Review: I hired [redacted] with Emmett Estates to be the property manager of my rental house. The signed contract with the tenant ([redacted] states that the renter is responsible for any damaged or missing items or property. When the tenant ([redacted] moved out, she took a $200 table that belonged to me, the property owner. It was [redacted]'s job to ask for the table back or secure the value of this table from the deposit money that was collected from the tenant ([redacted] We have extensive photo's of our entire property to prove the table was in fact at the property at the time the renter took up residence at my property. I visited the property several times to do repairs and, in deed, saw the table at my property. Upon vacating the property, the renter falsely claimed the table did not exist. The renter was very upset because she was charged for some damage to the property and I believe she is keeping the table to make up for the difference. This contract was violated at other levels as well. The signed contract stated that only the ones who signed are allowed to reside but [redacted] knowingly allowed two other people to live there without our knowledge (contract breach).

Initial Business Response

After being hired to manage and find a tenant for [redacted] I secured an application and granted approval for [redacted] and [redacted] Shortly thereafter, [redacted] chose to reside in Australia permanently and [redacted] came to reside at the address with [redacted]. An application was collected to verify qualifications, and permission was granted for the new person to be added to the lease. [redacted] had partial custody of his son as well. A walk through was performed and signed at move-in, however, I do not have a folding table listed on this and do not recall such a table on the premises. I was also asked for an antique shovel to be returned, but again, have no knowledge of such an item as being onsite. Regardless, I did make a request of [redacted] to look through the items she moved, in case perhaps this table had been packed up by mistake. Unfortunately, according to [redacted] after inspection, she shared with me that she did not see any table like this in her moved possessions. It saddens me that there remains underling confusion and frustration with this situation, however, I am not able to produce these items. It is important to note that the home, itself, was left in the most pristine condition I have yet to be greeted with upon a tenant vacating. I did issue a credit to the owner of $127.09, which was deducted from the deposit put up at move-in from the tenant. These charges were for the full cost of a computer cable which [redacted] reported at an original cost of $27.09, and $100.00 toward landscaping. Even though I checked the box for tenant responsibility of landscaping, the owner had assumed responsibility for landscaping since inception, first by hiring their son who rarely showed, then by doing it on their own, and finally by requesting I hire someone to do a mow, edge, and blow at $60 for 2 visits monthly. Even so, I did issue the $100.00 credit toward landscaping.

This is an unreasonable request. We did not go into [redacted]'s dwellings to take photos after she moved in, but we did take photos of everything (including the table), just prior to her moving in. This method is acceptable to insurance companies for collecting losses. This table was mentioned to Emmett Estates, but was not included in our contract upon our request. We do not feel that we are the ones to be interrogated here. [redacted] and the two other adult renters (who were never signed onto the contract) should be the ones to be questioned as to who took the table. We are still requesting the table back. If it is not retrievable, we would accept $100 in it's place.

To address the matter at hand, I would be happy to supply a full refund if photographs can be provided which show the folding table in question as being at the property during the tenancy of [redacted]
