In response to *** ***'s complaint, the charges that were deducted from his security deposit in the amount of $was for cleaning the following: Secure vent hood grease filter Clean oven Clean fan blades Clean toilets Clean microwave Clean window sills Pictures were provided and *** ***
discussed all charges with our Property ManagerAny repair requests have to be approved by the ownerThis property had foundation issues, which *** *** was made aware prior to entering into a lease, and some repairs had to be done multiple times due to the foundation continuing to shift*** *** was sent a refund in the amount of $1,on March 10, Regards,

May 22, *** *** was notified on several occasions of the charges to his security deposit, and the reasons for the chargesHe was also provided with pictures of the damages that were taken immediately after he surrendered the propertyIn no way were the charges to *** ***'s security
deposit for anything other than items that were beyond the scope of wear and tear1. The yard was not maintained and when *** *** surrendered the property the grass and weeds were approaching 12" highThe shrubs also had to be trimmedIt was obvious that *** *** did not maintain the yard as required by his lease and that includes the use of weed control and watering2. *** *** had walked around the house "smearing" spackling is the holes he had created while he was a tenantThis action required that the wall be painted3. As *** *** stated in his complaint, he did not clean the houseThe house was dirty as were the appliances and he was charged to clean both4. *** *** chose not to clean the carpet as required in his leaseWe had it cleaned and he was charged for this as well5. Nearly every window blind in the house was damaged during *** ***'s tenure, and all had to be replaced6. Other things requiring repair or maintenanceDoors were taken off the hingesThere was a broken vanity mirror with glass chards laying on the bathroom floorThe AC filter was dirtyLight bulbs were burned outDoor stops were missingLight fixtures had to be repairedAs stated, *** *** was aware of all of these items and he was provided with documentation to support the chargesHis claim regarding no heat/air are baselessAll of his request for HVAC service were take care of in a timely manner*** *** Emerald Residential Property Management

The complainant was furnished a copy of the painter's invoice which specified the areaspaintedThe work was billed as lump sum amount so hours and material were notlistedThe painter is an independent contractor and is not an "in house contractor," as hedoes work for many companies and
individualsAll funds billed to the complainant were paidto the contractor

We work with multiple contractors and feel that the fee that was charged was fair and because we workwith these contractors on a regular basis, their fees are reducedIn order for the walls to look good andnot splotchy, there is more to a "touch up" job then just filling in holes and painting that one area

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my dispute.
Please enter your reason(s) for rejecting the business response below.No other estimates were gotten for the work, I feel that most painters would charge far less for the amount of touch up paint show in these pictures. Considering that there was touch up paint left in the garage, that I used to touch up the walls, I can deduce that this painter also used that same paint, also there is no receipt of paint purchased to lead to me believe otherwise. Therefore the $350 must be for labor only...lets just say he was there 3.5 hours...that would mean the painter gets paid $100 per hour! I am not satisfied with the response because I don't feel that the home owner would have paid these types of rates out of their own pocket, and I don't feel that I should have to either. Maybe Emerald Property Management should send the pictures of the touch up work that needed to be done to some other painters in the area, and see what they would have charged in order to prove that this is a reasonable charge for the work done.
