Comments:

I am representing my daughter, who entered into a contract with *** on or about September 14, 2018, to complete the above-referenced concrete work. It took numerous phone follow ups by my daughter and myself before this project got started and to have him complete it. Final completion was on or about November 5, 2018. After completion, my daughter noticed a minor crack between the concrete wall of the planter (hollow tile planter). *** was immediately notified and he informed her that this is correctable and would immediately complete the repairs. Weeks later, this crack became larger and currently, it has gotten worst. On numerous occasions, via telephone and e-mails, both my daughter and myself were in contact with ***, but to no avail, he did not make any attempts to correct the problem as promised.

Upon completion of the above work, my daughter entered into an agreement with *** to provide for a sealant on the entire concrete slab for a total of $900, with half being fronted. Therefore, *** was provided with a check of $450.00 on November 9, 2018.

It should be noted that in the month of January 2019, my daughter received a California Preliminary Notice - Private Works from *** that Claimant, *** dba HP Concrete, as subcontractor, located at *** of ***'s failure to pay for materials provided to her residence.

Again, on numerous occasions, we have spoken and contacted *** via e-mails regarding his promises to complete the repairs as well as the sealant and all he has given us is the run-a-round (i.e., family member is sick, funeral to attend, busy on another job, too hot to apply sealant, etc.) Finally, an ultimatum was given to him in early September 2019, to stop any further work, however, to refund the $450.00. *** agreed to do so. Excuses again, i.e., a deposit needs to clear my bank, the bank closed out my account, I will drop off cash, I will make a cashier/certified check, etc.

On October 8, 2019, a FINAL DEMAND for the entire refund of $450.00 was sent and acknowledged by ***. He promised to refund the entire amount by October 15, 2019. On October 16, 2019, of the $450.00 promised, we received only $100. Yes, we are again faced with the same dilemma, "trying to collect" and will again be faced with "a mountain of broken promises."

was suppose to be a contractor to build the retaining wall between my neighbor and my backyard. The contracted job was supposed to be worth $***. I gave him a deposit check of $*** to start the job on 9/6/18 He didn't show up until 9/12 for half hour. Then on 9/13 another half hour. And thats all. Dig up a few less than a foot deep on a 30 ft. Long - at the side of my neighbor's driveway, which used to be a planters area. He just kept making excuses that he needs to wait for his guys ,he needs to wait for equipment. He is waiting for his guys. To the point, I felt he is not really coming to work.
On the 9/21. I start asking for refund. He claim, he needed to ask for refund from the company he ordered blocks for. But, there was no blocks or material ever delivered to my house. Then, he claim, he needs to wait for the check to clear. So, its like everyday, he claim, he will give back until, Friday 9/26 He came to hand me a check of $***. But ,told me not to cash the check until Saturday. when I tried to cash the check on Saturday 9/29/18 at Chase Bank, the bank teller says I need to talk to him. There is no money in the bank,I think.
This is everyday, he kept promising to return but he never . He claim to return to me only $***, he did not actually do anything. He is really a scam.
