Systems sent a statement to the address on file April 11th, 2017 with no response from the responsible party and no mail return. An Emerald representative left a voicemail on the phone number provided by the responsible party (in this complaint) in July of 2017. An Emerald representative followed up again with a phone call to the same phone number in October 2017 and the person who answered would not properly identify herself to validate who we were speaking and the person who answered hung up. Unfortunately, the debt was reported to the credit bureaus as it was unresolved even after multiple contact attempts for resolution by our Client and our agency. We recently received a complaint through the CFPB from this same person and properly responded via mail with an itemization of charges and claims reconciliation by the insurance of the responsible party received by our Client, [redacted]. The insurance indicated this was a non covered charge and any amounts due were patient responsibility. Is the complainant claiming that she was not serviced and did not receive care from our Client, [redacted], and the itemization of charges are not for her? The complainant would not have a signed contract with Emerald A/R Systems as we are the contracted collection agency for [redacted] and do not have a contract with the complainant. This is a valid debt sent by [redacted] to Emerald A/R Systems for collection efforts and resolution. We are happy to assist in resolving the account with the complainant.  She can call [redacted] and speak to our representatives for further resolution.

This is NOT my account! Please delete from my credit as you can see the paperwork that you provided is invalid. Second page PATIENT SIGNATURE **BLANK** no signature!!! This is NOT my debt. I am asking to cease all collection attempts and not to contact me about this debt as it is not my debt. Should you continue I will seek monetary damages for violating my consumer rights.

Is the consumer disputing that she received services from a [redacted]) at [redacted] as the itemization of charges shows? Is the consumer informing us somebody fraudulently used her identity and insurance information to receive these services? It is not clear from the complaint. The financial disclosure and estimate of charges shows that [redacted]/[redacted] information provided by the patient was to cover 100% of the charges incurred, but the insurance did not provide payment. Has the patient received an explanation of benefits from her insurance as to what charges they did/did not pay and why? Following up with [redacted] might assist in providing insight as to why the charges were not covered by her insurance provider.  We hope to resolve any dispute the consumer may have with our Client, [redacted]. This account has been placed on dispute status with our office since the consumer's original complaint. We will wait to hear from the consumer as to what is being disputed. Again, the consumer does not and would not have a contract with Emerald A/R Systems as we are the 3rd Party Collection Agency contracted to collect unresolved accounts receivable/debt for [redacted].  Emerald A/R Systems will not attempt to contact patient per her request.  If desired, the patient may discuss this dispute further with our office by calling [redacted] or directly with [redacted] by calling [redacted].

This complaint is not directed to the proper party. From the contents of the complaint, the dispute is not with Emerald A/R Systems rather it is with the hospital facility from which the patient was admitted. Moreover, the bill which Emerald is attempting to collect is neither with...

the hospital facility nor was it a purchased debt. It is a physicians bill from a cardiology provider, who had no choice but to treat the patient once the patient was admitted to the hospital. Emerald A/R Systems and our client have no say in '** Protocol' and we do not make decisions involving transferring a patient to a ** facility. Emerald received a cease and desist request from the consumer and this only requires attempts to contact a consumer to be stopped, which Emerald adhered to this request. The patient was treated by the provider and this bill from treatment is overdue and delinquent. Unfortunately, the reprecussions of not paying or resolving the **lid bill were to report to amount to the credit bureau(s). This is not a valid Revdex.com complaint to Emerald A/R Systems or our client.

Attached is a signed financial agreement at the time of service by the responsible party along with statements of the charges by our client. Please see the 'ZZ Bad Debt' or 'collection agency adjustment' line item for the balance(s) due. The is a valid debt. According to the financial agreement, our client could charge collection fees and/or interest up to the legal rate which they choose not to do. If a complaint still remains with hospital practices and ** protocol, please direct those to the proper party. Ms. [redacted] is correct that there are several bills for her deceased husband that went unpaid and are reported to her credit report. We made attempts to contact her regarding these outstanding charges once they were placed in our office by our client in 2010, from which we never heard a...

response. After several months of no response and no payments, the debts were reported to the credit bureau. These charges were for the same charge dollar amount, but for several different dates of service. Hence, multiple charges reported to the credit bureau report with the same dollar amount which would appear as duplicates yet they are for different dates of service. Arizona is a community property State and the responsible party may wish to review the manner in which liability and ownership of debt as well as property is handled in the State. These debts have been reported since 2011 and will remain until termed by the extent of the law. This is a valid debt and there was no mistakes of duplicate reporting as posed by the responsible party. As such, we consider this complaint invalid. We received a call from Ms. [redacted] today and the representative attempted to explain the debt, dates of service, and how community property works in AZ, yet the responsible party disagreed with the representative and stated she wanted to sue our organization. I tried to reach Ms. [redacted] via the number provided, but there was no answer. I did not leave a message. If she wishes to contact our office for further clarification, she may call ###-###-####.

