Incomplete execution of contracted work. Contractor non-responsiveOn August 22, 2016, I signed a contract with Elite Powerwashing LLC, for stripping, preparing and staining rear deck and front porch of my house. Total cost was to be $2,500 with one-half due prior to start. Although price was high, I expected equally high quality work, and felt that [redacted] and I were in agreement as to what constituted "high quality." Communication among all parties became complicated with the addition of a subcontractor. I learned, after signing the contract, that this person was to complete 99% of the work. However, items I discussed with [redacted] prior to signing, such as powerwashing the underside of the back deck, were not relayed to subcontractor and were not completed. Work did begin as planned around 7:30 am August 25. All seemed to be progressing well, and as I had several tasks to be completed elsewhere that morning, I left the house. I was visiting with a neighbor friend (who was not feeling well) around 11:30 am when Mike informed me that the subcontractor was finished with all the prep work. The subcontractor would return Wednesday, August 31, weather permitting, to begin staining phase. I arrived home about an hour later. And went ballistic. Neither the back deck or front porch was in any condition to begin staining. The underside of back deck had not been powerwashed, and no prep had been done on lattice of deck or porch. I was so upset I wasn't able to call Elite until around 8 pm that evening, leaving a message stating that I was not happy with the work. The deck and porch were not ready to be stained. After a restless night, I was still upset the next morning, August 26 I am retired and live on a fixed income. The $1,250 I spent so far on 4 hours of work is a lot of money to me! Around 8 am, Mike did call me back. Unfortunately, I was not ready to be calmed down. Mike finally said he'd call me back when he finished with a customer. He never called back.I received a text at 11 am that same day, asking for me to email a cancellation letter. Which I did, since I saw no other option. I believed I was due a refund, minus the 4 hours of work actually done. This was stated in my emailed letter. [redacted] responded via text to say the letter had been received, and "no balance due." Attempting to clarify, I texted back, "Are you saying you are not giving me a refund?" No response.The weekend passed silently. I called Elite at 8 am this morning, leaving a message: does lack of response from them mean I'm not getting any refund, and if that is the case, then "please call me at your convenience."No response.Desired SettlementPartial refund: down payment of $1,250 minus four hours of work and cost of supplies used to dateBusiness Response Contact Name and Title: [redacted]Contact Phone: XXXXXXXXXX On august 22nd mrs. [redacted] entered into a agreement with Elite Power Washing to strip the front and rear deck including hand rails. (not including the dog ramp) as stated. The deck was to be stained with 2 coats of stain that was choosen by mrs [redacted]. Elite explained that we use one person to do our stain work. she stated that was fine with her. On august 24th we scheduled for [redacted] from [redacted] Pressure Washing to start stripping and Elite surface cleaned the drivewayas part of our agreement. We also moved all of mrs [redacted]'s plants and furniture to be ready for August 25th. [redacted] started as scheduled when he was done with stripping the rear deck he went to the front deck and he decided that a much more detailed stripping would be needed which entailed hand sanding. we told [redacted] we would let [redacted] know. She was at another one of our customers house and we explained that to her she said ok. She then called that night and said she felt the work was incomplete, so I explained to her again that extra sanding was needed and there would be absolutely no additional charge to Mrs [redacted]. She then asked about washing under the deck which I told her we would take care of that and its a process. She then asked about her lattice which was never discussed or included. I told her we would work with her to make sure she was happy. The bext day [redacted] spoke with her and said he would would include the strip and stain of the lattice if it would make her happy. She told him "thank you so much [redacted]" I spoke with [redacted], at which point we had her back on schedule. She called [redacted] about 1 hour laterand said she was "pretty [redacted]" and that she just wanted to cancel anyway. [redacted] promised the job would be to her liking there are just steps that need to be taken it does not get done in one day. she insisted she didnt care she was canceling. [redacted] then asked her for a cancelation in writing. She emailed us at which point we canceled the job and let her know that there was no further balance due. all deposits are non refundable after 3 Buisness days.Consumer Response 1) Elite did not explain that they "use one person to do (their) stain work." Therefore, the statement that I "stated that was fine with" me is inaccurate. 