LETTER-SPACING: -0.15pt'>This letter is in regards to*** *** complaint against Emergency Response Gear LLCAs per *** *** complaint on February 1, on a verbal layaway plan that he stated was from 3.2/28/2015, the actual date the transaction took place was 12/21/*** *** was a previous employee of Emergency Response Gear, therefore we allowed him to place a firearm In layaway on a verbal contract instead of the regular written process which is procedure*** was let go from Emergency Response Gear, due to his lack of ambition and work ethics*** is the grandson of an elderly man who is a regular that comes to our store every day from open to close; this is why the exception was made for the layawayHis grandfather and I agreed to give *** a second chance on a layaway*** assured hls grandfather and I that he would do the right thing and pay the layaway as per discussed'
*** *** did not pay the layaway in the days as was agreed and he knew the consequences would be the loss of both his money and the firearm*** *** was upset as he was also told he was not allowed or welcome at Emergency Response Gear retail store any longerDue to the relationship we have with *** *** grandfather we had tried to give him another chance, even after his employment was terminated
*** *** stated In his complaint that he had paid $and that he had paid 25% down*** would not have paid $plus 25% down on a $firearm, his statement does not make senseHe is fabricating a story, which is typical of *** FowlerI would like to see a receipt for the $400.00, plus the 25% down that he is disputing
*** *** also has given an address that is not his correct address; we believe that the reasoning behind another address is so that his grandfather didn't find out what he was doingWe have noted his correct address and we have also shared this information with his grandfather and he is also willing to give a statement that *** is in the wrong regarding this matter
We believe that is whole fabricated complaint is due to *** being told he was no longer allowed or welcome at Emergency Response GearThis decision was made after several chances were given in an effort to help *** is very jealous of his grandfather's ability to come to the gun store on a daily basis and the fact that his grandfather chooses to spend all day from open to close at the gun store

I do NOT agree to a spending credit because I do not spend my money at a place of business that cannot admit they ordered the wrong itemI also do not spend money at a firearm dealer's store who is too incompetent to realize that they ordered the wrong itemThe fact remains; MrR*** spoke to me when I visited his store, my husband when ordering, and me when it was wrongAs MrR*** said in his statement to *** ** ***, " Mr*** ordered the "Sig Sauer P229" and the base model was ordered"Due to MrR***'s incompetents, he ordered the "Sig Sauer PSAS" modelThe SAS model is a custom model with significantly different features and is clearly NOT the base model that MrR*** said we ordered.

I bought and paid for jeans new and we received thousands less and they were suppose to be new and they were used and abused non salableThey told me too bad and I sued they in Federal Court in Los Angeles and they did not appear and we presented our case and got a judgement and then contacted an attorney in South Carolina that finally got us paidThey are not reputable

First I'd like to clear up a statement made by Mrs. [redacted]: We DO NOT run a corrupt business nor have we ever, that is why we have...

tried In every way to resolve this issue. Mrs. [redacted] has made this situation a hostile one, every step of the way. We are not holding ANYTHING hostage. Mrs. [redacted] doesn't seem to understand that we only ordered the firearm that her husband instructed us to order, which was a Sig Sauer P229, there was never any mention of a pictinney rail or any certain model. There is many different models that have different accessories that are P229. If Mr. & Mrs. [redacted] wanted a different model than that's what should have been stated. This is why we encourage our customers to come into our store when special ordering items. Mr. & Mrs. [redacted] had NO Firearm knowledge when then initially came to our store, but stated they were going to a friends to shoot and to decide what they wanted to purchase. We have tried every avenue to please Mrs. [redacted], including returning the firearm to the distributor and ordering the Sig Sauer with the pictinney rail that she decided after the fact that she wanted. We also went to a trade show and spoke directly with the Sig Sauer Rep. and they were willing to waive the 25% re-stocking fee that they normally charge, in hopes of keeping the customer happy; however there would be the additional charge for the additional accessories on the firearm they were now wanting. We told Mrs. [redacted] that there would be an addition charge for the additional accessories of $55.00; we were told by a mutual friend that she stated she would NOT pay the additional cost. We also offered to credit her credit card minus the 20% restocking fee, the 3% for using a credit card, and the shipping and handling fees that we obtained due to her order.
We have stated all of the above information to Mrs. [redacted] and to her credit card company. Her credit card company did initially take the money from our account, but has sided with ERG and returned the funds to our account, due to the facts, not the fabrication that Mrs. [redacted] has fabricated. Our distributor is holding the credit due us from returning the firearm to them, until this issue is resolved. ERG has return policy noted in several locations of our business and it clearly states Special Orders are NON-REFUNDABLE. As I stated previously we do NOT run a corrupt business and we pride ourselves in taking care of our customers and that is why we tried every avenue to make Mrs. [redacted]s experience with ERG a good experience.

