LOVE, LOVE, LOVE our new EMC Home
We put a contract on an EMC home in Dec. 2022 and due to permitting issues with the lot that we had chosen it took quite a while to start building. Once they started building in June 2023 we were excited to see how fast the process went and we were able to close in December 2023. We hit a few bumps in the road along the way, which is to be expected when building a new home, but overall we were very pleased with the experience and loved working with Pamela and Wade. They answered our questions and concerns in a timely manner and made sure we had what we needed to bring it all together by closing. Wade is such a great Superintendent with a detailed eye when it comes to seeing things we did not even notice. He has a calm and patient demeanor which allowed us to be at ease when things were a little stressful as we got closer to closing. We are so blessed to be in our new beautiful home and in such a wonderful and peaceful community in The Shores of Lynncliff. Thank you Wade, Pamela, and the rest of the team for making it possible and a great experience.

This construction company is the most shameless and unprofessional I have ever seen. Please stay away from this construction company as much as possible. I was the first to sign a house purchase contract (May 2021) and pay deposit of $8,000 at that time. The initial plan was that there was no basement. After more than half a year (January, 2022), they told me that their original plan was wrong and asked me to choose another lot to build a house. Then I did. After waiting for another year, they told me today (January 2023) that they will not sell me the house because the price of this house has increased. they'll give me an extra 250 bucks in addition to my deposit.

This is the most ridiculous thing. I paid a deposit of 8,000 for nearly two years. They refused to give me the house, and then canceled the contract rudely.

EMC Homes has violated the termination agreement for the purchase at *** Dr in ***, GA. The termination agreement was sent by their seller's agent, Tracey *** of Peggy *** Realty, and it was signed on 1/10/20. The agreement said that I would be refunded my $1700 earnest money within 30 days and today is 2/9/10. I haven't received my money back still. They broke the termination agreement even after demanding that I paid them $1700 via wire within 24 hours of signing the purchase agreement.

Also, they have unscrupulous business practices. The builder which I'm not sure of his name because no one would tell me has an innapropriate relationship with the preferred lender, *** of *** Bank. Their relationship is a conflict of interest for any buyer and was not disclosed on the contract. One of Syvlia's colleague told me about their relationship.

I had two lawyers review the purchase agreement and both said that they are using a non-standard builders contract. The contract falsely used the term "construction deposit" for the earnest money that I paid when the house was not under construction and was fully complete prior to my even making an offer on the property. They also kept violating the contract by making amendments via email and trying to force me to sign off when I wasn't in agreement with the terms. And they added a clause after the contract was signed in order to milk me out of more money to pay $125 per day after the date of 1/31/10 ended up not being the closing date when I clearly told them from the beginning that I would need a minimum of 60 days for the financing to go thru because the GA Dream takes a minimum of 60 days to process applications. They did this to ensure that I wouldn't be able to buy the house. They made it impossible for me to be able to complete the purchase.

EMC Homes violated the law. They write one thing in a contract and do something else. They make it impossible for the buyer to be treated fairly.

Desired Outcome

Refund I want my refund of $1700 within 24 hours (2/10/20)and a fee of $125 per day that they went over their agreement in punitive damages for violating the termination agreement. I also want EMC Homes to be exposed and fined for violating the contract.
