like to note that he has turned in more than 30 bad reviews on my website with the same identical complaint. I would call that obsessive and borderline stalking.

I have a signed invoice, by him, stating that we worked on
the unit, replaced parts, and would apply the diagnostic fee towards a new
unit. The amount of $195 is clearly stated right beside his signature. Finally,
we will gladly give him a credit of $195 towards future repairs.

Again I can only apologize so many time for the miscommunication on HIS part. I clarified before I made the appointment of our fees. He accepted. I was not aware of his misunderstanding until after said work was apply the credit on future work. I cannot help that he does not want to continue with repairs. I do not have any other choice to offer him. I'm sorry he was confused, but I am not liable for his confusion. 1. I clearly explained the $195 charge on our first conversation when we made the appointment.2. After work was done, He saw the invoice stating $1953. He signed the invoice clearing showing a charge of $195Again I can only apologize so many time for the miscommunication on HIS part.I suggest the solution is for him to schedule the repairs in order for him to get his credit.
