In response to [redacted] ...The fact that he saw either 2-apartment is a bit irrelevant at this pointThe fact is that [redacted] did view and apartment that he decided to apply for of which he brought in ALL the requirements that we asked for and got APPROVED [redacted] does contradict himself by stating that he "did get a call and arrange a date for monday" and then he goes on by saying "then I was going to be noticed of date and time of the meeting with management witch I did not get" Clearly we made an arrangement for Monday May [redacted] at 4PM to meet with management and sign lease.Again, after we set the date and time to sign lease[redacted] bailed out indicating that he has a "Family Emergency" and that he needed to leave the country in days

On Friday August **, 2017, [redacted] meet up with me interested in an apartment for rentPrior to showing any apartments to ***, I told her that she must read and sign the agreement before seeing any apartmentsOnce she fill out the agreement, I showed her the apartment and she like the unitShe then ask what are the documents and fees needed in order to apply for the unitI told her all the documents needed in order for her to apply for the apartment and that she would also have to pay a depositI Told her if she does get the unit her deposit will be refunded back to her except the credit check fee of $due to management using it for checking her creditShe ask if it was a guarantee that she will get the apartmentI told her that there is no guaranteeThere are other applicant applying for the unit and it is up to the management to choose the best qualified candidateThen she said that my fee was to much and she requested the contract back I told her that I have to consult with my broker first and I ask her to come with me back to my office she agreed to go back with me to the office I spoke with broker and I gave her the original contract back

I've viewed many apartments and found there was no "agreement or contract" to signThe factor of this man keeping my ***al information with no further business is conniving and scandalizingI did receive the original yet I haven't had the slightest clue why he made a copy of my originalI followed him back to the office to seek more information from his colleagues yet they too seemed clueless on the situation. What needs to be done is an investigation on how these businesses keep people ***al informationWhat is the interest and how do they operate with file folders of people's documents? Is it identity theft?

Yes I choose an apartment but it appears that Johnny has selective memoryYes I got the call from Johnny and stated that I was pre-approved for a interview and possible lease signing.because I was I my way to work and couldn't make it that Friday.I asked Johnny if it be on Monday and stated that he would call or text me with the date ,time and where later I'm the day hadn't He would after he talked to the property managerBut I never got that infoTill I contacted Johnny via email that I had a family emergency that's when I got the info and stated that I was approved that's where Johnny Contradicted himself.Again pre-approved and approved are different thingsTo bad that the call wasn't recorded

She ask if it was a guarantee that she will get the apartment. I told her that there is no guarantee. There are other applicant applying for the unit and it is up to the management to choose the best qualified candidate. Then she said that my fee was to much and she requested the contract back I told her that I have to consult with my broker first and I ask her to come with me back to my office she agreed to go back with me to the office I spoke with broker and I gave her the original contract back.

[Your Answer Here]All information stated by the business is not all accurate. yes on April ** 2017. I went to see 3 apartments at 2 locations. first location ([redacted]) was not accessible or was not ready whatever the reason wasn’t able to view it. then I was shown the other 2 apartments on ([redacted])and 2 on ([redacted]). then on May**,2017 yes I did get the call and arrange a date for monday and then I was going to to be noticed of date and time of the meeting with management witch I did not get. but also stated on the phone that I was pre-approved for the apartment. which to my understanding is I didn’t get the apartment till I provide some kind of more information in person.after the meeting with management would provide approval or not.I feel I was not approved at that time and did not get the info of the meeting on time as was stated on the phone.         I got the date and time of Monday may ** 2017 at 4pm. on Sunday may ** 2017 after I advised the business that I could not make to meeting with management due to unforeseen family emergency out state.         Another issue that I have with the business is no one had intruded themselves in the office from day one. and I feel thats lack of Leadership and Professtionalism.

As my previous response, before meeting [redacted] I told her about the contract that she must sign before previewing an apartment. When we met her, I specifically told her and explained about the non-disclosure form. She asked for my pocket card (real estate id) and my business card which I showed it to her. She asked her daughter to take pictures of it. She said there are too many scammers. I told her the fee is negotiable to a month and half of the rent instead of the 15% of the annual rent. The apartment was for her daughter and she was there with her too. She would be the guarantor for her. She stated the studio was priced at $1,200 however it was advertised at $1,175. In my previous response I stated the unit was not guaranteed to be theirs. More people apply for the unit and it is up to management to select a candidate for the unit. I never told her I will give her the contract back if she did not like the unit. When she asked for the contract back I told her we have to go back to the real estate office so that I can speak with my broker. She tail gated me to the office. I parked my car and I waited for her and we walked in together to the office. I talked to my broker and I gave her the original back. She was provided with the original contract. As a sales agent I complied with the policy and procedures.

On April **, 2017 [redacted] came into our office inquiring about apartments for rent. We gave him an application to fill out. We then mentioned the available units of which he decided to view 2 of the units. On April **, 2017 [redacted] came in for a second time and viewed 2 more units...

of which he decided to take one of them. We gave [redacted] a check list of all the required documents, credit check fees & deposits he needed to bring in in order to apply for the desired unit and we also explained that the management needed more or less (+/- ) 5-7 business days to review the application. Any deposit we collected were going to be held in an Escrow account and in the event that [redacted] did not get approved for the unit we would either get him another unit or we would give him the full refund except the credit check fee. We also explained that in the event he decided not to take the unit after the application for the specific unit was approved, then the broker’s fee will not be refunded for our time and effort in getting him the unit.On April **, 2017 [redacted] came in and brought all the required documents, credit check fees & deposits of $1,875 (Broker Fee) & $1,200 (Security Deposit towards the apartment). Before he gave all the required documents and deposits, we re-iterated what our policy is regarding any refunds of which it is also stipulated in our in-house apartment application. The following Monday May **, 2017 I submitted the application to the management. That same day (May **, 2017) management communicated that they need additional documentations of which I let me Camacho Know and he complied with the missing paper work. On Friday May **, 2017 management indicated that they wanted to conduct an interview and sign lease with [redacted]. I relayed the information to [redacted] and he stated that he is unable to go in for the interview and lease signing that same day because he was already on his way to work. But indicated that he can go in for the interview and lease signing the following Monday May **, 2017. Both Management and [redacted] agreed to go in for interview and lease signing on Monday May **, 2017 at 4:00 PM.A day before the scheduled interview & lease signing (Sunday May **, 2017) [redacted] emailed me and indicated that he had a “Family Emergency” and that he needed to leave the country in 3 days and that he need the money for travel. I told him to stop by the office to pick up security deposit for $1,200 but The brokers fee is non-refundable since we got him the apartment and management was ready, willing and able to interview and sign lease but [redacted] backed out.On Wednesday May **, 2017 [redacted] came in to our office and collected the Security deposit back.
