[redacted] enrolled in a membership with Emerald City Athletics on November 6th, 2015. She was not able to make here full initial payment that same day so she gave Emerald City Athletics authorization to process the balance owed on November 20th, 2015. Only after the balance processed on...
November 20th, 2015 did [redacted] initiate contact to cancel her payment and ask for a refund. When [redacted] originally signed up for her membership she signed two different agreements acknowledging the fact that she signed up for a year long membership and for no reason after the initial 3-day cancellation period (required by WA state law) is she able to cancel within the first year. We here at Emerald City Athletics go above and beyond to ensure all of our members understand exactly what they are signing before they enroll in a membership. We have an additional addendum that is signed at the point of sale that is not part of the actual membership agreement that we go over with the member separately to ensure they understand they are signing a year commitment if that is the membership they choose. All of our members also have the option of signing up on a 1 month, 3 month, or 6 month agreement. Every member chooses which membership will work best for them. Since [redacted] decided to enroll in a 1 year membership, and she was past her 3-day cancellation period she was unable to receive a full refund or cancel her membership. Unfortunately, we have no record of [redacted] calling on either November 9th or 10th (we keep a log of every call/message left), nor have we received a formal letter to cancel her membership within the cancellation period. The only call we have on record for [redacted] was her calling after the payment went through. She then acknowledged on the phone with our manager that she in fact did not call to cancel her membership like she has stated here. She acknowledged the fact that she did forget to come in and process the cancellation within the three day period if she was indeed relocating. For these reasons Emerald City Athletics was unable to extend a refund per [redacted] request.
Complaint: [redacted]I am rejecting this response because:Since my claim has not been addressed by a point of contact above their General Manager, [redacted], I have decided to consult with my lawyer on this matter. I was harassed by this business and no effort has been done to keep [redacted] accountable for his actions. [redacted] is someone that works for [redacted] and has sent the same response back. Therefore there I will be consulting a 3rd party to address this issue to resolve this matter and will be filing a harassment claim.Sincerely,[redacted]

I am rejecting this response because: this information was already provided to ECA when they requested it and just failed to have a copy on file. I have been charged for several months of the membership and have not used the facilities.

We are sorry and of coarse it is unfortunate, that [redacted] didn't submit the cancellation paperwork back on the date that she decided to discontinue use of the club. We do not charge members beyond what is stipulated in the agreement. Like any gym, we have a cancellation policy...
that we adhere to. [redacted] received a copy of her signed agreement when she joined back in 2014 and therein is stated the procedure to cancel a membership. It is not hard, and we don't even require a person to come into the club to do it in person if they don't want to. Everyone has the same two options to cancel: 1. come into the club and speak with a manager to sign the cancelation form, or 2. send in a letter stating your wishes to cancel membership that is sent via certified mail from the local post office. [redacted] husband [redacted] cancelled his membership back in August of 2015, we received his signed form and processed the cancellation no problem. We are sad that [redacted] has been unable to continue using the facility during these past few months and as a courtesy we are more than happy to extend her gym access out an additional 60 days free of charge. With this, her access will be valid at all three of our locations. The Everett club even has Sports courts and swimming pool, plus free family hours during certain time periods on the weekends.
