All tenants are provided with a list of charges that are chargeable if we have to send a vendor into the unit. the move out date. The rates for maid service, carpet cleaning, and trash removal are set prices, and are a flat rate. Upon move out, maid services had to enter the unit and clean some of the areas that were missed, at the flat rate the tenants are quoted on the lease and the forms sent, so they are aware of what the costs are. Also, management had offered to split the cost with them, and they agreed to the offer, which closes the account, per the closing agreement. We have supplied a ledger of what we paid for the services, we use our own vendors and will not have anything to give her other than the ledger of the costs. We consider this account as closed, as we settled with them on an amount, and provided the ledger of the payments made to our vendors for the unit, along with the photos.

This issue has bee resolved and we consider this matter closed.

Photos of the unit ARE from the unit in question. There is a witness to that claim. All work is done through Ely Properties vendors and there are no outside vendor invoices. We attempted to give her the accounting of the work done, which she is rejecting. We do not have an outside vendor, they are inhouse workers so the invoices are Ely generated invoices. We offered to refund half of the maid and half of the paint, which the tenants are rejecting by disputing further. Ely considers this matter closed, and if the tenants accept the offer of half the maid and paint, we will cut a check to them and close the matter.

I am rejecting this response because:The photos provided as proof could be from any apartment in the complex, neither do the photos show damage but only normal wear and tear. In addition, the business agreed in email to refund 1/2 of the cleaning fee and 1/2 of the painting fee. I will submit copies of the emails confirming these offers. I also do not accept that the business does not keep final invoices for its records on amounts paid to vendors for services rendered.

The previous tenant, [redacted] did have a water leak upon move-in August 2016 and the issue was addressed in a timely manner as outlined for landlord responsibility in Texas Property Code.  She and her roommate occupied the property from August 2016 to August 3rd 2017. When tenant left...

the apartment for extended period Summer 2017, they failed to ensure HVAC system was functioning properly by keeping AC filter changed along with not leaving the system in auto cool mode as opposed to fan “on” position causing the AC fan to run 24/7 which caused the dirt build up at AC registers.  [redacted] offers no compensation for the disgruntled tenant. Once Ely Properties was properly notified by the tenant, we acted with due diligence to remedy the problem in a timely manner (Per Texas Property Code). The leak was coming from the condo above which Ely Properties does not manage. The owner of the above condo was notified and repaired the leak. Ely...

I have tried contacting Ely Properties and I have not received any return email or phone call. Please provide me with the email you would like me to contact you through and what information you require in that email to assure the prompt mailing if the refund.

manager is willing to agree to to the 50% refund of paint and maid.  Tenant neglected to respond to the offer, there is no unethical practice.  If tenant wants to accept the offer they need to make contact.  We consider this matter closed once they accept the original offer.
