Business Response /* (1000, 5, 2013/05/14) */

I would like to help this customer. They did not supply me with enough information to research. I need to know the vehicle and dates for transaction. What name the on the receipt and the receipt number.

Review: In 2007 I purchased a 2001 [redacted] Explorer Sport at approximately $8500. After about a month of ownership, the transmission failed and the vehicle was exchanged for 1998 [redacted] Durango at equal value. After owning the Durango for about 1.5 years, I returned it to the dealer as a voluntary repossession with the verbal agreement that once the vehicle sold, I would be responsible for any difference if the dealer experienced a loss. At the time, my remaining balance on the vehicle was approximately $4000.00.

Since the vehicle was returned, this company has reported four separate transactions to credit agencies giving the appearance that I have three loans with them that are in default. My credit report also shows one "judgment" in the approximate amount of $2500.00. Although I am assuming this "judgment amount" is the difference owed per the verbal agreement identified above, I do not know for certain because I was never notified of any litigation or formal court proceedings. I am still unaware of what this "judgment" is or when it officially took place.

The three loans on my credit report reflect two large vehicle purchases for the approximate amounts of $15,000.00 and $20,000.00. There is also a loan reported in the approximate amount of $7,500.00. None of these loan amounts reflect the actual cost of the initial vehicle purchased in 2007.

About 30 days ago, the dealer received a certified letter from me to which I ensured signed delivery requesting a statement of account as well as copies of all promissory notes and vehicle re-sell amounts to prove the difference owed. The dealer has not responded to my inquiry and has also failed to produce any proof behind their claim that I have three unpaid loans.

This false information on my credit report is causing a significant hardship to me as I am required to report and provide detailed explanations for every debt I have to my employer. I am at the point where I may face remedial action from my employer because it appears as though I do not pay my debts. Right now, this dealer is reporting that I took out over $40,000.00 in loans for a used vehicle that was no where near that value brand new. Although I would like to pay the debt I owe (which I believe is only around $2,500.00), I don't dare make any payments to this dealer or on these loans because I do not believe that the three other loans are factual and I don't know if paying is going to do me any good. I believe that based on research performed on this dealer, that the accounts were fraudulently entered. The fact that the dealer has failed to provide me with the information I requested only adds to that suspicion.Desired Settlement: I would like for the dealer to retract all invalid loan reports so they no longer appear on my credit report. I will work on establishing a payment plan for any balance that is proved without a doubt that I owe (in my opinion, only around $2500). I can obtain legal support if needed.

Review: On May 3rd, 2013 I purchased a 2002 Mercury Sable from this dealership. After I signed all the paperwork, they informed me the "check engine" light was on and that they were going to fix it but in the meantime, they will let me borrow a 2004 Ford Taurus. On May 5th, the Taurus broke down on me on I95 at 9pm, very dangerous. I had the car towed back to my home that night and I called this dealership the next day asking for my money back because I believed the car I purchased would be just as reliable as the car they let me borrow. They told me that they would NOT give me my money back, even though I didn't lay a finger on the car I bought, and still haven't. I refuse to take possession of the car I bought.

Product_Or_Service: 2002 Mercury Sable

Desired Settlement: I would like to have a refund of my down payment ($750) and a refund of each of my weekly payments ($105.44 a week).

Review: I purchased a 2005 Nissan Altima on 7/10/2008 from ellington auto sales my contract states that I also purchased GAP insurance as well. My car was total on 01/23/2014 I owed $2800 on my car witch was suppose to be covered by my gap insurance. I contacted ellington auto to let them know what was going on and ask how do I go about getting the $2800 paid off I spoke with a representative [redacted] that ask me to fax over my insurance and credit union information witch I did she call me back stating she contacted GAP and it going to take 45 days to process my claim after two weeks I called back to follow up and I was told she was fired I ask to speak with the manager [redacted] I got his voicemail every time I call I left multiple messages and he never return my calls. I want them to be investigated for there unprofessional and dishonest practiceDesired Settlement: I would like the money that's owed to me. I have a contract that states I have GAP insurance

Review: I financed a car through drive auto group whose finance company is autoflow fianance. The flyer for the car said 400$ down and I end up having to put down 1400$. I traded in a vehicle and transferee the plates to my new car. [redacted] (the dealer who sold me the car) said that it was legal to drive and I will receive my registration in the mail. I got pulled over 3 days later for my plate still being registered to my old car. I was told by the police and dmv that no attempt was made by drive auto group to register the vehicle and I had to go to dmv and pay out of pocket to register the car. But I am paying a seperated loan on top of car payment for registration and vehicle tax I already paid the dmv. A shutoff device was installed in the car and I signed a contract that if I get more than 14 days behind it would've shutoff. Every Monday when payment is due they call me and if I don't have the money they shut off the car even if it's not late. I plead with them not to do that and they just laugh at me. I've been called racial names by them and have had car shut off for threatening to file a complaint and not turned back on until I apologize for my "attitude". The finance guy chris called one day and my wife picked up and he told her she sounded "sexy" and asked her why she is with a man who can't afford payments.Desired Settlement: I want them to be investigated and repremanded for there unprofessional and dishonest practices.

Response:

This is in response to Mr. [redacted]'s complaint. Mr. [redacted] purchase a vehicle from Ellington Auto Sales & Financing dba Drive Auto Group on 8/19/2013. All the appropriate contracts were signed by Mr. [redacted] on that day and the registration was issued on 8/19/2013 by the DMV online system. The customer should have been given his registration that date. I don't see how a registration could have been given to him on that date. [redacted] the salesperson named no longer works for the company neither does [redacted] in Collection depart. I am sorry if Mr. [redacted] feels disrespected in anyway.
