RE: Case # XXXXXXXX
In response to the complaints referenced in Case # XXXXXXXX. Elite One Property Management LLC has an annual rent increase which occurs when the...

tenant's current lease expires. The tenant gets notice of this increase approximately 45 days prior to lease renewal date. If the tenant wishes to leave the property they are required to provide a 30-day written notice to Elite One Property Management. The management software system used at Elite allows all transactions to be completed via the internet. This includes lease signings, renewals, maintenance requests, and rent payments. The tenant may request a paper copy of their lease (which we provide) upon collecting the keys, paying their deposit and 1st months' rent; but also have the opportunity to print a copy at their convenience anytime throughout their lease term. Currently [redacted] of our tenants pay rent online as required by their lease documents. There is a [redacted] handling fee to accept paper checks or money orders (identified in the lease) as these require additional time and expense for the Management Company. Paper checks also increase the possibility of the tenants checks to be misplaced or incorrectly logged into the management software which results in a computer generated late fee as mentioned by the tenant. The late fee in question has been reversed and credited to the tenants account in the form of handling fees and rent payment. Please see a copy of the tenant ledger attached.
The property at which the tenant resides in has been managed by Elite One Property Management since May 17th 2015. Management completed walk-through inspections on this unit on 6-19-15 and 6-22-16; there were no mentions of mold or any other tenant complaints at these times. If there is mold within an appliance it would be the responsibility of the tenant to clean the items furnished by Elite One for the tenants use. If they are unwilling or unable to perform the cleaning, we will assist in finding a company to do this cleaning. There have been no formal work orders placed on this unit since Elite One has taken over the management. We were verbally informed of the drain issue and it was resolved prior to receiving this complaint from the Revdex.com. The faded numbers on the mailbox have been replaced.
The tenant moved into this property in September of 2014; they chose to resign the lease for the 15'-16' year and again for the 16'-17' year knowing the lack of accessibility to this property which was built in 1980. There are exterior stairs and interior stairs to every unit on this property, it is not possible to make this property accessible without major renovations. To help improve the tenants experience we have installed 2 handicap parking signs outside of their building at front door, installed shower bar in the bathroom, and installed a new A/C unit with a remote control within their unit. Elite One will release the tenant from their lease if they can no longer reside at this property due to medical reasons. There are other accessible complexes in the area they will fit their accessibility needs with no improvement to the property.
Sincerely,
Elite One Property Mangement
Initial Consumer Rebuttal /* (3000, 8, 2016/09/11) */
(The consumer indicated he/she DID NOT accept the response from the business.)
It is not professional to verbally agree to make changes on one date and then say you did not agree to make said changes- there are audio recordings of what the property manager agreed to do-.. it is also illegal not to accommodate disabled individuals or force them to move just to avoid complying with Federal regulations. Pure greed and indifference. The building is a fire/safety hazard, as it reeks of mold, hot wires and the carpet is rotting on the floor.
Final Consumer Response /* (4200, 16, 2016/09/23) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Typical practices.. Agreeing to something and then back peddling. "Not knowing" is her go to response and as someone practicing business, it is her job to know these things. Choosing ignorance over informing oneself of laws and regulations does not make good business practice, nor does it absolve them of liabilities from injuries suffered on their property because they "do not know" laws, regulations or accessibility requirements.
Final Business Response /* (4000, 17, 2016/09/26) */
Original complaints have been satisfied on the behalf of Elite One Property Management except those that we can not or are not required to do. According the U.S Department of Housing and Urban Development: Both privately owned and publicly assisted housing, regardless of whether they are rental or for sale units, must meet the accessibility requirements of the Fair Housing Act when they are located in a building of four or more units, built for first occupancy after March 13, 1991. The building in question was built in 1980. Modifications to the current structure would not be within "reasonable" means for Elite One Property Management.
Elite One has just underwent its yearly fire inspection and building is and was up to fire code. There are plans for the common areas in this building to be remodeled in spring of 2017. The common areas of the building do not affect the living conditions of tenants.
Elite One would like to close with restating that we will allow the tenants to break the lease for medical reasons at anytime, if they find housing that better suits their needs.
