Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this resolution is satisfactory to me I am writing in response to an e-mail I received on April 26th containing the response from the business (Elite Seamless Gutters) that I was dealing with for the repair of a leak in my laundry roomI submitted a complaint on April 4th and received a phone call from the owner ( [redacted] ) the following morningWe agreed to meet at my house so he could look at the leak coming from my ceilingWe met on Wednesday April 6th and he told me he was going to call in some of his roofers that he works with to look at the issue and that this would be corrected within the next week.The next afternoon we met at the office and I received copies of the contract and paperwork originally requestedThe roofers arrived Friday AM (April 15th) and worked on the roof that dayThey came by for a final check and to cap it off on Monday (April 18th) As of this time the issue has been resolved as there have been no further leaks, all paperwork has been received as requested, and the bill to the business has been paid in full [redacted] @comcast.net# [redacted] Sincerely, [redacted] ***

Myers Towing, INC is responding to a complaint regarding the number of days charged for a vehicle that was dispatched by the Stanislaus County Sheriff's Department towed by our firm to our storage yard and stored for a period of three daysOn July 3rd approximately 4:52pm Myers Towing
received a request from the Stanislaus County Sheriff's Department to store a stolen vehicle that has been recoveredThe Stanislaus County Sheriff's Department is responsible to notify the registered and or legal owner at the time of recovery that their vehicle may be picked up by themIf the registered or legal owner does not answer their call, is unable to respond within a reasonable time, or the vehicle is unable to be safely operated they request a towing company from a rotating list of approved firmsThe Vehicle was stored at our *** *** *** *** ** *** facility on July 3rd approximately 5:51pmAccording to California Civil Code 3068.1(a): Every person has a lien dependent upon possession for the compensation to which the person is legally entitled for towing, storage, or labor associated with recovery or load salvage of any vehicle subject to registration that has been authorized to be removed by a public agency, a private property owner pursuant to Section of the Vehicle Code, or a lessee, operator, or registered owner of the vehicleThe lien is deemed to arise on the date of possession of the vehiclePossession is deemed to arise when the vehicle is removed and is in transit, or when vehicle recovery operations or load salvage operations have begunA person seeking to enforce a lien for the storage and safekeeping of a vehicle shall impose no charge exceeding that for one day of storage if, hours or less after the vehicle is placed in storage, the vehicle is releasedIf the release is made more than hours after the vehicle is placed in storage, charges may be imposed on a full-calendar-day basis for each day, or part thereof, that the vehicle is in storageIf a request to release the vehicle is made and the appropriate fees are tendered and documentation establishing that the person requesting release is entitled to possession of the vehicle, or is the owner's insurance representative, is presented within the initial hours of storage, and the storage facility fails to comply with the request to release the vehicle or is not open for business during business hours, then only one day's charge may be required to be paid until after the first business dayA "business day" is any day in which the lienholder is open for business to the public for at least eight hoursIf the request is made more than hours after the vehicle is placed in storage, charges may be imposed on a full-calendar-day basis for each day, or part thereof, that the vehicle is in storageThe important aspect of the law states: A person seeking to enforce a lien for the storage and safekeeping of a vehicle shall impose no charge exceeding that for one day of storage if, hours or less after the vehicle is placed in storage, the vehicle is releasedIf the release is made more than hours after the vehicle is placed in storage, charges may be imposed on a full-calendar-day basis for each day, or part thereof, that the vehicle is in storageTherefore, once the vehicle has been stored at our facility we charge one day ($103) of storage for the first hours (Up to July 4th 5:51pm) Following this hour time, we charge a FULL-CALENDAR-DAY per day the vehicle is in our possessionThe claimant did state that the vehicle was picked up on July 5th THREE CALENDAR DAYS later (starting at 12:00am each day) Although our business hours are Monday-Friday 8am-5pm excluding major Holidays (such as July 4th), our facilities are able to release vehicles upon full payment and including an additional "gate fee" within minutes of request at our facility in order to reduce daily storage charges on weekends and holidaysThe claimant chose to come to our office three days into the storage of the vehicle which was charged at our rate of $per dayJuly 3rd Tow Fee + Storage Day July 4th Storage Day July 5th Storage Day The claimant was not charged as every other person who picks up a vehicle that has been stored over the weekend that chooses to claim their vehicle on our following opening day.Sent on: *** *** **
