I have received a letter regarding the matter of [redacted]. I have tried to contact on numerous occasions via phone to explain why we charged Mr. [redacted]. I understand that you have closed the case but by no means did I ignore or dismiss the matter. I would like to see if there is anything that can be done about this matter.

Review: The reason for filing this complaint: I was charged $200 because they claim I violated their smoking policy, which I did not. I have talked with their manager [redacted] on three occasions. He claims his hands are tied and that he would communicate my issue to the ownership of the hotel who is claimed to be out of country. After two months I have not had any resolution.

I have two friends who stayed with me that night, and we are all willing witnesses to sign sworn testimony that no one smoked anything, nor lit a match, lighter, candle, or anything whatsoever in that hotel room. We don't smoke. None of us. My cousin, a dentist, at 46 years of age, has never smoked one time in his entire life. I last smoked in high school -- over 18 years ago. My friend [redacted] is a non-smoker, plain and simple.

[redacted], manager of Elizabeth Inn, confirmed with me on the phone that we were not found in violation of the policy because there was any detectable odor of smoke, nor from having been physically seen smoking. Rather, their "proof" is in a claim to have found a butt in the trash can upon our departure, which was photographed by them. If I am expected to be believed in my claim, then I will extend the same courtesy to the staff and assume for a moment that a butt was indeed found in the trash can. Firstly, if this had been my butt, the throwing away of a butt in the trash can does not constitute a violation of the non-smoking policy. This is elemental to my case! It could be that as a courteous and environmentally responsible smoker I extinguished the butt outside and came to dispose of it properly instead of littering. Or perhaps a smoker cleans out his car ashtray in the trash can, but again, does not violate the smoking policy by actually smoking in the room. Secondly, the butt could have indeed existed in the trash can as they claim, but remained from previous guests if the room was not thoroughly cleaned. This is not implausible as we found a tag (the sort that indicates size and price that is torn off the care label of a new shirt) on top of the dresser when we moved in. That simple tag shows that things can indeed be overlooked when preparing a room for new guests.

We are willing to gather personal character statements from family, friends, and community members we encounter on a daily basis that would lend credibility to this claim. Both my dentist and doctor have agreed to provide their professional opinion that I am not a smoker. I can gather dozens of signatures from friends, family, and community members with whom I interact regularly to say that they do not know me as a smoker.

I will do whatever is asked of me to give support that this is either a fraudulent claim by Elizabeth Inn, or simply a misapplication of the fine that should have gone to the previous occupants. I can only speculate as to how this error happened, but I am paying for someone's mistake and it is wrong. I take this moment now to swear on all that is true and holy in this world, to ask that my life be plagued with sickness, poverty, pain and suffering if I am making an untruthful claim here. Elizabeth Inn charged us $200 for something that did not happen. That is not acceptable. I can seemingly do nothing else than to try and try again, as passionately as possible, to convince them this is an error. There is a wrong that needs to be made right.

I feel violated by this matter, thus the passionate nature of this complaint. I give my apologies for the lengthy argument but is difficult to discuss it in brief.

That is the problem as best as I can describe it here. I am happy to talk with anyone at any time about this issue.

This may be an unfortunate "cry wolf" situation where many people who have indeed violated the policy in the past make it difficult for me to appear truthful at this juncture. I have no more "proof" that I did not smoke in the room than they have "proof" that I did by finding a butt in the trash can.Desired Settlement: A refund, presumably to the credit card used for the hotel room.

Good Afternoon,

We recently booked at least 15 rooms at this business during my mother's funeral services. We walked into our rooms, after checking in and being told nothing, only to find signs saying "Water is not safe for pregnant women or children to drink." We had one pregnant woman and 15 young children in our group! One family (pregnant woman and 18 month old) went right back to the front desk and asked for his money back so he could go somewhere else. He was told this was not possible and it was only after he said he would write them the worst review ever, that they said they would speak to someone and try to resolve it. He eventually did get a refund. The rest of us chose to stay simply because we were under time constraints to get to the visitation. We found stained sheets and blankets, disgustingly stained and dirty looking carpet throughout the rooms, halls and lobby, heaters that pumped out heat constantly and we were told they couldn't fix, rooms without shower curtains, rooms with large areas of patching plaster on the walls that hadn't been sanded or painted, and fitted sheets that were so small and torn everyone woke up all night wrapped up in them. When I complained at the front desk to the manager, she said they have been renovating and fixing things for awhile. I can't imagine what condition it was in before! In all of our opinions, (15 rooms of people), this place should be shut down until it is completely renovated and they can prove the water is safe to drink.