We are in receipt of a confirmation from our client that the responsible party has resolved the account with the creditor directly and assume that contact was obtained through whatever means she found necessary. Further contact information for the office and the billing company is attached and available online.

Statement 1. From Emeralds Response: “This complaint is not directed to the proper party. From the contents of the complaint, the dispute is not with Emerald A/R Systems, rather it is with the hospital facility from which the patient was admitted.”

Rebuttal to statement 1: This dispute IS correctly addressed  to  Emerald A/R Systems,  not the hospital, because Emerald is the one attempting to collect a debt that for the reasons outlined  hereunder, is in valid and should never have existed..

Statement 2. From Emeralds Response:  “Moreover, the bill which Emerald is attempting to collect is neither with the hospital facility nor was it a purchased debt. It is a physicians bill from a cardiology provider, who had no choice but to treat the patient once the patient was admitted to the hospital”.

Rebuttal to statement 2: Regardless of whom Emerald’s client was or is; ANY hospital billings as well as ANY of the same from any other person or agency arising out of or initiated by the subject incident were completely in**lidated in TOTO by the hospital’s ignoring **’s  protocol for outside agencies treating a ** member.  As to Emeralds “Cardiologist” client, I do not recall ever asking for, authorizing, seeing, or receiving any “treatments” by a “cardiologist” at any time during this incident  nor did I ever receive any subsequent billings from any such “cardiologist”.  However, any such billings that exist or existed would be a “Fruit Of The Poisonous Tree” created by the hospitals ignoring ** protocol and therefore in**lid on their face.

Statement 3. From Emeralds Response:. “Emerald received a cease and desist request from the consumer and this only requires attempts to contact a consumer to be stopped, which Emerald adhered to this request.

Rebuttal to statement 3:  Emerald’s complaint response has completely mischaracterized the response letter they received from me (sent to them immediately following receipt of their initial correspondence to me in this matter). That is: that letter was NOT a  simple  “cease and desist” order.  Rather it contained a) my full and complete denial that I owed the  subject debt, b) my  complete explanation to them as to why I didn’t owe it, c) my  request to them to either “**lidate”, the debt with their client (or not) and d) a request for them to notify me of the results of that **lidation procedure, all of which the federal FDCP act requires upon my requesting it and which Emerald apparently did not do,  as I never received responses to any of my requests to them.

Statement 4. From Emeralds Response. The patient was treated by the provider and this bill from treatment is overdue and delinquent. Unfortunately, the reprecussions (sic) of not paying or resolving the valid bill were to report to amount to the credit bureau(s). This is not a valid Revdex.com complaint to The patient was treated by the provider and this bill from Emerald A/R Systems or our client.

Rebuttal to statement 4:  Emerald’s assumptions , opinions,  action descriptions and denials of responsibility included in statement 5 above, are for all the reasons outlined in rebuttals 1 through 3 preceding,  in valid and not applicable in this matter.

 

Conclusion: I believe that I have truthfully and completely laid out my case asking for Emeralds corrective actions in this matter. I trust that Emerald will concur and take the appropriate actions to correct this injustice, so that I wont have to pursue relief further.

Review: They called every day for 2 months!!! THIS IS NOT MY DEBT!!! They are looking for someone named [redacted], whom I've never met in my life! They refuse to stop calling!!!Desired Settlement: STOP CALLING ME OVER AND OVER FOR SOMEONE ELSE'S DEBT!!! When someone has a phone number for over 2 years; why would you call the previous owner!!!??? Do research before you harass the wrong person!!!! You should be sued for this harassment!!!!

The phone number provided by our client is in our system for 2 different debts for 2 different people and we have been attempting to reach those parties to reslove the outstanding balance. While calling every day is an exaggeration, we have called the number provided by these parties and have not heard back from the owner of this number so we had no knowledge that it is an incorrect number for the person or persons we are trying to contact. There have been no direct attempts on record by the new owner of this number to remove the phone number from our system. Although a simple call in to our company to explain this is a new number for the complainant and she is not any of the parties we are attempting to contact, I have removed the number from our system.

Review: I am disputing a debt of $631 from collection agency Emerald AR Systems LLC. Account No.[redacted]. This is not my debt. Two written attempts to obtain detailed information about this debt were ignored. I had no business with the original creditor, [redacted], Hematology Oncology on the alleged service date of 4/29/2010. In addition, I never received a billing for this service. I was totally unaware of this debt until receiving a collection notice from Emerald in August of 2013.Desired Settlement: Remove debt from the collection agency system and remove the collection account from all credit reporting agencies.
