Thank you for your inquiryAs a courtesy to our customer we are in the process of trying to get this matter resolved with his insurance companyWe have provided all work to our customer under the terms of our contract which was accounted for in the scope of work provided by his insurance company and attached to our contractWe even replaced additional shutters that weren't scoped to be replaced (at our expense) We will follow up with you when we have reached an amicable agreement

We were contacted by [redacted] , [redacted] s Wife on M.arch 17, due to a flood in his basement after another contractor was there and pumped out the basement leaving everything wetWhile at the home working the Insurance Company sent out an adjuster and a brief scope of work was discussed to achiev?? the first round of mitigation workWe brought drying equipment to dry out the structure, a dumpster to remove wet contents from basement, and install a new furnace to provide heat for the drying process along with some other detailed itemsThe mitigation invoice that was submitted to the insurance company and customer was $15,+/- Which clearly states what work has been done and to date have only been paid $3,which was paid.on 9/15/due to complications with the mortgage companyOn June 6th I received the insurance company's first estimateThe amount of the scope was $8,which included the amount of $3,as reimbursement for the work paid to the 1st contractor paid by the custom??rsAfter several emails and phone calls back and forth with our customers and their insurance company and adjuster another site visit was conducted in Mid-July with the insurance company's adjuster to have him document the items of concern necessary for the proper scope of repairOn or about July 26th a complete scope of repairs was submitted to the insurance company which then prompted events the first event was a response from the insurance company adjuster stating the insurance company won) pay for the environmental clecosts and that he would recommend what he could from the estimate I submittedThe second event was and email generated by the adjuster stating the claim was now under investigation A complete scope of work was never been reachedWith the customers being out of the country extended periods, communication is by phone, texts, and some emails or on occasion in person while in townI informed Mr [redacted] that email isn't always the best way to communicate since most of my time is in the field workingI have answered emails, spoken to him by phone along with his wife, answered text messages each time to go over his claim reiterating each time that a scope of work needs to be reached before we can move forwardThis is an insurance claim and scope of work needs to be agreed to with the insurance companyThe pri??ary concern of the agreed scope being reached with the insurance company is that there sometimes limited or no coverage for environmental remediation activities such as mold or asbestos or the agreement of scope of work we proposedWe are licensed in NYS to do both mold and asbestos remediationWe recommended to our customers to have third-party consultant provide an assessment due to conditions in the basement and verify the mold /asbestos concerns with tape on the heating ducts which that report was forwarded to the customersThe customers have this report and pricing to do such workMr [redacted] has a dirt floor and sump pump in his basement so there is always a potential problem for mold even prior to his loss occurringNo repairs could start until the mold and asbestos issues were correctedOne of Mr M??nning's primary concerns was to restore water to his home however until the remediation work was completedYou can't replace the water system until this is done due to cross contamination problemsAgain, the customers have been advised this numerous timesA repair proposal/contract was sent to Mr [redacted] on 4/26/with projected dates of May-July this contract wasn't even returned signed until 6/26/A revised insurance company approved scope was received 10/20/increasing the scope of repairs from $8,to $27,together with a letter stating that there is no coverage for the mold/asbestos remediation costsThis information was again reiterated to Mr [redacted] at a meeting on October 20, Mr [redacted] and I agreed to develop a game plan which included his meeting with a Licensed Public Adjuster to di-scuss and develop a strategyAt my meeting it was discussed with Mr [redacted] that the revised insurance check he received was going to be submitted to his mortgage company for release of funds and those funds were expected in December and once we were paid those funds we would continue to discuss with the insurance company for the items still missing from their revised scope of repairsWe expected the check to be mailed directly to his home and that he was going to be out of the country and having his house sitter looking for the check so he could get us our funds which never happenedA check was issued from his mortgage company on:December 14, in the amount of $8,which EXPIRED ON MARCH 14, and was certified mailed from Mr [redacted] to us on April 8, Mr [redacted] returned to his home and found the check and that it had already expired and then certified mailed this expired check to us along with a letter stating that I have not responded to emails or text messagesI may have not answered a few emails but have never, not responded to a phone call or text messageIn his ·letter he refers to our contractual agreement which again states that our work is subject to agreed scope and pricing set forth within insurance claim and that 1/of our contract will be paid at acceptanceWe remain able and willing to with continue assisting Mr [redacted] with the repairs once we are paid what we are owed for work already provided and an appropriate draw on the balance of the work neededHowever at this point in time we have in good faith done all we can with no money
