Dear ***,
Firstly let me say that I am surprised that you have filed a complaint with the Revdex.com as I have been responsive to your every phone call and e-mail and very willing to help you with all your issues
and concerns, as I am with all my clients.
Your lamp post was installed in 2008, years ago*** recommends a coat of their stain every yearsYour painter, not a *** representative, recommends a coat every years, none of which you have done*** states in the product information, given to you, that their cedar wood products undergo a natural process called “checking.” “As wood releases moisture, checking can occur across or through it’s annual growth ringsThis result of wood seasoning occurs on the surface of the wood and does not affect the wood’s structural performance or integrity.” You did receive information on *** wood products and what to expect from them before installation and upon delivery The recommended installation of a *** wood lamp post requires that there be a gravel surround base below the post for drainage and a cement footing, as your post hasThe post IS factory stained and it IS stained below grade I have been installing their products for years without an issue*** does not give guidelines as to installation charges for contractors, so your claim about *** informing you about any overcharges is unsupportedThe price of the lamppost alone does not include installation or electrical installation Your complete post, oval sign lantern installation was a total of $ 1,Your electrical install is still good and can be used, so remove that cost off your claim please The electrical install was not performed by Emil PWeiss Landscaping IncYour lantern at the top of the post is still good, so remove that off the claim as well, and the sided sign and bracket with “* *** ***” embossed on it , is still usable and in good condition So these items will not be replaced by Emil PWeiss Landscaping Inc.
Not claimable or replaceable:
Sided Sign $
Post Mount Lantern $ Labor to install (included first year’s painting) $ Electric install provided by electrical contractor
This is the cost of the Post alone: this is the item that the ***’s seem to have a problem withPost cost $ + tax
(This was what *** charged for their cedar post in 2008, as a contractor I receive a 10% discount ($ is what my cost was for the post) so as far as the ***’s concerns about my overcharges are concerned they are completely unfoundedDelivery from Maine $
As for your side comment about plantings I would like to state that I have not been contracted to perform any of the necessary spring or bi-yearly maintenance that a planting like yours requires, since the installation in Over the years and throughout the growing season I drive by your home and plantings, and have noticed several times that plants were extremely dry in warm weather and that NO pruning, mulch or proper maintenance has been preformed at your property, I have called you several times on these occasions that I have driven by to alert you to watering and or other maintenance issues but I have not received a response from you nor have I seen watering or any other necessary maintenance preformedIn fact, I added plants on your hillside for no charge on when you complained about the area of the planting where the school buses hit when making a turn When I noticed that you did not water, mulch or prune or perform any maintenance on these plants I assumed that you were not as concerned about your property as I wasAlthough I did not feel responsible to make additions and replacements as the damage occurred due to your lack of watering and mulching, fertilizing, and general neglect, I did want you to know how concerned and conscientious I was to your needsAs of today, your plants that were replaced and your existing plants (cotoneasters) have grown in and covered the hillside, but no weeding has been done and no pruning has been done to dead wood that was ruined by salt spray from street salting over this past extreme winterMaintenance is recommended for this area to keep your planting looking good and in good condition Your concerns about the lamppost and my plantings are due to your neglect and improper maintenanceAs Emil PWeiss Landscaping Inchas not done any maintenance of your property since the installation in 2008, I can not be responsible for any issues that normally need attention within a year period of neglect, I can not make FURTHER replacements because of your neglect and carelessnessShould you make a replacement of your post or your plantings with another contractor I suggest you perform all proper watering, pruning, mulching, painting, etcto avoid this situation again Although I accept NO responsibility for the ***’s lamp post and plantings, I will as a gesture of good faith, neighborly concern, and my general willingness to help any client in the years that I have been business, I will purchase and deliver to the ***’s property (my cost) a new *** post from *** for them to install by a contractor of their choice*** Woodworker’s has arranged for me to purchase an *** vinyl post of the same size, shape and quality and the ***’s will not need to paint or perform maintenance and will solve the maintenance issuesSincerely,
Emil PWeiss

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.  Please note:  We are not in any way agreeing that any of the nasty statements made by Mr. Weiss are true and accurate regarding the rotting post.
Regards,

[redacted],
After many e-mails between [redacted] of [redacted] & Emil Weiss Landscaping, we both feel that your demands were not warranted.  And since it has been over 6 years since the products were installed, we feel that you needed to do some maintenance work far before this time and that was simply not done to the post.   There is checking in wood products as we have advised you of, and this could all have been corrected with caulk and stain as Emil Weiss had offered to you in late September, 2013.  Since the weather was quite wet and unstable since his last conversation on site, he did not have the proper conditions to address this issue with you.   So you decided to use the Revdex.com for this matter.
[redacted] and Emil Weiss Landscaping would like to offer this ONLY solution to your unhappiness with their post and my installation of their product.   We will both share the cost of a new [redacted] post and bracket which will be sent directly to your address for your installation.   We will not cover any other costs, not pay any other amounts of money for any installation nor any electrical rewiring at all.  If these terms are acceptable, then I will make the necessary arrangements to have the post shipped to your home ASAP.   I am hoping that this will satisfy you as a final resolution to your complaint with both of our companies.

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the response. If no reason is received your complaint will be closed Administratively Resolved]
 Complaint: [redacted]
I am rejecting this response because:  We do not believe it is fair for us to have to pay the expense of taking out the old post and reinstalling a new post.  We are requesting the cost of the new vinyl post and installation.  Recognizing the cost of the vinyl post is higher than the original cost of the wood post we are requesting approximately $700 to cover the cost of the new post with sign holder, delivery, and installation by [redacted].  In order to reach an agreement we are willing to assume the cost of rewiring the new post.  We also would prefer the post be installed early next spring or this fall so as to cause the least disruption to our plantings.
Regards,
[redacted]

Review: In 2008 we hired Emil P. Weiss landscaping to install a lamp post as well as plantings on our property. Mr Weiss recommended a post made by [redacted]. The post displayed cracks when it was installed and every year has g[redacted]en worse and is now r[redacted]ing in the ground. We paid nearly $2000 for this lamp post and after talking with the [redacted] company we discovered that Mr. Weiss over charged us for the lamp post above and beyond the expected installation charge. We also discovered that putting cedar wood under ground is not advisable because it will rot. Had Mr. Weiss told us our lamp post would rot out within 5 years we certainly would not have approved of this project. Mr Weiss claims that the post r[redacted]ed and cracked because we needed to restain the post every year. We find that claim to be ridiculous since the under ground part is not stained at all and a professional painter has evaluated the above ground post and told us that it should have only needed restraining approximately every 5 years. We have had problems with the plantings Mr Weiss installed but at this point the lamp post is our greater concern.Desired Settlement: We would like Mr Weiss to replace the lamp post or return our money so we can go hire someone else to do the job appropriately.