2) I never wanted my driveway pressure washed. Elite said they were throwing that in for "free." In fact, when Elite pressure washed my house on June 24th of this year, they tried hard to get me to agree to add on the driveway, finally leaving by stating that they would return anytime and do it for $50. It has been a little over 2 weeks since they pressure washed the driveway and it is stained again from all the acorns, nuts and other leaf debris from overhanging trees which is why I did not want it done in the first place. 3) I moved 95% of my plants and furniture myself. Subcontractor [redacted] helped me move a few of the heavy plants and a deck box from my rear deck; Elite did move a heavy credenza from my front porch that my nephew had not had time to help me movedefinitely not "all of my plants and furniture" - maybe 5%. I had a lot of stuff out there! 4) Elite told me - in front of a witness that [redacted] was ready to start staining Wednesday. No mention was made of further prep required. Nothing was said about him not being done - only that he was ready to start staining Wednesday, weather permitting. No one ever let me know that "a much more detailed stripping was required..." as inaccurately stated. 5) When I called [redacted] that night, I had to leave a message: I did not consider the prep work complete and to please call me back. 6) In the morning (Friday), since I had not heard from [redacted], I first called [redacted] to ask if he was finished with the prep work. I did not really get an answer to that, but he said he would get in touch with [redacted] to discuss the situation. About 30 minutes later, [redacted] did call me back. I did not, however, get any of the explanations stated in Elite's Revdex.com response to my complaint. No mention was made of any specifics that would be taken to rectify what had only been presented to me as a "ready to stain" situation following only 4 hours of prep work. Vague statements by [redacted] that "we want to make this right" without any specifics were followed by his statement that he would call me back when he was finished with a customer. That was the end of any live voice call contact with Elite. None of the "stuff" regarding phone calls specifying attempts to make me happy occurred. 7) As I stated in my original complaint, [redacted] did not call me back. And [redacted] did not call me back as incorrectly stated in Elite's Revdex.com response. The only contact was from [redacted] via text: "[redacted] sorry that you cancelled. Please email a cancellation letter explaining why you cancelled so I can give it to my accountant Thanks" So I wrote a cancellation letter, including the statement: "Because of issues specified below relating to Elite's fulfillment of contract cited above, I wish to cancel said contract and am expecting return of $1,100 of my down payment of $1,250." Via text [redacted] acknowledged receipt of cancellation notice, and stated "There is no balance due." I responded via text "Are you saying you are not giving me a refund?" No response. 8) On Monday morning I called and had to leave a message: Should I assume lack of response mean I am not getting a refund? No response. So Tuesday I filed my complaint. 8) There is nothing in my copy of Elite's contract that states "all deposits are non-refundable after 3 Business days." Final Business Response We at Elite only use 1 person to do all our stain work. [redacted] the owner of [redacted]. We met [redacted] at [redacted] Drive to introduce him to Mrs. [redacted] and to discuss the prep work and Mrs. [redacted] was given her color choice book from [redacted]. We explained that [redacted] would be doing the stripping so that it would be ready for him to stain, MRS. [redacted] said that would be great. Mrs. [redacted] was always made aware that [redacted] would be doing the stain and strip. She was given [redacted]s card before any work started. 2) The driveway was included in this work, Elite does not do any concrete cleaning for under $125.00 We can not control the oak trees or their debris. 3) [redacted] and Elite moved atleast %75 of the plants and furniture including a very heavy dresser from the porch to the inside the house . 4) When Elite talked to [redacted] we explained a more detailed hand sanding would be needed on the front porch. She then asked why the lattice was not done. We explained it was not part of our agreement as it was not on the paperwork. She then saod she could have done the work herself for less, I agreed. I told her I would ask [redacted] about adding the lattice work. [redacted] spoke with her and told her he would do it for free of that would make her happy, she said ok. 1 hour later she called to say she was "[redacted] off" and that the job was just to much money and that she wanted to cancel. I promised her we would do what we agreed to. She said she wanted to cancel anyways. Elite told her we needed amd cancelation in writing, she sent it. Elite then informed her that there was no balance due. Mrs. [redacted] cancelled the job after we pleaded with her to let us finish the work. Elite would be willing to gove [redacted] $125.00 which is the balance after considering the the work that was done there and the loss of our final payment that was cancelled due to her not allowing us to finish the work.
