Complaint: ***I am rejecting this response because:
While I did enquire with Bellingham IVF about the option of storing my sperm with them, I clearly stated that I did not wish to store my sperm straws with them (see attached), nor did I intend to become a patient as I was no longer near the West Coast (en route to the East Coast)When my straws were erroneously shipped to BIVF, Bellingham IVF confirmed that my straws would be refused (as I was not a patient) and rerouted to a long term storage facility in Florida should they fail to be rerouted by the shipper (see attached)BIVF did not comply as promisedInstead, they accepted delivery (allowing my straws to expire) and made no further efforts to inform me they'd taken possession of my straws against my wishes, though they were clearly in possession of my all my contact informationWhen I discovered this violation, I attempted to collect my straws per BIVF's originally quoted terms, they refused to release my straws to meIt quickly became apparent that BIVF was making impossible demands in a clear effort to shift their negligence to an unsuspecting third party, when the simple and standard protocol would have been to provide a charged cryo tank (preferably the one they stole) and return my straws to meGiven every opportunity to do so, they have repeatedly refused, and then proceeded to refuse communicationIt is only too clear that this is due to the fact that they allowed my straws to expire and then disposed of the evidence, fabricating endless lies, omit and alter evidence to distract from these basic truthsIf this was not the case, they could at any time return my straws, tank, etc to me, so that I might have them analyzed in a lab for viabilityInstead they've chosen to steal my tank and destroy my irreplaceable sperm straws.Sincerely,*** ***

This is our response to the claims of this individuals statements
I am forwarding the emails from all of the correspondence in regards to this situation
It is unfortunate that a business has to respond to such accusations but sometimes we run into
individuals like thisSo, in response, this individual gave the Florida based Sperm Bank our information to send her samples to, which they did. As a courtesy, we accepted them since she expressed interest in becoming a patient. The claims she has made are due to her lack of knowledge and understanding of how the shipping of a frozen sample is done. Our mistake was being considerate, when we should have demanded that she establish herself with us first
With nearly every accusation and request she made we emailed a reasonable response but her lack of understanding of the methods used to ship samples only seemed to frustrate and confuse her moreWe are not sure she understands our responses to her emails since she adamantly kept demanding the same informationWe spent months of trying to work with her with almost emails between us (as yet she has never given any of her personal information, we only know what the originating sperm bank sent us.)
We spent numerous hours and then months of trying to get her to make a decision, become a patient or have her samples sent to another clinic or sperm storage facility. She refused stating that we were responsible for the awful situation of accepting her sperm and were not meeting any of her requests and therefore demanded free services to make up for it.
Of course at this point we decided not to accept her as a patient and gave her two choices, set up an account with a storage facility or clinic. Instead of doing such a simple task her response was to get a lawyer but after we sent him the correspondence from this individual we never heard from him again
We again requested that she establish an account at a sperm storage or clinic, she responded by contacting a local arbitratorAfter agreeing to arbitration to settle the matter and being on the phone for over an hour we still had not resolved the situation, so we agreed to another arbitration but, just days before the scheduled second arbitration, she informed the arbitrator that she was going to be out of cellular range thus avoiding getting resolution again.
Since it was apparent that she was not going to take steps to have them sent elsewhere we tried to get her sperm samples returned to the sperm bank that sent themThey refused to take them back because of her threats to their company (she demanded a total refund from the sperm bank as well as trying to get her VISA to deny payment for the sperm samples in question)
Working with frozen sperm samples is part of what we do as a fertility clinic, this is the first time anyone has made accusations of incompetency, of kidnapping and of denying them a child even before attempting to become an established patient.
She has threatened lawsuits if we did not provide free services and treatments for a situation that could have been easily resolved by doing what any person would do, set up an account with another facility if the current one is not meeting your needs to your satisfaction
To sum it up, we have spent numerous hours on emails, arbitration and meetings to resolve this issue, she has not taken any reasonable steps to end this situation, even other facilities and lawyers do not wish to accept her anymore. It is sad, as well as frustrating for us when an individual attacks us in such a manner, we always make great attempts to ensure our clients happiness
It’s unfortunate that some individuals need to attack, make defamatory remarks and reduce themselves to extortion when they lack the understanding and methods used by businesses they seek services from
We understand her fear of losing her samples by shipping them, accidents do happen, but her accusations are without merit. We have been established here for almost years and in that time only shipment of sperm has arrived thawed. So, the percentage of her samples being viable are the same as all samples shipped to us, extremely high. Simple solution, she should just take out a credit card, make a phone call to a storage facility and we would gladly ship them there as we have stated from day 1…