The statements made in Mr. R[redacted]'s response are false and deliberately fraudulent against myself and [redacted]. Mr. R[redacted] is incorrect that [redacted] sided with him in this matter. He is under this assumption because he knowingly lied and deceived [redacted] in order to get the money back; however, his efforts are being reviewed and I am pursing fraud against Ken R[redacted] and Emergency Response Gear. Mr. R[redacted] was asked to order the base model Sig Sauer P229, as he clearly stated in his statement to [redacted]. This artifice being perpetrated by Mr. R[redacted] is illegal and downright unscrupulous. The base model, as proven in the Sig Sauer online catalog clearly shows that the base model P229 comes STANDARD with the picatinny rail. This WAS NOT an after thought because when you order an item that comes standard with something it is not a thought that it wouldn't come with it. The FACT remains that the base model was asked for and Mr. R[redacted] ordered the SAS custom model. This FACT is proven in the photos that Mr. R[redacted] sent via text message on 1/15/2016. The model SAS is CLEARLY shown on the firearm as well as the custom shop logo. My husband and myself at no point in time said that we did not have firearm knowledge and I think that is quite evident in the FACT that I know more about the Sig Sauer P229 than Mr. R[redacted]. Which I find odd considering he sells firearms! I knew it was wrong and NOT THE BASE MODEL as soon as I saw the photos sent by Mr. R[redacted]. Mr. R[redacted] at no point in time offered to order the correct model as he offered to order the Crimson Trace model, and if Mr. R[redacted] had the knowledge about Sig Sauer firearms as he claims, than he would know that the Crimson Trace model has been discontinued for quite some time. To get the accessories that were requested(E2 grips and 15 round magazine) the base model would suffice and would include the rail which was also wanted, but not required to specify to a supposed, reputable dealer because they would know this! In fact, the SAS model that Mr. R[redacted] ordered comes with a 13 round magazine and that is just ANOTHER incorrect feature. I refuse to pay any additional fees for restocking or shipping mentioned by Mr. R[redacted] due to his scam or incompetence, take your pick. This was NOT my error and I'm sorry that Mr. R[redacted] can not own his mistake, but I am not liable to pay for something that is not what was described or asked for. It is not my fault that Mr. R[redacted] did NOT order the base model as he continues to claim and I can not, by law, be held responsible for the item or additional fees due to his error. I have attached supporting documentation.

This letter is in reference to the complaint ID# [redacted] by Mrs. [redacted]. There are several items in the attached documents that I have received that I would like to address at this time. First and foremost Emergency Response Gear, DOES NOT and I repeat DOES NOT, nor have we ever run a corrupt business. I am a very professional business owner and Mrs. [redacted] clearly does not understand Professional Business practices. Mrs. [redacted] has stated that I do not even know her name; I have been brought up to refer to Individuals as Mr. and Mrs., when it is a situation that you do not know an individual's first name. I dealt with Mrs. [redacted]s husband, NOT with Mrs. [redacted], except for the one phone call she made to Emergency Response Gear saying she wanted the Sig Sauer with the picatinny rail; this was after the original gun arrived. Mrs. [redacted] was extremely hostile and violent in her tone of voice and words, I at that time told her I was NOT her husband and I would NOT allow her to talk to myself nor my staff in this manner. I have not heard from the [redacted]s since.
I feel as though Mrs. [redacted] has a vendetta against Emergency Response Gear and me personally. The slander against Emergency Response Gear and me needs to stop. This is now nothing but threatening and the next action we will be taking is going to be through our attorney.
If Mr. [redacted] would like to clear up this whole Issue, we have a pending credit for $721.47. This amount is the original amount minus the fees that have been detailed in the numerous letters and statements. We are more than happy to Issue the credit to the credit card that was originally used for the special order that was placed by Mr. [redacted].
